Muovendo dalle origini del ‘diritto della prevenzione’ e dall’impegno ermeneutico alla tipizzazione delle fattispecie di pericolosità, lo studio si sofferma sulle riforme più recenti che hanno interessato il c.d. codice antimafia, mettendosi in dialogo con gli apporti ‘correttivi’ della giurisprudenza di legittimità e con le posizioni dottrinali sulla natura giuridica della confisca di prevenzione. All’analisi della disciplina vigente si congiunge una lettura dell’istituto alla luce del principio di proporzione. Nello specifico, l’Autrice si interroga sulla conformità della misura ablatoria rispetto alla c.d. proporzione in senso stretto, valutandone la ragionevolezza sulla base dei presupposti fattuali che ne autorizzano l’impiego e di altre sanzioni affini, disposte per fenomeni di uguale gravità. Anche la c.d. proporzione in senso ampio (idoneità, necessarietà e adeguatezza) viene indagata, approfondendo il rapporto tra la ‘limitazione della proprietà’ (an, quomodo e quantum dell’apprensione reale) e il soddisfacimento dell’interesse generale, di ‘lotta’ alla criminalità e alla circolazione dei capitali illeciti. Il testo si completa con uno sguardo alla legislazione europea in materia di congelamento e confisca dei proventi di reato, nonché alla disciplina delle confische allargate di taluni ordinamenti stranieri e a soluzioni alternative all’apprensione patrimoniale previste dall’ordinamento nazionale (amministrazione e controllo giudiziario), quali esemplificazioni di convincenti attuazioni del principio di proporzione.

Nell’ultima parte del lavoro si avanzano alcune proposte per una revisione normativa dell’istituto che consenta di recuperarne uno spazio di legittimità alla luce del principio di proporzione, nella prospettiva del ritorno a un diritto della prevenzione “minimo”, che può legittimarsi solo in via eccezionale e nel limitato campo del contrasto alla criminalità organizzata.
