Book excerpt: While jury decision making has received considerable attention from social scientists, there have been few efforts to systematically pull together all the pieces of this research. In Jury Decision Making, Dennis J. Devine examines over 50 years of research on juries and offers a "big picture" overview of the field. The volume summarizes existing theories of jury decision making and identifies what we have learned about jury behavior, including the effects of specific courtroom practices, the nature of the trial, the characteristics of the participants, and the evidence itself. Making use of those foundations, Devine offers a new integrated theory of jury decision making that addresses both individual jurors and juries as a whole and discusses its ramifications for the courts. Providing a unique combination of broad scope, extensive coverage of the empirical research conducted over the last half century, and theory advancement, this accessible and engaging volume offers "one-stop shopping" for scholars, students, legal professionals, and those who simply wish to better understand how well the jury system works.

This Handbook provides an encyclopedic-style source regarding the major concerns in forensic psychology. It is an invaluable reference text for practitioners within community, special hospital, secure unit, prison, probation and law enforcement forensic settings, as well as being appropriate for trainees and students in these areas. It will also serve as a companion text for lawyers and psychiatric and law enforcement professionals who wish to be apprised of forensic psychology coverage. Each entry provides a succinct outline of the topic, describes current thinking, identifies relevant consensual or contested aspects and alternative positions. Readers are presented with key issues and directed towards specialized sources for further reference.

Available in PDF, EPUB and Kindle. Book excerpt: Trial by jury remains a supposed bedrock of the English Legal System, upheld as a bastion of democracy. However, research with real juries is prohibited under s.8 Contempt of Court Act (1981) meaning the function and operation of juries remain somewhat secretive and concealed. The following case explores the use of online mock jury simulations to gather important insights into jury decision-making processes. This method produces researchers the opportunity to gather in-depth, nuanced data regarding not only which verdicts jurors come to, but importantly 'why?' and 'how?' these verdicts are reached, and 'what?' evidence is held to be of most value. However, the time and resource-intensive nature of jury simulation research means little research of this kind is conducted and very little guidance exists on how to undertake such a project. This case study is therefore designed as a practical guide for researchers who wish to utilise this valuable, yet significantly underused research method. It outlines the various stages of development required to undertake jury simulations as well as guidance on sampling, data recording, ethical issues, and experiences in the field. The current project additionally took place during the COVID-19 pandemic and therefore explores the use of online mock juries.Ultimately, this case calls for greater utilisation of fundamental research into juror decision-making amid a growing societal context of controversy regarding the suitability of juries to deliver justice.

Book excerpt: Two earlier papers by the authors have developed two and three parameter models for jury verdicts. The present research employs these models to examine in more detail the internal and external behavior of the jury. The internal analysis sheds light on the decision-making process from the first ballot position to the final outcome. Ballot to ballot transitions in the jury stance are also considered. The external analysis explores questions regarding the correctness of jury decisions and the effect of changes in jury size and in majority requirements for decisions. Numerous recent state and federal court decisions have revealed the need for such inquiry.
