Para encaminar la investigación se parte de sus principales presupuestos teórico-metodológicos, diferenciación necesaria, para demostrar las insuficiencias de las mismas e identificar sus problemas teóricos, enjuiciar las relaciones que existen entre la formulación de estos problemas y las contradicciones histórico-sociales y argumentar los fundamentos a emplear para que el pensamiento criminológico se convierta en un discurso crítico y transformador. La problemática exigió como métodos de la investigación los siguientes: de análisis histórico, exegético-analítico y la revisión bibliográfica de autores relacionados con la temática, tanto literatura pasiva, activa y auxiliar que constituyeron fuentes valiosas. Se encuentra estructurado de la siguiente forma: el capítulo I, aborda los temas concernientes al nacimiento de la Criminología, el positivismo y el Estado, la naturaleza, concepto, contenido y categorías de esta ciencia; en el capítulo II, se realiza un análisis crítico a los presupuestos del pensamiento criminológico contemporáneo . Los resultados obtenidos nos permitió concluir que la Criminología posee una base conflictual donde se inserta el sujeto epistémico, y para que el pensamiento criminológico se convierta en un discurso crítico y transformador es necesario utilizar una metódica que difiera del empleado por las corrientes criminológicas contemporáneas, con un enfoque multidisciplinario. En el orden metodológico, además, el carácter complejo del fenómeno en cuestión requiere no sólo una epistemología de disciplina sino de saberes, que genere una diversa prospectiva capaz de trascender la mera empiria.
