Book excerpt: "TRB's National Cooperative Rail Research Program (NCRRP) Legal Research Digest 2: Railroad Legal Issues and Resources presents legal issues of importance that attorneys may encounter when representing both freight and passenger railroad owners, and operators involved in railroad-related transactions. Issues explored in the report range from abandonment and discontinuance to constitutional law, construction, contracts, interaction with regulatory agencies, safety, retirement, and numerous other subjects. The electronic version of the digest includes more than 700 pages of case law presenting detailed summaries of statutes, regulations, cases, and relevant articles as a fundamental resource for use in understanding the background and broad ramifications of railroad-related law reflected in each category. Available in PDF, EPUB and Kindle. Book excerpt: No enterprise is so seductive as a railroad for the influence it exerts, the power it gives, and the hope of gain it offers.—Poor's Manual of Railroads (1900) At its peak, the railroad was the Internet of its day in its transformative impact on American life and law. A harbinger and promoter of economic empire, it was also the icon of a technological revolution that accelerated national expansion and in the process transformed our legal system. James W. Ely Jr., in the first comprehensive legal history of the rail industry, shows that the two institutions-the railroad and American law-had a profound influence on each other. Ely chronicles how "America's first big business" impelled the creation of a vast array of new laws in a country where long-distance internal transport had previously been limited to canals and turnpikes. Railroads, the first major industry to experience extensive regulation, brought about significant legal innovations governing interstate commerce, eminent domain, private property, labor relations, and much more. Much of this development was originally designed to serve the interests of the railroads themselves but gradually came to contest and control the industry's power and exploitative tendencies. As Ely reveals, despite its great promise and potential as an engine of prosperity and uniter of far-flung regions, the railroad was not universally admired. Railroads uprooted people, threatened local autonomy, and posed dangers to employees and the public alike-situations with unprecedented legal ramifications. Ely explores the complex and sometimes contradictory ways in which those ramifications played out, as railroads crossed state lines and knitted together a diverse nation with thousands of miles of iron rail. Epic in its scope, Railroads and American Law makes a complex subject accessible to a wide range of readers, from legal historians to railroad buffs, and shows the many ways in which a powerful industry brought change and innovation to America.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Street Railway Law, Vol. 4: A Comprehensive Working Compendium, of Important Street Railway Decisions in All Parts of the Country, Covering Practically All New Legal Questions, Including Promotion, Charter, Construction, Equipment and Maintenance Problems In presenting this, the fourth volume of street railway law, it appears scarcely necessary to make extended mention of the litigation concerning street railways and the need for managers, as well as claim agents-and attorneys, to be informed as to the deci sions of the courts. This book tells what the courts have decided, the matter being couched in language that will be understood by the layman as well as the lawyer. To quote from the preface to Volume III: In its preparation, the constant aim has been to omit nothing vital, to cover all points of interest of both law and fact; to give as much space as necessary to new and exceptionally important points, yet, on the whole, to be as brief as possible without sacrificing anything of prac tical value. It is much more full and comprehensive than an ordi nary digest would be, and is at the same time in about the same pro portion less bulky and more readable than would be the several vol umes that would be required to report the same cases in full. It is probably all that; managers or other street railway officers will care for in the way of reports on the cases covered, while such attorneys as desire to see and use full opinions, when the occasion requires, will find it a'good medium for locating such as they want, as well as a convenient handbook for many other purposes. The arrangement chronologically and something of the style are attributable to the fact that the work was originally prepared for publication in the Legal Department Of the Street Railway Review. However, it is believed that there will be more gain than loss in this last fact. The index, which has been prepared with a good deal of care, will make the contents of the book readily available.
