Mai 1945 verließen die Matrosen Wehrmann, Schilling, Gail und Schwalenberg ihre Unterkünfte, um sich von der Truppe abzusetzen und nach Hause zurückzukehren, nachdem am 4. Mai 1945 die Kapitulationsurkunde für die Truppen in Holland, Friesland, Bremen, Schleswig-Holstein und Dänemark unterzeichnet worden war. Daraufhin wurde auf den im dänischen Svendborg liegenden Schnellbooten, auf denen die Vier dienten, die Waffenruhe ausgerufen. Den vier Matrosen gelang die Flucht nicht, und sie wurden gefangen genommen. Einen Tag nach der bedingungslosen Kapitulation des Deutschen Reiches wurden sie von einem Standgericht wegen Fahnenflucht im Felde zum Tode verurteilt. Am 10. Mai wurde das Urteil vollstreckt und die Leichen im Meer versenkt. Der Ankläger in diesem Verfahren, Kriegsgerichtsrat Hartger, wurde in der BRD Oberstaatsanwalt. In dieser Funktion konnte er 1960 das Verfahren gegen den Amtsgerichtsrat Kolhoff einstellen, der als Richter am Sondergericht Ziechenau zahlreiche Todesurteile gegen polnische Schwarzschlächter gefällt hatte. Handelt es sich bei dem Oberstaatsanwalt Hartger um einen Einzelfall in der bundesdeutschen Justiz oder ist die Kontinuität der Juristen eher die Regel? Wie schon der Titel der Arbeit zeigt, ist dieser Fall nicht die Ausnahme. Die Arbeit beschäftigt sich deshalb nicht mehr mit der Frage, ob es überhaupt eine Kontinuität zwischen NS-Justiz und bundesdeutscher Justiz gab, denn dieses haben Ingo Müller, „Furchtbare Juristen“, Jörg Friedrich, „Freispruch für die NS-Justiz“, Norbert Frei, „Karrieren im Zwielicht - Hitlers Eliten nach 1945“ und Ulrich Brochhagen, „ Nach Nürnberg, Vergangenheitsbewältigung in der Ära Adenauer“ schon belegt, sondern sie stellt die personellen Kontinuitäten in einzelnen Bereichen der Justiz und die damit zusammenhängenden Folgen dar. Hierbei stützt sich die Arbeit auch auf diese Autoren. Um zu verstehen, was an der personellen Kontinuität problematisch ist, muss man sich verdeutlichen, wie die Justiz im Nationalsozialismus aussah. Dieses soll im ersten Teil der Arbeit geschehen, der sich damit beschäftigt, mit welchen Gesetzen die Juristen zur NS-Zeit arbeiteten. Außerdem sollen noch die Gerichte des NS-Staates betrachtet werden, und wie die Verfahren an diesen Gerichten abliefen. Im zweiten Teil der Arbeit wird die personelle Kontinuität in den drei Bereichen Universitäten, Justizministerium und den Gerichten dargestellt.
