El interés del menor también condiciona los derechos de los demás integrantes de la comunidad escolar, especialmente los referidos a la libertad de enseñanza como manifestación del pluralismo constitucional en el ámbito educativo (art. 1.1 CE) y de la libertad ideológica y religiosa (art. 16.1 CE).

La prevención frente al riesgo de manipulaciones semánticas a su propósito habilitantes de amplios márgenes de discrecionalidad a los poderes públicos se impone en la estructuración de cualquier sistema educativo que pretenda salva-guardar su condición emancipatoria. Ignacio Ara Pinilla, Catedrático de Filosofía del Derecho de la Universidad de La Laguna, en la que ha desempeñado simultáneamente durante los últimos diez años las funciones de Direc-tor de Departamento y Coordinador del Programa de Doctorado “Derechos humanos y orde-namiento constitucional”. Cuando algún grupo de personas sufre su violación, otras personas (en esta hipótesis, muchos ciudadanos de la Unión) no se dan cuenta de que se cuestiona, sufre y peligra la misma esencia de la democracia.
