Book excerpt: In July 2015, eight parties – France, Germany and the United Kingdom, together with the European Union and China, Russia and the United States on the one side, and Iran on the other – adopted the Joint Comprehensive Plan of Action (JCPOA), better known as the Iran nuclear deal. Under the agreement, Iran accepted limits to its nuclear programme in return for sanctions relief. Hailed by some as a diplomatic achievement, detractors – both in the US and the Middle East – saw the deal as overly lenient. In May 2018, US President Donald Trump announced that the US would cease waiving sanctions and withdraw from the agreement. This Adelphi book assesses that Trump’s decision was a grave error. Like any multilateral agreement, the deal was not perfect, but Iran had been honouring its commitments. Drawing on a deep understanding of the non-proliferation regime and technical expertise, the authors trace the emergence of antipathy to the JCPOA and set out how many of the politicised criticisms of the accord are demonstrably incorrect. They argue that the little-known Procurement Channel – established by the JCPOA to give Iran a legitimate route to procure goods and services for its now-limited nuclear programme – has been an effective check on Iran’s illicit procurement of nuclear-related goods. Moreover, this book demonstrates that Iran’s nuclear and ballistic-missile programmes are not intrinsically linked, as not all Iranian missiles are designed to be nuclear-capable. While the deal endures for now, its survival will ultimately depend on Iran.

Security Council resolutions adopted between 2006 and 2010 required Iran to cooperate fully with the International Atomic Energy Agency's (IAEA's) investigation of its nuclear activities, suspend its uranium enrichment program, suspend its construction of a heavy-water reactor and related projects, and ratify the Additional Protocol to its IAEA safeguards agreement. However, Tehran has implemented various restrictions on, and provided the IAEA with additional information about, its nuclear program pursuant to the July 2015 Joint Comprehensive Plan of Action (JCPOA), which Tehran concluded with China, France, Germany, Russia, the United Kingdom, and the United States. On the JCPOA's Implementation Day, which took place on January 16, 2016, all of the previous resolutions﷿ requirements were terminated. The nuclear Nonproliferation Treaty (NPT) and U.N. Security Council Resolution 2231, which the Council adopted on July 20, 2015, compose the current legal framework governing Iran's nuclear program. Iran has complied with the JCPOA and resolution. Iran and the IAEA agreed in August 2007 on a work plan to clarify outstanding questions regarding Tehran's nuclear program. The IAEA had essentially resolved most of these issues, but for several years the agency still had questions concerning ﷿possible military dimensions to Iran's nuclear programme.﷿ A December 2, 2015, report to the IAEA Board of Governors from agency Director General Yukiya Amano contains the IAE's ﷿final assessment on the resolution﷿ of the outstanding issues. This report provides a brief overview of Iran's nuclear program and describes the legal basis for the actions taken by the IAEA board and the Security Council.

Since then, Tehran's nuclear activities and public diplomacy have only affirmed what this analysis first suggested: Iran is not about to give up its effort to make nuclear fuel and, thereby, come within days of acquiring a nuclear bomb. Iran's continued pursuit of uranium enrichment and plutonium recycling puts a premium on asking what a more confident nuclear-ready Iran might confront us with and what we might do now to hedge against these threats. These questions are the focus of this volume. The book is divided into four parts. The first presents the endings of the NPEC's working group on Iran. It reflects interviews with government officials and outside specialists and the work of some 20 regional security experts whom NPEC convened in Washington to discuss the commissioned research that is contained in this book. Some of this report's endings to keep Iran and others from overtly deploying nuclear weapons or leaving the Nuclear Nonproliferation Treaty (NPT) are beginning to gain official support.
