Book Synopsis Public Broadcasting and European Law by : Irini Katsirea
Download or read book Public Broadcasting and European Law written by Irini Katsirea and published by Kluwer Law International B.V.. This book was released on 2008-04-09 with total page 482 pages. Available in PDF, EPUB and Kindle. Book excerpt: This important book examines the challenges posed to public service obligations by European Union media law and policy. An in-depth analysis of the extent to which six countries (France, Germany, Greece, Italy, the Netherlands, and the United Kingdom) regulate broadcasting for the public interest reveals a range of vulnerability to national political pressures or, alternatively, to the ideology of market sovereignty. The author examines the country of origin principle and the European quota rule of the Television without Frontiers Directive, revealing the influence of European law on the definition and enforcement of programme requirements, and shows how the case law of the European Court of Justice encourages deregulation at the national level without offering adequate safeguards at the supranational level in exchange. She asks the question whether the alleged ‘European audiovisual model’ actually persists—that is, whether broadcasting is still committed to protecting such values as cultural diversity, the safety of minors, the susceptibility of consumers to advertising, media pluralism, and the fight against racial and religious hatred. The book concludes with an evaluation of the impact of the EU state aid regime on the licence fee based financing of public broadcasting.

Book Synopsis Media Freedom and the Law by : András Koltay
Download or read book Media Freedom and the Law written by András Koltay and published by Taylor & Francis. This book was released on 2024-08-01 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: The main objectives of media regulation in Europe are to protect media freedom, to ensure the social responsibility of the media, and to prevent harm caused by speech published through the media. This book examines the way in which these are reflected in European legal regimes and jurisprudence at the supranational, regional, and national levels. It addresses the theoretical considerations behind the protection and restriction of media freedom. It starts from the assumption that there is a common European ideal of media freedom as a human right. Apart from EU law, and in many cases similar national regulations, many common points can be identified across Europe in the theoretical underpinnings of this right, and the history of struggles for this freedom in different European countries also shows common features. While the focus is on media freedom in Europe, the work also discusses the uniquely distinct concept of freedom of expression and of the media that is prevalent in the US, the principles of which have a significant impact in Europe. The book uses a comparative method, in part, as it attempts to outline the common regulatory framework for the idea of media freedom on a European scale. The reference to national laws and court decisions is intended to illustrate this picture, looking primarily at what binds European states together. The work will be a valuable resource for those working in the areas of public law, media law, media studies, comparative law, international human rights law, and legal philosophy.
Book Synopsis Search Engine Freedom by : Joris van Hoboken
Download or read book Search Engine Freedom written by Joris van Hoboken and published by Kluwer Law International B.V.. This book was released on 2012-10-01 with total page 654 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, the author explores how search media can be incorporated into freedom of expression doctrine, as well as media and communications law and policy more generally. And the book develops a theory of the legal relations between national governments and search media providers on the one hand and between end-users and information providers on the other. Among the many issues covered are the following: role of government under the right to freedom of expression; lack of transparency about the ranking and selection of search results; search engine and ISP intermediary liability; filtering by access providers; freedom of expression and the governance of public libraries; the search engine market, its business model and the separation rule for advertising; search engine self-regulation; user profiling and personalization; decisions and actions for which search engines should be able to claim protection. The analysis draws on specific legal developments under Article 10 of the European Convention on Human Rights and the United States First Amendment, and investigates issues of diversity, pluralism, and freedom of expression as they relate to editorial control in other media. The author concludes with recommendations regarding search engine governance and the proper role of government, indicating which existing elements of the regulatory framework for search media can be improved and offering directions for future legal and empirical research. Considering the ever-growing cultural, political, and economic importance of the Internet and the World Wide Web in our societies, and the societal interests involved in the availability of effective search tools, this first in-depth legal analysis of search engine freedom will prove indispensable to the many practitioners and policymakers concerned with freedom of expression in the digital age.

Book Synopsis Food Advertising to Children: A Critical Evaluation of Public, Governmental and Corporate Responsibilities in Germany by : Anna Lena Hallmann
Download or read book Food Advertising to Children: A Critical Evaluation of Public, Governmental and Corporate Responsibilities in Germany written by Anna Lena Hallmann and published by Anchor Academic Publishing (aap_verlag). This book was released on 2014-02 with total page 53 pages. Available in PDF, EPUB and Kindle. Book excerpt: With increasing levels of child obesity, the food industry and its advertising techniques are ever more in the centre of public and academic discussion. While such discussion is complicated by the subjectivity of ethical understanding, the existing body of research also lacks evidence for the actual effects of child-directed advertising. In order to advance a solution in the persisting conflict, this paper critically examines public, governmental and corporate responsibilities. A reflection of theoretical and empirical research is therefore complemented by the collection of primary data – drawn from qualitative interviews with children and their parents. As means of implications for practice, the author drafts an organisational concept, namely the ‘Initiative for the responsible use and creation of children’s food advertising’.
Book Synopsis Protection of Minors and Audiovisual Content On-demand by : European Audiovisual Observatory
Download or read book Protection of Minors and Audiovisual Content On-demand written by European Audiovisual Observatory and published by Council of Europe. This book was released on 2012 with total page 56 pages. Available in PDF, EPUB and Kindle. Book excerpt: The use of audiovisual content services on-demand is catching up with traditional media at a dizzying speed. The growing popularity of on-demand services is based on extremely widespread use by young people, which raises the question of protection of minors from some of this on-demand media content. The protection of minors is a shared responsibility between the legislature and parents, but parents sometimes feel overwhelmed by this responsibility. This only serves to strengthen the role of the legislator when it comes to the protection of children. This IRIS Plus analyzes the protection of minors in the field of on-demand audiovisual content. It examines the position of the EU on this subject as well as the basic principles and specific rules contained in the different national systems.
