Elle analyse plus particulièrement la problématique sous-jacente des accommodements, entendu ici comme l ́« ajustement d ́une réglementation » visant à permettre l ́exercice d ́une religion qui aurait été sinon contraint, limité, voir rendu impossible par la loi en question. Ce travail met d ́abord en évidence l ́expansion des politiques des accommodements religieux à partir des années 1960 aux Etats-Unis, accordés aussi bien par les juges que le législateur. Mais, outil de gestion étatique et juridictionnel de la diversité religieuse, qui devait, dans une logique à la fois laïque et pluraliste, garantir la neutralité de l ́Etat et protéger de manière affirmative l ́exercice de la religion, les accommodements sont aussi progressivement devenus un enjeu identitaire et politique, revendiqué de plus en plus fréquemment, non seulement par des minorités en quête de droits et de reconnaissance, mais aussi par des groupes chrétiens, pourtant dans une position socialement et culturellement privilégiée aux Etats-Unis. Les controverses autour des politiques des accommodements religieux permettent ainsi de mettre en évidence les fondements, les succès et les ambiguités de l ́expérience de la laïcité « libérale-pluraliste » telle qu ́elle s ́est affirmée aux Etats-Unis à partir des années 1960, mais laissent également entrevoir les défis auxquels ce modèle est aujourd ́hui confronté, notamment face aux transformations récentes du paysage confessionnel américain.

This book intends to address the relationship between, on the one hand, cultural diversity resulting from migration, and, on the other hand, social cohesion and social justice within Western societies. In order to do this, the authors examine what can be described as two contradictory trends in recent public policies towards foreign people or people with a foreign origin. A book that aims to provide a trans-disciplinary analysis of the construction of “otherness” in North America and Europe. EXTRAIT In October 2010, in a very polemic context on immigration and immigrant integration, the German Chancellor, Angela Merkel, announced that Germany was to be considered a multicultural failure, words that were soon echoed by the Belgian Prime Minister Yves Leterme. A few months later, the British Prime Minister David Cameron and the French President Nicolas Sarkozy announced the failure of multiculturalism in almost identical terms. These sensational statements, which by and large avoid defining the concept of multiculturalism, are based on a reaffirmation of “Western values” and strengthening of national identity. These statements express the need to review the policies on integration of immigrants, in the sense that they should be more active and voluntarist, more organized by the state and more supported by the EU. In the background, one can see fear for Islamic extremism, but also the idea that the nation states can put some obligations on immigrants, and that for a too long time we have been focusing on “those who arrive”, rather than on “the society that welcomes them”. These speeches are situated in a politico-legal context that in recent years was characterized by an ambivalent attitude towards diversity in Europe. On the one hand, we have seen accusations of racial, ethnic and religious discrimination, based on antidiscrimination legislation boosted by a strong European equality legal framework. On the other hand, we have seen denouncements of the perceived risk posed by Islam in Europe. These policy statements are also a result of numerous publications, often widely discussed in the media that outline the dangers of Islam in Europe (especially in the Netherlands). These political positions have also led to political decisions demonstrating the lack of legitimacy of Islam in Europe, such as the ban on building minarets in Switzerland or the Burqa bans adopted in the name of protecting national values and the “living together”, notably in France and Belgium (2011).

Beyond Accommodation offers a different perspective, showing how Muslim Canadians successfully navigate and negotiate their religiosity in the more mundane moments of their lives. Drawing on interviews with Muslims in Montreal and St. John’s, Selby, Barras, and Beaman examine moments in which religiosity is worked out. They critique the model of reasonable accommodation, which has been lauded internationally for acknowledging and accommodating religious and cultural differences. The authors suggest that it disempowers religious minorities by implicitly privileging Christianity and by placing the onus on minorities to make requests for accommodation. The interviewees show that informal negotiation occurs all the time; scholars, however, have not been paying attention. This book advances a new model for studying the navigation and negotiation of religion in the public sphere and presents an alternative picture of how religious difference is woven into the fabric of Canadian society.

Questions of how to accommodate religious minorities and of the limits of tolerance resonate in a variety of contexts and have become central preoccupations for many Western democracies. What might we see if we turned our attention to the positive narratives and success stories of the everyday working out of religious difference? Rather than 'tolerance' and 'accommodation', and through the stories of ordinary people, this book traces deep equality, which is found in the respect, humour, and friendship of seemingly mundane interactions. Deep Equality in an Era of Religious Diversity shows that the telling of such stories can create an alternative narrative to that of diversity as a problem to be solved. It explores the non-event, or micro-processes of interaction that constitute the foundation for deep equality and the conditions under which deep equality emerges, exists, and sometimes flourishes. Through a systematic search for and examination of such narratives, Lori G. Beaman demonstrates the possibility of uncovering, revealing, and recovering deep equality—a recovery that is vital to living in an increasingly diverse society. In achieving deep equality, identities are fluid, shifting in importance and structure as social interaction unfolds. Rigid identity imaginings, especially religious identities, block our vision to the complexities of social life and press us into corners that trap us in identities that we often ourselves do not recognize, want, or know how to escape. Although the focus of this study is deep equality and its existence and persistence in relation to religious difference, deep equality is located beyond the realm of religion. Beaman draws from the work of those whose primary focus is not in fact religion, and who are doing their own 'deep equality' work in other domains, illustrating especially why equality matters. By retelling and exploring stories of negotiation it is possible to reshape our social imaginary to better facilitate what works, which varies from place to place and time to time.
