Gregory Pedlow considers the nobles of the small but representative state of Hesse-Kassel from the end of the ancien regime to the era of German unification. Although this period has been most often described in terms of the "triumph of the bourgeoisie," the author shows that landholding Hessian nobles were able to preserve much of their political prestige and social and economic power during these years. By demonstrating a mixture of conservatism and flexibility instead of blind reaction, the Hessian nobility maintained its position as a landed elite. The author focuses on four main areas: the noble family, with material showing changes in marriage patterns and family size and the impact of such demographic changes on inheritance practices; noble landownership, with documentation as to how noble landholdings and landed income survived the loss of traditional noble privileges and payments by peasants; noble occupations, with information (including collective biography) showing nobles' education, career choices, and degree of success in obtaining positions in government service; and the nobility's political response to the growing pressure for reform during the nineteenth century. Originally published in 1988. No collection of its constitutions has ever been published, nor any systematic interpretation of them has yet been written in spite of the fact that during the revolutionary upheaval of 1848-9, more than 40 constitutions were, with at least some sort of public legitimacy, drafted in Europe and most of them enacted.The twelve articles assembled in this volume were written to illustrate, with a focus on the organization of legislative and executive powers, some major aspects of this struggle. Besides several German, Italian, and Austro-Hungarian constitutions and those of France, Switzerland, and the Netherlands, the constitution of Wisconsin is deliberately included to document the whole range of ideas from nearly unconcealed opposition to major constitutional concessions to the rule of popular sovereignty in a democratic republic and to demonstrate the similarities as well as the differences between European and American constitutional concepts at the time. As a result, the years 1848-9 stand out for some major results that transformed the performance of modern constitutionalism in Europe during the second half of the nineteenth and in the twentieth centuries.

Book excerpt: Germany's Rude Awakening depicts the rise and fall of censorship in the age of the Brothers Grimm and Prince Metternich. Focusing on the Grimm's homeland of Hesse-Cassel, Frederik Ohles illustrates how censorship first awakened to the challenge posed by new political forces and literary forms, then lost its effectiveness as more and more Germans read and wrote what they wanted, finding ways to evade both censors and police. Ohles examines actual practices, looking beyond the legislation of the German Confederation and the pronouncements of Prince Metternich. He explores the effects of the laws on the censors' work, analyzes the political influence of Prussia and Austria on the Principality of Hesse (situated at the crossroads of the German Confederation), and interprets the results of censorship on literature, politics, the book trade, and public and private life. In telling the story of a momentous struggle between old and new views of politics and literature, he shows that while censorship became a public issue in eighteenth-century Germany, it failed as a policing institution. Ohles's extensive research includes police archives, early issues of the bookdealers' gazette published in Marburg, recollections of the Brothers Grimm, the Hessian collection of artistic and scholarly memoirs, and travelers' accounts.
