Available in PDF, EPUB and Kindle. Book excerpt: This is the only modern comprehensive constitutional history of any state, and as a history of Virgina, it is one of the oldest and most complex. Virginia’s state legislature is the Virginia General Assembly, which was established in July 1619, making it the oldest current lawmaking body in North America. Brent Tarter’s Constitutional History of Virginia covers over three hundred years of Virginia’s legislative policy, from colony to statehood, revealing its political and legal backstory. From the very beginning in 1606, when James I chartered the Virginia Company to establish a commercial outpost on the Atlantic coast of North America, through the first two decades of the twenty-first century, the fundamental constitutions of the colony and state of Virginia have evolved and changed as the demographic, economic, political, and cultural characteristics of Virginia changed. Elements of the colonial constitution influenced the character of the state’s first constitution in 1776, and changing relationships between the people and their government, as well as relationships between the state and federal governments, have influenced how the state’s constitution has evolved. Tarter explores that evolution and taps into its relevance to the people who have lived and still live in Virginia.

Available in PDF, EPUB and Kindle. Book excerpt: After the Civil War, Congress required ten former Confederate states to rewrite their constitutions before they could be readmitted to the Union. An electorate composed of newly enfranchised former slaves, native southern whites (minus significant numbers of disenfranchised former Confederate officials), and a small contingent of "carpetbaggers," or outside whites, sent delegates to ten constitutional conventions. Derogatorily labeled "black and tan" by their detractors, these assemblies wrote constitutions and submitted them to Congress and to the voters in their respective states for approval. Blacks, Carpetbaggers, and Scalawags offers a quantitative study of these decisive but little-understood assemblies -- the first elected bodies in the United States to include a significant number of blacks. Richard L. Hume and Jerry B. Gough scoured manuscript census returns to determine the age, occupation, property holdings, literacy, and slaveholdings of 839 of the conventions' 1,018 delegates. Carefully analyzing convention voting records on certain issues -- including race, suffrage, and government structure -- they correlate delegates' voting patterns with their racial and socioeconomic status. The authors then assign a "Republican support score" to each delegate who voted often enough to count, establishing the degree to which each delegate adhered to the Republican leaders' program at his convention. Using these scores, they divide the delegates into three groups -- radicals, swing voters, and conservatives -- and incorporate their quantitative findings into the narrative histories of each convention, providing, for the first time, a detailed analysis of these long-overlooked assemblies. Hume and Gough's comprehensive study offers an objective look at the accomplishments and shortcomings of the conventions and humanizes the delegates who have until now been understood largely as stereotypes. Blacks, Carpetbaggers, and Scalawags provides an essential reference guide for anyone seeking a better understanding of the Reconstruction era.

Available in PDF, EPUB and Kindle. Book excerpt: In contrast with the U.S. Constitution, which has been amended only 27 times since it was drafted in 1787, the Virginia Constitution has been the subject of many revisions since its adoption by the Convention of 1776. Significant changes have been brought about at the recommendation of revision commissions. On a number of those occasions, Virginia constitution makers have engaged in significant debates about fundamental questions. In fact, few states have had more opportunities to engage in constitutional revision and to debate fundamental principles. In The Virginia State Constitution, John Dinan analyzes the history and development of the Virginia constitution and undertakes a detailed treatment of the evolving interpretation of each section. In it, he contends that few states have had more opportunities than Virginia to engage in constitutional revision, and, in the process, to debate fundamental political questions about the role of state government. Previously published by Greenwood, this title has been brought back in to circulation by Oxford University Press with new verve. Re-printed with standardization of content organization in order to facilitate research across the series, this title, as with all titles in the series, is set to join the dynamic revision cycle of The Oxford Commentaries on the State Constitutions of the United States. The Oxford Commentaries on the State Constitutions of the United States is an important series that reflects a renewed international interest in constitutional history and provides expert insight into each of the 50 state constitutions. Available in PDF, EPUB and Kindle. Book excerpt: The Virginia State Constitution examines constitutional amendments, court decisions, attorney general opinions, and legislative deliberations bearing on the development and interpretation of the Virginia Constitution. The book contains a detailed history of the Virginia Constitution, with particular attention to key moments in the state's constitutional development, from the 1776 Constitution through the current 1971 Constitution. The book also includes a provision-by-provision commentary on the evolution and meaning of each section of the Virginia Constitution. The second edition brings this material up to date through mid-2013 and analyzes a number of constitutional developments with important implications for governance. Among the recent amendments covered in this volume is an amendment barring recognition of same-sex marriages and civil unions, and an amendment that undertook a major revision of the provision limiting the eminent domain power. The book examines several recent state court decisions of note, including the state supreme court's first interpretation of the provision guaranteeing "the right of the people to keep and bear arms" and various court decisions limiting the power to levy taxes. The book also analyzes recent attorney general opinions with significant implications for legislative appropriations to non-profit groups, along with various other legislative initiatives. Book excerpt: Harris maintains that Lincoln held a fundamentally conservative position on the process of reintegrating the South, one that permitted a large measure of self-reconstruction, and that he did not modify his position late in the war. He examines the reasoning and ideology behind Lincoln's policies, describes what happened when military and civil agents tried to implement them at the local level, and evaluates Lincoln's successes and failures in bringing his restoration efforts to closure.

Book excerpt: In The Scalawags, James Alex Baggett ambitiously uncovers the genesis of scalawag leaders throughout the former Confederacy. Using a collective biography approach, Baggett profiles 742 white southerners who supported Congressional Reconstruction and the Republican Party. He then compares and contrasts the scalawags with 666 redeemer-Democrats who opposed and eventually replaced them. Significantly, he analyzes this rich data by region -- the Upper South, the Southeast, and the Southwest -- as well as for the South as a whole. Baggett follows the life of each scalawag before, during, and after the war, revealing real personalities and not mere statistics. Examining such features as birthplace, vocation, estate, slaveholding status, education, political antecedents and experience, stand on secession, war record, and postwar political activities, he finds striking uniformity among scalawags. This is the first Southwide study of the scalawags, its scope and astounding wealth in quantity and quality of sources make it the definitive work on the subject.
