Die Vertretung der Interessen der deutschen Kommunalkörperschaften im Ausschuß der Regionen und der lokalen Gebietskörperschaften ist mehr als dürftig. Auch das im Maastricht-Vertrag und im Grundgesetz verankerte Subsidiaritätsprinzip vermag kaum Schutzwirkungen zugunsten der Gemeinden und Landkreise zu entfalten. Letztlich liegt seine Interpretation als Kompetenzausübungsschranke in den Händen des Europäischen Gerichtshofes, der sich als Motor der europäischen Integration begreift.
