Because courts and arbitration laws across the world take contrasting approaches to the definition of awards, such enforcement can be problematic, especially in the context of awards by consent, and the recent development known as ‘emergency arbitration’. In this timely and ground-breaking book, a young arbitration scholar takes us through the difficulties of defining the notion of arbitral award with a rare combination of theoretical awareness and attention to the procedural requirements of arbitral practice. In a framework using a comparative analysis of common law and civil law jurisdictions (specifically, England and France) and how each has regulated in different ways the equilibria between state justice and arbitral justice – and comparing each with the UNCITRAL Model Law – the book addresses such issues as the following: - the ‘judicialization’ of arbitration; - different models of arbitral adjudication and their impact on the notion of award; - what an award needs to contain to be enforceable; - awards on competence; - awards by consent; and - awards ante causam. The author employs a methodology that views arbitration as providing an institution for administering justice rather than as a purely contractual creature. To this end, rules of arbitral institutions (particularly the International Chamber of Commerce) are examined closely for their implications on what an award means. As a fresh look at the arbitral award by placing it in a broader context than is usually found, this book allows for a greater understanding of the functioning of international commercial arbitration. Book excerpt: A recent study in the field of comparative economics (or, more precisely, numerical comparative law) constructed an index of procedural formalism of dispute resolution for more than 100 countries and analyzed the relationship between procedural formalism and certain aspects of quality of the judicial systems. The study's results suggest a strong relationship between legal origins, formalism, and the quality of dispute resolution. Not surprisingly, the study closes with a recommendation for reform. What makes this study so important is not only its findings, backed by an amount of data which seems to be a guarantee for the study's universal validity, but also the financial support of the World Bank - an indicator of the Bank's interest in these questions. Similar studies in the area of banking, securities, and corporate law have received much attention from the legal community. However, for the recent study on civil procedure, this is not the case. Christoph Kern provides a first critical approach to the study from the perspective of a legal scholar. He does not suggest a mere re-coding, but focuses on the methodology and the underlying legal questions. After an extensive discussion of the input to the study, the author turns to the way the study combines the data and, in particular, how it interprets the results. He concludes that the study leaves a mixed impression and that, therefore, doubts remain as to its results and interpretation.

This is the story of how the French Crown and local institutions accommodated one another as they sought to forge acceptable political and commercial relationships. Junko Thérèse Takeda tells this tale through the particular experience of Marseille, a port the monarchy saw as key to commercial expansion in the Mediterranean. At first, Marseille’s commercial and political elites were strongly opposed to the Crown’s encroaching influence. Rather than dismiss their concerns, the monarchy cleverly co-opted their civic traditions, practices, and institutions to convince the city’s elite of their important role in Levantine commerce. Chief among such traditions were local ideas of citizenship and civic virtue. As the city’s stature throughout the Mediterranean grew, however, so too did the dangers of commercial expansion as exemplified by the arrival of the bubonic plague. During the crisis, Marseille’s citizens reevaluated merchant virtue, while the French monarchy found opportunities to extend its power. Between Crown and Commerce deftly combines a political and intellectual history of state-building, mercantilism, and republicanism with a cultural history of medical crisis. In doing so, the book highlights the conjoined history of broad transnational processes and local political change.
