This book was released on 2018-09-01 with total page 313 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the last few decades, research, activity, and funding has been devoted to improving the recruitment, retention, and advancement of women in the fields of science, engineering, and medicine. In recent years the diversity of those participating in these fields, particularly the participation of women, has improved and there are significantly more women entering careers and studying science, engineering, and medicine than ever before. However, as women increasingly enter these fields they face biases and barriers and it is not surprising that sexual harassment is one of these barriers. Over thirty years the incidence of sexual harassment in different industries has held steady, yet now more women are in the workforce and in academia, and in the fields of science, engineering, and medicine (as students and faculty) and so more women are experiencing sexual harassment as they work and learn. Over the last several years, revelations of the sexual harassment experienced by women in the workplace and in academic settings have raised urgent questions about the specific impact of this discriminatory behavior on women and the extent to which it is limiting their careers. Sexual Harassment of Women explores the influence of sexual harassment in academia on the career advancement of women in the scientific, technical, and medical workforce. This report reviews the research on the extent to which women in the fields of science, engineering, and medicine are victimized by sexual harassment and examines the existing information on the extent to which sexual harassment in academia negatively impacts the recruitment, retention, and advancement of women pursuing scientific, engineering, technical, and medical careers. It also identifies and analyzes the policies, strategies and practices that have been the most successful in preventing and addressing sexual harassment in these settings.

Aggarwal and Madhu M. Guptas Sexual Harassment Investigations: How to Limit Your Liability and More A Practical Guide presents a comprehensive overview of the current law on sexual harassment in North America. Sexual harassment in the workplace is a pervasive concern, and no employer can afford to be passive or careless about this weighty subject. Prevention through effective sexual harassment policies and education is the key to maintaining a healthy and productive work environment. Dr. Aggarwal and Ms. Gupta have penned an informative and practical text on the legal aspects of sexual harassment, designed to appeal to employers, legal practitioners, and members of the general public alike. The text is divided into five logical and accessible segments. The discussion begins with a clear and concise explanation of the current state of the law on sexual harassment how the law defines sexual harassment and what behaviours amount to sexual harassment in the workplace. The authors outline the costs of sexual harassment in the workplace, and the relatively small costs of implementing effective preventative measures.Part two lays out guidelines for creating and implementing an effective sexual harassment policy, including what employers should, and more importantly, should not do, in order to prevent and to act on sexual harassment complaints, including how to approach the tricky topic of workplace romance.Parts three and four examine the various approaches to dealing with a sexual harassment complaint, including the advantages and shortcomings of litigation and mediation. The authors walk readers through the various steps involved in the investigation and resolution of a sexual harassment complaint through both formal and informal channels. The final and most substantive section of the text provides an in-depth practical guide to the investigation process and available remedies. The authors offer step-by-step advice on how to undertake the often-difficult task of interviewing the parties and witnesses, how to ensure the investigation is properly documented, and how to determine the proper resolution of a complaint. The final chapter examines the available remedies and penalties, and encourages a resolution that will satisfy all involved parties. The text, which acts as the roadmap for a fair and complete investigation, incorporates a series of extraordinarily useful and user-friendly checklists and sample forms. The forms include a sample pre-investigation planning chart, sexual harassment policy, policy provisions for complaints against senior management, a sexual harassment complaint form and an investigation report layout. In completing their task, the authors have faced head-on the most difficult practical challenges in a harassment complaint investigation, including whether to investigate informally or formally, when and how to mediate a complaint, the selection of the most appropriate investigator(s), legal representation, privacy protection, and information access in a multiplicity of contexts, including the privilege attaching to an investigation and the extent to which the complaint and the investigation report ought to be disclosed to the parties and the workplace public. As in the totality of their work, Aggarwal and Gupta have addressed these thorny issues with strong intellect, skill, and balance.Sexual Harassment Investigations: How to Limit Your Liability and More A Practical Guide will appeal to anyone interested in learning about sexual harassment in the workplace. Legal practitioners and judges will find the legal analysis and case law discussion to be thorough, accessible, and current. Academics and students will discover an expansive, but readily legible, treatment of the issues surrounding sexual harassment that balances the theoretical legal aspects with practical real-life scenarios. Employers and human resources personnel will find this to be an indispensable text in perfecting their current sexual harassment policies as well as how to deal with even the most complex sexual harassment complaints.

Available in PDF, EPUB and Kindle. Book excerpt: Here is a valuable guide that saves researchers investigating sexual harassment in the workplace enormous amounts of time and money. Focusing on the hostile environment claim under Title VII of the Civil Rights Act of 1964, Women and Sexual Harassment is a complete resource tool. In one easy-to-use volume, it provides a detailed background and history of the hostile environment claim as well as an extensive guide on how to use and where to find the best resources available on this topic. Unlike some legal books, Chan’s book does not require cover-to-cover reading to access pertinent information. Anyone, whether they are interested in the specifics of the hostile environment claim or sexual harassment in general, will be able to locate the information they’re looking for with the help of this handy guide. It saves enormous amounts of time, effort, and money for researchers by providing extensive listings and evaluations of statutes, cases, agency decisions, law review articles, annotations, and books containing information on this subject. Readers can use the book to get a better understanding of the hostile environment claim or use it like a dictionary to pinpoint the specific resources that will be most useful to their area of research. Women and Sexual Harassment is logically divided into five complete parts to make it easy to use: Part 1: Clearly explains how to best use the book to access specific information. Part 2: Describes the history and present state of the hostile environment claim in a manner that is to the point, yet is more thorough than descriptions of the claim found in articles, cases, or other sources. Part 3: Research guide--Directs researchers to the best sources for information, categorized by type and area. Includes tips that will save hours in the library and will help researchers find the most up-to-the-minute articles and cases. Part 4: Bibliography of primary legal sources--Covers statutes, regulations, and case law on the hostile environment claim and sexual harassment. Part 5: Bibliography of secondary sources--Includes books, articles, surveys, and legislative history. The annotated bibliography, broken down by type of source and type of information, not only points researchers in the right direction but also steers them away from sources that seem valuable from their title, but are in fact not worthwhile. The insightful written analysis of the hostile environment claim alone provides researchers unfamiliar with the subject with a clearly written history and definition of the claim, its key elements, employer liability, statute of limitations, remedies, considerations of discovery and evidence, and related claims. Women and Sexual Harassment is an invaluable guide for all types of researchers including victims of sexual harassment considering filing a hostile environment claim, scholars interested in women’s issues, attorneys unfamiliar with this area, employers interested in limiting their liability by taking steps to prevent sexual harassment in their workplaces, and law students in any level of courses related to sex discrimination or sexual harassment.

Book Synopsis Sexual Justice by : Alexandra Brodsky
Download or read book Sexual Justice written by Alexandra Brodsky and published by Metropolitan Books. This book was released on 2021-08-24 with total page 217 pages. Available in PDF, EPUB and Kindle. Book excerpt: A pathbreaking work for the next stage of the #MeToo movement, showing how we can address sexual harms with fairness to both victims and the accused, and exposing the sexism that shapes today's contentious debates about due process Over the past few years, a remarkable number of sexual harassment victims have come forward with their stories, demanding consequences for their assailants and broad societal change. Each prominent allegation, however, has also set off a wave of questions – some posed in good faith, some distinctly not – about the rights of the accused. The national conversation has grown polarized, inflamed by a public narrative that wrongly presents feminism and fair process as warring interests. Sexual Justice is an intervention, pointing the way to common ground. Drawing on core principles of civil rights law, and the personal experiences of victims and the accused, Alexandra Brodsky details how schools, workplaces, and other institutions can – indeed, must – address sexual harms in ways fair to all. She shows why these allegations cannot be left to police and prosecutors alone, and outlines the key principles of fair proceedings outside the courts. Brodsky explains how contemporary debates continue the long, sexist history of “rape exceptionalism,” in which sexual allegations are treated as uniquely suspect. And she calls on readers to resist the anti-feminist backlash that hijacks the rhetoric of due process to protect male impunity. Vivid and eye-opening, at once intellectually rigorous and profoundly empathetic, Sexual Justice clears up common misunderstandings about sexual harassment, traces the forgotten histories that underlie our current predicament, and illuminates the way to a more just world.
