Book excerpt: The fruits of human creativity are linked to Intellectual property and are integral to the progress of human kind, an indispensable element in economic development in present global environment. Intellectual property plays an important role in an increasingly broad range of areas, ranging from the Internet, biotechnology, forests, agriculture, health care and nearly all aspects of science and technology. At present, there is a sharp contrast between the wide spread international recognition of biotechnology s benefits and the apprehensions about its possible dangers to ecology. The Book Intellectual Property Rights and Conservation of Forest Resources provides information on international perspective of important issues in the field of patenting. The book examines international agreements, as well as national laws on the Intellectual Property Rights. The book makes readers aware of historical developments associated with IPR and requirements of IPR relating to spatial information or any geo-data . The case study on computerized application for determining vulnerability of species in wild , throws new dimension to determining vulnerability of species. The author, Dr Sudhanshu Gupta, has demonstrated computerized application for determining vulnerability of species in wild and has defined vulnerability of species based on statistically determined probable mathematical estimates. It is a book many people, may like to read to gain new depth and meaning to IPR related resources and their vulnerability.

Book excerpt: Provides an assessment of the international forest regime, in reponse to calls from many quarters, including the UN Intergovernmental Forum on Forests (IFF) and the World Commission on Forests and Sustainable Development, as well as several NGOs. The focus is mainly on action taken by countries at the global level, in the framework of legally binding instruments and institutions. It builds on previous analyses of the international forest regime by looking beyond the legal mandates to begin exploring the actual performance of the components against their mandates. With the Intergovernmental Panel on Forests (IPF) Proposals for Action as the point for departure, the effectiveness and impact of individual legal instruments and global instutions are analyzed, as is the potential for synergy between them.

Book excerpt: Biogenetic resources - the critical biological and chemical materials that underpin so much of medicine, both modern and traditional, agriculture, and wider economic activity in so many fields - are at the centre of heated debate regarding their use, development, and ownership, and the issues of ethics and equity that impinge on all of these factors. This book is a comprehensive examination of the key issues, institutions and ideologies in this area, presenting definitions and explanations of the fundamentals of intellectual property rights (IPRs), biogenetic resources and traditional knowledge. It uses the insights from this to build a picture of how these factors interact in practice, bringing to the surface issues such as: the conservation and sustainable use of biodiversity, benefit sharing from the commercial use of biodiversity, biotechnological innovation and the transfer of technology, agriculture, food security, rural development, health and international justice.Part 1 describes the relevant international IPR laws, highlights the extent to which modern commerce depends on such resources, and traces the way in which modern IPR law has evolved to accommodate this dependence. Part 2 shows how stronger IPR protection in the area of life science innovation has given rise to controversies such as 'biopiracy', 'terminator' genes and genetic uniformity. Part 3 focuses on traditional knowledge, its nature, its importance, and the applicability of IPR-style protection. Part 4 covers the international negotiation and policy-making of the WTO, WIPO and CBD and the legislative initiatives of national governments of Asia, Africa and Latin America. Finally, Part 5 focuses on two developing country case studies - of India and Kenya - assessing whether they will be able to gain economic benefit from development of their natural resources within the current regulatory system and whether this will encourage the conservation and sustainable use of the resource base. With its multidisciplinary approach and breadth of coverage, this book will appeal both to those new to the subject and to those with professional and specialist interest, including students, academics, legal practitioners, government policy-makers and the private sector.

Book excerpt: "Forest Resource Policy in Latin America" gathers the thinking of a score of experts on sustainable use and management of forests, including incentives for investment. The authors tackle the thorny social issues of property rights, deforestation, and forest management and ownership by indigenous people and take a hard look at the trade and environmental issues in forest production that will affect future directions for sustainable forestry development in Latin America. Some argue that the main opportunity to conserve natural forests lies in recognizing and paying for the environmental services they provide. In addition, compensatory measures such as the establishment and better management of strictly protected areas appear to be the best tools to delay the loss of ecosystems and species. Alternative forest concession policies and trade and environmental issues in forest production are also analyzed.

Book excerpt: This book argues that intellectual property (IP) management development and innovation are fundamental to economic development , especially in newly emerging economies which often hold vast reserves of natural resources and human knowledge that remain unprotected. It sheds light on countries that are gradually realising this situation, with examples from many parts of the world, including Eastern Europe, Africa and especially Asia including India, where a great deal is being made of innovation and intellectual property to stimulate economic growth. These case studies are seen within the theoretical context of the future of cross-border IP which is slowly becoming a reality. Specific examples go beyond the patent prosecution highway, to which China has also recently signed up, and India’s development of generic drugs at lower costs. Experts in the field including practising IP lawyers explain and criticise current and new models being tested in emerging economies concerning IPR. Original case studies of hitherto little understood breaches of African trademarks by the US and Japan, and patenting mistakes in relation to little known Indian forest plants all damage emerging economies and their native people's lives. While proper implementation of IP laws by emerging economies themselves can lead to positive outcomes for all involved, the key is an independent judiciary coupled by thoughtful and thoroughly understood implementation of IP laws within the context of cross border IP. The book shows through models how different emerging economies are at various levels of developing their IPR and what paths they are taking to do this. Finally, it provides a comprehensive assessment of the ways in which innovation, protection and enforcement of IP laws can help newly emerging economies achieve economic growth without destroying natural and human resources, while moving ahead from the current global financial crisis.

Book excerpt: Who has rights to forests and forest resources? In recent years governments in the South have transferred at least 200 million hectares of forests to communities living in and around them . This book assesses the experience of what appears to be a new international trend that has substantially increased the share of the world's forests under community administration. Based on research in over 30 communities in selected countries in Asia (India, Nepal, Philippines, Laos, Indonesia), Africa (Burkina Faso, Cameroon, Ghana) and Latin America (Bolivia, Brazil, Guatemala, Nicaragua), it examines the process and outcomes of granting new rights, assessing a variety of governance issues in implementation, access to forest products and markets and outcomes for people and forests . Forest tenure reforms have been highly varied, ranging from the titling of indigenous territories to the granting of small land areas for forest regeneration or the right to a share in timber revenues. While in many cases these rights have been significant, new statutory rights do not automatically result in rights in practice, and a variety of institutional weaknesses and policy distortions have limited the impacts of change. Through the comparison of selected cases, the chapters explore the nature of forest reform, the extent and meaning of rights transferred or recognized, and the role of authority and citizens' networks in forest governance. They also assess opportunities and obstacles associated with government regulations and markets for forest products and the effects across the cases on livelihoods, forest condition and equity. Book excerpt: The tropical rain forests have become an important focus in the search for new drugs from natural sources, especially from plants. This volume aims to promote a better understanding between scientists and institutions located in the developed and developing countries, in their efforts to search for new medicinal agents from the plants of these forests. The papers have been contributed by scientists and researchers from both developed and developing countries worldwide, and cover issues relevant to biodiversity prospecting activities. Such issues include rules and regulations on the collection of genetic materials for biological testing; logistical and technical challenges to be faced; sharing the benefits of discovery; patent protection for the discovery of potentially useful drug candidates; intellectual property rights; and indigenous property rights. The volume will be invaluable in achieving more fruitful collaborative efforts between scientists from different countries and different institutional affiliations, in their search for new drugs from tropical forest plants.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the contribution which intellectual property rights can make in the struggle for food security in developing countries. The book consists of 11 chapters. Chapter 1 locates intellectual property rights within the armoury of food security policies. Chapter 2 deals with definitional issues and examines the role of intellectual property rights in incentivizing agricultural research and development. Chapter 3 examines the international landscape of intellectual property and the approaches taken to the relationship between intellectual property rights, agricultural biotechnology, access to biological resources, food security and globalization which are taken by the WTO, FAO, CBD and WIPO among the various international and development agencies. Plant variety rights (PVRs) are a specially created form of intellectual property right originally minted to encourage agricultural innovation and Chapter 4 examines the effectiveness of PVRs in a food security context. Agricultural innovation is in part dependent upon access of researchers to the genetic resources of the biodiverse countries of the South. Chapter 5 considers the attempts to construct an international regime to secure this access. The important role of traditional farmers in preserving landraces and cultivars from which improvements can be derived has generated for a call for the recognition of farmers' rights, and this is examined in Chapter 6 together with agitation for the protection of the traditional knowledge which often informs access to the useful genetic resources. Chapter 7 examines the intellectual property implications of the use of genetically modified (GM) crops as a technological solution to food insecurity. The protection of GM crops is achieved through patent protection and Chapter 9 looks at the competition law implications of patent licensing, patent pools and patent thickets. An old intellectual property device that underpinned the commercial development of European agricultural marketing is the geographical indication, and Chapter 8 examines the contribution it might make to achieving food security. Returning to the theme of the role of intellectual property law in incentivizing innovation, Chapter 10 examines its role in promoting agricultural research. The concluding chapter proposes a number of recommendations for action in deploying intellectual property law in the struggle for food security.
