Download or read book Foreign policy annual written by Mahendra Gaur and published by Gyan Publishing House. This book was released on 2007 with total page 410 pages. Available in PDF, EPUB and Kindle. Book excerpt: (In Fourteen Volumes) Foreign Policy Annual is the first publication of its type that provides a reliable chronicle of events in contemporary Indian Foreign Policy on a day-to-day basis. It covers India s participation in the deliberations of international organizations, and relations with her neighbours, regional and super powers; also contains chronicle of world events in which India reacted in defence of its national interests. The events deal with India s political, economic and strategic relations as well as unofficial opinion on world affairs. During all these eventful years as an independent nation, there has been phenomenal growth in our foreign contacts so much so that diplomatic relations have been established with almost all the countries of the world. Besides as a member of hundreds of international organizations, India has to participate in their periodic deliberations. The VIP visits and those numerous other groups have become common occurrences of the day. Hardly any country has the opportunity to extend hospitality in one single year to so many distinguished visits which are not merely acts of diplomatic courtesy. Then due to the growth of the political consciousness among our people, interest in world developments has assumed a new dimension. Our countrymen have grown critical of our government s international activities than of its doings on the home front. The vigilant press kept watchful eye on every initiative that govt. took or the way it reacted to different issues that arose from time to time. All this underlines the very fact that in view of India s growing importance in world politics, its increasing activities in the international sphere need to be viewed and chronicled periodically. The publication as such was introduced first time in 2001 and it has been continuing pleased at its lofty and lasting utility proven to the Indian as well as people from the foreign lands. Published in two volumes every year, saliently featured, it contains the documents in the first volume while the events with all accuracy are chronicled in the second one. The events have taken place either on our own land or on the foreign. And the documents, really rare to the provision to the commonly reach of the people or organizations, will in actual sense be proved invaluable, at ease, and these comprise of various kinds of documents-such as, addresses, international reports, bilateral or multilateral treaties, conventions, international agreements etc. proving to be highly beneficial to the people having the characters, of economic, politic, sociatic , health and hygine, environment etc. This publication will certainly prove to be a storehouse for knowledge, information and reference in many measures. The people will find it an easy access to the things which earlier either swam in air or rested in the books of the higher offices, meaning thereby beyond the complete reach.

Book Synopsis Legal Protection and Sustainability of Chinese Investments in Africa by : Xiuli Han
Download or read book Legal Protection and Sustainability of Chinese Investments in Africa written by Xiuli Han and published by Springer Nature. This book was released on 2022-08-26 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book attempts to illustrate the whole picture of international investment rule of law between China and African countries and find the way forward through combining theory and practice. It is a book by a Chinese professor based on her long-term research experience in the international investment law field and her African field work in person. Its main feature is its well-balanced thinking on the structure of investment international rule of law. It should be the most comprehensive research on the international investment rule of law between China and African countries. With the increase of Chinese investment in Africa, various discussions and viewpoints on Chinese investment in Africa have become striking. The purpose of this book is to explore systematically the protection and sustainability of Chinese investment under the concept and framework of the international investment rule of law, so as to serve the sustainable development of Africa and China. For the purpose of this book, great importance is attached to the idea of the international rule of law, and the international investment law with the function of rule of law is adhered to. The conclusion of this book is that China should take proactive steps to protect Chinese investment in Africa and regulate Chinese overseas investors and their investments in addition to complying with the laws in the host states and thus make them conductive to African and Chinese sustainable development; however, the most significant issue is that China-Africa investment relations should be regulated by the evolving and specific international investment rule of law, and the China-Africa international investment rule of law should conform to normative in form, support common sustainable development in value, and reflect the social reality of China and Africa. For both researchers and students, it is an approach to understand international investment rule of law from a perspective of China and Africa. For those who are interested in China and Africa, it is a useful reference book.

Book Synopsis The South China Sea Arbitration by : Alfredo C. Robles
Download or read book The South China Sea Arbitration written by Alfredo C. Robles and published by Liverpool University Press. This book was released on 2019-01-01 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: The South China Sea Arbitration, which marks the first time that the Philippines and China have been parties to a compulsory dispute settlement procedure, is a landmark legal case. The Tribunal tackled head-on critical issues in the interpretation and application of the UN Convention on the Law of the Sea that other international courts have failed to address, particularly the compatibility of historic rights with the Convention, the identification of maritime features as permanently submerged or above water at high-tide, and the distinction between features that are fully entitled to maritime zones and those that are not. In addition, the Tribunal also had to decide on issues as diverse as near-collisions at sea, illegal fishing of giant clams and sea turtles, and the destruction of fragile coral reefs resulting from island-building. The Tribunals task was rendered arduous by Chinas refusal to appear before it. In these circumstances, understanding the Tribunals decisions is a challenging undertaking. Chinas public relations campaign targeting the proceedings raised issues that the layperson could readily grasp, notably African states support for its non-appearance, the integrity of the judges, and the validity of arbitral awards. Understanding the Awards and Debating with China aims to facilitate understanding of the South China Sea Arbitration by presenting detailed summaries of the two Arbitral Awards. The author rebuts the questionable claims raised by Chinas public relations campaign and highlights Chinas covert actions during the proceedings.
Book Synopsis Trade in Goods by : Petros C. Mavroidis
Download or read book Trade in Goods written by Petros C. Mavroidis and published by Oxford University Press. This book was released on 2012-07-19 with total page 942 pages. Available in PDF, EPUB and Kindle. Book excerpt: This new edition of Trade in Goods is an authoritative work on international trade by one of the most influential scholars in the field. It provides a comprehensive and detailed analysis of every WTO agreement dealing with trade in goods. The focus of the book is on the reasoning behind the various WTO agreements and their provisions, and the manner in which they have been understood in practice. It introduces both the historic as well as the economic rationale for the emergence of the multilateral trading system, before dealing with WTO practice in all areas involving trade in goods. It contests the claim that the international trade agreements themselves represent 'incomplete contracts', realized through interpretation by the WTO and other judicial bodies. The book comprehensively analyses the WTO's case law, and it argues that a more rigorous theoretical approach is needed to ensure a greater coherence in the interpretation of the core provisions regulating trade in goods. This second edition readdresses and moves beyond the discussion of the GATT presented in the first edition to assess in significant detail every trade in goods agreement at the WTO, both multilateral as well as plurilateral. The book is written to be accessible to those new to the field, with an authoritative level of detail and analysis that makes it essential reading for lawyers and economists alike.

Book Synopsis Arbitration in Africa by : Lise Bosman
Download or read book Arbitration in Africa written by Lise Bosman and published by Kluwer Law International B.V.. This book was released on 2021-09-02 with total page 693 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Second Edition of this unprecedented volume assembles an updated and expanded country-by-country analysis – both practical and insightful – of how arbitration is conducted in forty-nine African countries, providing essential information about legislative provisions, treaty adherence, and arbitral procedure. Contributors include sought-after African arbitrators, distinguished practitioners, academics and institution-builders, all of whom are active in promoting the use of arbitration as a viable means of dispute resolution in Africa. Five sections representing the main regions of the continent, each with a substantive introductory chapter covering the major trends within that region, offer country overviews addressing issues such as the following: adherence to the key arbitration conventions; modernity of a State’s arbitration legislation and its compatibility with the UNCITRAL Model Law; particular features of arbitral practice in that jurisdiction (including responses to the COVID-19 pandemic); access to and (where available) statistics from local and regional arbitral institutions; significant arbitration-related national case law; and enforcement of foreign arbitral awards. A sixth section focuses on treaty-based investor-State arbitration against African States under the ICSID Convention, providing an empirical analysis of the experience and record of African States with investor-State arbitration in the period between 2010 and 2020. Useful tables and graphics of intra-African bilateral investment treaties, a list of ICSID proceedings involving African States, a list of treaty accession by African States, and other tabular features round out the volume. The first edition of this volume was welcomed by arbitration practitioners and legal academics everywhere as an essential guide to an emerging and important area of international arbitration practice. This second edition tracks the significant developments (in treaty accession, reform of arbitration legislation and developing case law) that have taken place over the past decade, and confirms that arbitration as a preferred method of dispute resolution is now firmly entrenched on the African continent.

Book Synopsis INTERNATIONAL ARBITRATION: THE SEAT IS KING by : Roland Amoussou, PH.D
Download or read book INTERNATIONAL ARBITRATION: THE SEAT IS KING written by Roland Amoussou, PH.D and published by ASIAFRICA CONSULTING (AACO) BOOKS . This book was released on 2023-04-10 with total page 134 pages. Available in PDF, EPUB and Kindle. Book excerpt: The notion of "seat" or "Place" is one of the most disconcerting in the international arbitration system. It is usually confused with similar notions such as "Site", "Place", "City", "Venue", "Forum", "Home", "Territory" or "Jurisdiction". Legal professionals add to the complexity with Latin expressions referring to the same such as "Lex fori" (the law of the forum – the jurisdiction –the venue) or "Lex Loci" (the law of the place"). Beyond the nod to Thailand with the title "The Seat is King", this book is a tribute as well as a contribution to the knowledge and practice of international arbitration in the Kingdom of Thailand. Identifying the seat of arbitration, the home legal system is one of the most important features of an arbitration clause. It sets the framework for the law governing the arbitration procedure and more importantly, the process and rights relating to the enforcement of the arbitral award. The battle around the world for having the best or safest arbitration seat is real. What are the assets that a country can display to win such a beauty contest? Generally speaking, the seat of the arbitration matters because it allows the arbitrator to determine conflict of law rules, as well as assistance, support, or control of the state judges. The "seat" or "place" of the arbitration has long been recognized as far more than a place where the main evidentiary hearing might be held. In many arbitrations, procedural meetings are often held remotely or in places other than the seat when it is more convenient to the parties and the tribunal. It is now widely accepted that the choice of seat has a range of potentially significant implications for supporting – or undermining – the effective and efficient conduct of the arbitration and the enforceability of the award. The book will also cover futuristic perspectives such as the transformation of legal documents into visual art thanks the blockchain technology and especially by using NFTs. I will discuss how an NFT can free an arbitration agreement, an arbitration process, an award, and its enforcement from the constraints of the Seat! Going further the chapter on "Blockchain arbitration and the seat" will look at how blockchain technology can potentially resolve all problems related to the seat of arbitration, through a peer-to-peer dispute resolution mechanism. From the arbitration agreement to the award and its enforcement, smart contracts will help resolve every issue traditionally covered by the seat of arbitration. Potentially, the support judge will not be needed anymore and the new york convention of 1958 may be obsolete! The book is an informative and entertaining journey to the seats of arbitration around the realms of the world and technology.
