Book excerpt: Excerpt from Investment Securities and Tax Exemption The logical result of this absurdity was that the bonds of states and municipalities, if taxable by the jurisdiction in which they were issued, enjoyed a better market outside the state's jurisdiction than within. Such taxation not only discriminated in favor of foreign bondholders, but it tended also to impair the borrowing power of states and municipalities. The complete exemption on the part of the states of their own bonds and the bonds of their municipalities from the general property tax tended to overcome this difficulty without working any injustice to tax payers. It is still true, however, that the bonds of one state and its municipalities are taxable by another state when found in the hands of its citizens. Of course, such bonds are seldom found by the tax assessors. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Tax Exempt and Taxable Investment Securities: A Summary of the Laws of All the States and the District of Columbia Relating to the Taxation of Securities From the Standpoint of the Banker and Investor Corporations which issue certificates representing the shares in their capital stock owned by individu als are in theory artificial persons created by some sovereign power, such as the United States or a state of the Union. A corporation organized under the laws of one jurisdiction may transact business and hold property in another, and its shares may be owned by a citizen of a third. The technical terms for distinguishing between a corporation which re ceives its charter from the state levying the tax and a corporation which receives its charter from some other state are the words domestic and for eign. So far as possible these words have been avoided, and the name of the state granting the charter to the corporation has been prefixed. For example, Massachusetts Corporations means corporations receiving their charter from that state and does not include corporations chartered by other states but doing all or part of their business in Massachusetts. Book excerpt: Excerpt from Tax Exempt and Taxable Investment Securities: A Summary of the Laws of All the States and the District of Columbia Relating to the Taxation of Securities From the Standpoint of the Banker and Investor This book is intended as a manual for the use of investors and dealers in investment securities. It treats of the laws of the various states of the Union levying a direct property tax on investments. It does not include inheritance taxes or stock transfer taxes. These are not properly described as included in the direct property tax. The taxes referred to are levied by states, counties, cities, towns, or specially created municipal districts within states, on property in the hands of its owner assessed at a given rate in proportion to the value of the property or upon incomes. These are the great fundamental annual taxes which form the backbone of our public revenue. This book is not intended as a legal treatise and does not contain a discussion of the constitutional limitations on the taxing power or questions relating to the interpretation of tax statutes. The citations of the statutes are given for the convenience of those who may wish to make a more detailed study of a particular statute in a given state. Book excerpt: Excerpt from Needed Reform in the Present Federal Tax Laws: Measures Which Should Be Taken to Relieve Business From Unwarranted Burden of Existing Taxation Moreover, our high taxes militate against the expansion of our foreign trade, which at this time is so important to the future prosperity of our in dustries. The high rates for money which are demanded by the investor because of heavy taxa tion, deter the opening of commercial credits and the free investment in foreign securities. In fact our own industries are precluded from financing by bond issues, except at excessive rates, which overcome, in a measure, the tax of the in dividual investor, and they have recently favored the raising of capital by the issue of preferred stock which is less expensive. The high rate of return on such stock also is proving attractive now to investors who formerly would invest only in high grade bonds, thus demonstrating that high rates of tax are inclined to cultivate speculative ten dencies, rather than encourage caution and thrift. And even with the inducement of high return, capital has been, to a considerable extent, divertedfrom investment in industries to investment in securities which are exempt from tax. Obviously the taxpayer is not entitled to recover or extinguish through amortization more than the difference between the war cost of such property and what he can sell the property for after the war, or if he continues to need and use it in his business, what it would have cost him after the war. As the rule is expressed in Article 183 of the Regulations: The total amount to be extinguished by amortization, in general, is the excess of the unextinguished or unrecovered cost of the property over its maximum value (either for sale or for use as part of the plant or equipment of a going business) under stable post war. If you have big gains and decide to play it safe and take some of that money off the table, taxes will take a hefty chunk of those profits. Brokerage firms know how to handle such risk for their own accounts, hedging holdings, for example, to iron out volatility instead of incurring taxable capital gains. Savvy individual investors can use the same techniques to protect themselves. In this indispensable guide, Robert Gordon, a Wall Street veteran, shares the strategies of an insider to demonstrate how you can use the tax laws to your advantage. Written in plain English, this book explains federal and state tax considerations that investors need to know to make the most tax-efficient choices and to protect their portfolios. The emphasis is on practical application, aimed at guiding you to specific, accessible tax-saving goals without having to wrestle down the entire Internal Revenue Code. Thanks to the talents of Gordon and respected journalist Jan M. Rosen, this book is clearly organized along transactional lines, offering easy entry for busy readers and allowing investors to zero in on a powerful array of proven, tax-minimizing techniques and strategies. By the time you finish reading Wall Street Secrets for Tax-Efficient Investing, you will be on your way to reducing your tax bite to a nibble and enjoying the full benefit of your investment earnings.

Available in PDF, EPUB and Kindle. Book excerpt: JCS-5-05. Joint Committee Print. Provides an explanation of tax legislation enacted in the 108th Congress. Arranged in chronological order by the date each piece of legislation was signed into law. This document, prepared by the staff of the Joint Committee on Taxation in consultation with the staffs of the House Committee on Ways and Means and the Senate Committee on Finance, provides an explanation of tax legislation enacted in the 108th Congress. The explanation follows the chronological order of the tax legislation as signed into law. For each provision, the document includes a description of present law, explanation of the provision, and effective date. Present law describes the law in effect immediately prior to enactment. It does not reflect changes to the law made by the provision or subsequent to the enactment of the provision. For many provisions, the reasons for change are also included. In some instances, provisions included in legislation enacted in the 108th Congress were not reported out of committee before enactment. For example, in some cases, the provisions enacted were included in bills that went directly to the House and Senate floors. As a result, the legislative history of such provisions does not include the reasons for change normally included in a committee report. In the case of such provisions, no reasons for change are included with the explanation of the provision in this document. In some cases, there is no legislative history for enacted provisions. For such provisions, this document includes a description of present law, explanation of the provision, and effective date, as prepared by the staff of the Joint Committee on Taxation. In some cases, contemporaneous technical explanations of certain bills were prepared and published by the staff of the Joint Committee. In those cases, this document follows the technical explanations. Section references are to the Internal Revenue Code unless otherwise indicated.

Book excerpt: Alternative Investments: A Primer for Investment Professionals provides an overview of alternative investments for institutional asset allocators and other overseers of portfolios containing both traditional and alternative assets. It is designed for those with substantial experience regarding traditional investments in stocks and bonds but limited familiarity regarding alternative assets, alternative strategies, and alternative portfolio management. The primer categorizes alternative assets into four groups: hedge funds, real assets, private equity, and structured products/derivatives. Real assets include vacant land, farmland, timber, infrastructure, intellectual property, commodities, and private real estate. For each group, the primer provides essential information about the characteristics, challenges, and purposes of these institutional-quality alternative assets in the context of a well-diversified institutional portfolio. Other topics addressed by this primer include tail risk, due diligence of the investment process and operations, measurement and management of risks and returns, setting return expectations, and portfolio construction. The primer concludes with a chapter on the case for investing in alternatives.
