Available in PDF, EPUB and Kindle. Book excerpt: Introduction to Japanese Business Law & Practice is an ideal first point of reference on Japanese business law in the English language. It provides a concise and reader-friendly overview of all Japan’s major laws relevant to 21st century corporate and financial enterprises, with a practical emphasis on international business topics such as the cross-border flow of goods, services and capital funds. Each chapter was authored by a team of specialist lawyers, supported by a team of researchers. This text provides insight for modern businesses on Japan’s major legislative fields in a practical and concise manner. This edition includes the “new companies act” which is due to be enforced in April 2015. The change is so important for Japanese business related to corporate governance. In an increasingly globalized world economy, the cross-border flow of goods, services, capital funds and other business activity has become increasingly commonplace. To facilitate these transactions, efforts to harmonize laws and regulations through model laws, multi-national legislation such as EU law, and bilateral and multi-lateral treaties have gained popularity and prominence. Despite this trend, in reality, each sovereign nation still possesses a system of law with unique features. In this sense ‘national borders’ will inevitably continue to exist in the world of law.Accordingly, it remains essential for multinational enterprises to have an accurate and current understanding of the laws and regulations in each of the countries and jurisdictions in which they conduct business.

Available in PDF, EPUB and Kindle. Book excerpt: The only book of its kind available in English, Civil Procedure in Japan is the most reliable and comprehensive reference on the broad subject of the Japanese civil justice system. Civil Procedure in Japan discusses the problems encountered in litigating a civil controversy in the chronological order in which they are most likely to arise. Since civil procedure, as all law, is a product of historical developments and since it cannot be understood without reference to the political structure within it is to operate, Chapter 1 presents the historical background to date of the development of court procedure. The chapter looks at Japan's political organization (Executive, Legislative, etc), the court structure, and the sources of law. Chapter 2 is devoted to a look at the world of Japanese Legal Profession including legal education and non-Japanese lawyers in Japan, while Chapter 3 is an overview of the Judiciary as a whole. Chapter 4 sets forth the basic concepts involved in the judiciary authority and its interface with other governmental authorities. Subsequent chapters deal with practical issues of civil procedure, starting with Chapter 5 through Chapter 8, the trial is traced from beginning (parties to action and pre-commencement preparation including provisional remedies) through appellate procedures. Chapters 8 and 9 deal with various judicial proceedings outside of typical civil actions. Chapter 11 specifically explains various insolvency proceedings from straight bankruptcy to corporate reorganization. Chapter 12 is devoted to the arbitration law of 2002. Chapter 13 is about various terms of the court costs. Enforcement of civil judgments is treated in detail in Chapter 14. Finally, Chapter 15 is reserved for international cooperation in litigation and sets forth Japan's bilateral arrangements for international co-operation. Furthermore, appendices include an English translation of the Code and Rules of Civil Procedure of 1996 and other important statutes, English translations of sample judgments, glossaries, bibliography, ect.

Available in PDF, EPUB and Kindle. Book excerpt: While Japan has been on center stage of the world economy for decades, interactions between the Japanese and Westerners continue to be on the rise. Daily communication in both business and social settings is commonplace, and connections through the Internet and mobile media make what felt distant only a few years ago seem familiar. Our cultures and social norms remain vastly different, however, and professionals working in Japan are likely to confront new challenges every day. For example, what are the three biggest challenges for Westerners who go to work in Japan? How can you tell when “yes” might mean “no”? When you are the guest in a taxi, who should sit where? In the fully updated second edition of With Respect to the Japanese, readers discover not only answers to basic etiquette questions, but also how to communicate successfully with the Japanese and, in the process, earn mutual respect. John C. Condon and Tomoko Masumoto use real-life examples (from kindergarten classrooms to the boardroom) to explain the contrast between these two distinct cultures. In this essential guide to Japanese culture, you will learn how vital societal characteristics affect communication, decision making, management styles and many other aspects of work and everyday relationships.

Book excerpt: Compilations of cases with commentary – in Japanese Hanrei Hyakusen – often provide the most practical way to obtain a quick and reliable understanding of a specific field of law, as well as guidance on how best to proceed in specific situations. In this respect, leading cases much more than statutory provisions are essential for understanding the reality of Japanese commercial law. This incomparable book compiles 72 of the most important commercially relevant Japanese court decisions in the fields of civil law, labour law, company law, financial transactions, intellectual property, antitrust, conflict of laws, and arbitration. Each decision is presented in English translation and is accompanied by a practical and explanatory commentary by an expert in the field, be it from academia or private practice. There are 50 commentators in all, brought together here to honour the 60th birthday of Harald Baum, widely regarded as one of the world’s foremost scholars on Japanese business law. The cases encompass a wide reach of causes of action in fields such as: breach of contract; tort liability; product liability; unjust enrichment; collective bargaining; shareholders’ rights; directors’ duty of care; political donations; insider trading; patent infringement; parallel imports; trade mark rights; unfair competition; publicity rights; price fixing; arbitration agreements; and recognition of foreign judgements. Whether serving as practical guidance or as a basis for academic research, this compilation will be warmly welcomed by practicing lawyers, teachers and students of Japanese and international law, and all others who need to understand the various fields of Japanese commercial law.

Book excerpt: The Practice of Concern: Ritual, Well-Being, and Aging in Rural Japan explores ideas and practices related to religious ritual and health among older people in northern Japan. Drawing on more than three years of ethnographic fieldwork, Traphagan considers various forms of ritual performance and contextualizes these in terms of private and public spheres of activity. An important theme of the book is that for Japanese the expression of concern about family, friends, the community, and the nation is a central symbolic element in religious ritual practice. The book has important implications for research into religion and health, because it suggests that, in order to carry out successful cross-cultural research, it is necessary to move beyond conceptualizations of religion -- largely centering on concepts of belief, faith, forgiveness -- that have shaped much of the work in this area to date, because, as consideration of the Japanese context shows, the theological language of Western religions is not necessarily adequate to the task of understanding how health and religion are tied together in other cultures. Traphagan argues that there is a need to focus on how religious rituals are markers that symbolically convey information about embodied experience and how these markers express and are expressions of concerns about health and well-being. The Practice of Concern provides a detailed examination of Japanese religious practices both within the home and in the community, as well as a thorough discussion of Japanese concepts of health, well-being, and aging. In addition to those who are interested in medical anthropology, this book will be useful to gerontologists who are concerned with cross-cultural studies in aging. Because of the rich ethnographic detail presented, the book also provides an excellent introduction to Japanese religious and ritual practice and Japanese culture and society more broadly. This book is part of the Ethnographic Studies in Medical Anthropology Series, edited by Pamela J. Stewart and Andrew Strathern, Department of Anthropology, University of Pittsburgh. "[T]he book's basic argument is indeed innovative... well worth reading." -- Pacific Affairs "John Traphagan demonstrates why cross-cultural studies are critically necessary if we are to understand the range of meanings and experiences of age and aging in a pluralistic world." -- Journal of Japanese Studies "Gerontologists will find the book illuminating in its treatment of aging in cultural context in Japan as well as the meaning and significance of ritual and religion in this society. The key concepts of aging--ritual--health/wellness are intertwined; Traphagan does an excellent job of explaining the linkages as well as the cultural factors responsible for maintaining these links." -- Journal of Intergenerational Relationship "In addressing the full spectrum of topics concerning older adults' health and well-being along with the vast array of Japanese religious rituals, The Practice of Concern is uniquely ambitious in scope. At the same time, it is a thoughtful, ethnographically grounded account of rural life in Japan that produces useful insights for anyone with an interest in the cross-cultural study of aging and religion." -- Journal of Religion, Spirituality & Aging

It critically assesses the patterns and issues involved in the substantive law and policy environment which impact on investment flows, as well as the related dispute resolution law and practice. The book combines insights from international law and comparative study and is attentive to the socio-economic contexts and competing theories of the role of law in Asia. Contributions come from both academics with considerable practical expertise and legal practitioners with strong academic backgrounds. The chapters analyze the law and practice of investment treaties and FDI regimes in Asia looking specifically at developments in Japan, India, China, Indonesia, Malaysia, Korea and Vietnam. The book explores the impact of the Asian Financial Crisis in the late 1990s and the Global Financial Crisis a decade later, examining actual trends and policy debates relating to FDI and capital flows in Asia before and after those upheavals. Foreign Investment and Dispute Resolution: Law and Practice in Asia is a valuable resource for practitioners, academics and students of International and Comparative Law, Business and Finance Law, Business, Finance and Asian Studies.

Oriented towards the serious learner, there are no shortcuts in this book: no romanised Japanese for ease of reading beyond the introduction, no pretending that Japanese grammar maps perfectly to English grammar, and no simplified terminology. In return, this book explains Japanese the way one may find it taught at universities, covering everything from basic to intermediary Japanese, and even touching on some of the more advanced constructions.

Available in PDF, EPUB and Kindle. Book excerpt: Interest in international law has increased greatly over the past decade, largely because of its central place in discussions such as the Iraq War and Guantanamo, the World Trade Organisation, the anti-capitalist movement, the Kyoto Convention on climate change, and the apparent failure of the international system to deal with the situations in Palestine and Darfur, and the plights of refugees and illegal immigrants around the world. This Very Short Introduction explains what international law is, what its role in international society is, and how it operates. Vaughan Lowe examines what international law can and cannot do and what it is and what it isn't doing to make the world a better place. Focussing on the problems the world faces, Lowe uses terrorism, environmental change, poverty, and international violence to demonstrate the theories and practice of international law, and how the principles can be used for international co-operation.
