Book excerpt: Taiwan has made significant efforts in the last five years to overhaul its IP system according to international standards and since January 2002 has been a member to WTO/TRIPS. After frequent revisions of the IP laws in the 1990s in order to gear up for WTO accession, the legal system has now reached a certain level of consolidation that makes publication both timely and advisable. The more so, as there is no comprehensive book on the Taiwanese IP system published in English. This volume is written by leading Taiwanese academics and practitioners in the IP field and has been edited by the Max Planck Institute. All areas of IP are covered in around 200 pages and the appendix contains the relevant statutory provisions. Importance is attached to the practice of the courts and IP offices and to matters related to enforcement. An introductory chapter puts the IP system in the context of Taiwanese law in general. This book will appeal to practitioners and academics alike. The book is part of the Max Planck Series on Asian Intellectual Property Law.

Available in PDF, EPUB and Kindle. Book excerpt: This study examines the development of copyright protection in Taiwan, from cultural, political, historical and legal points of view and from a variety of sources, including in-depth personal interviews with government officials, lawyers, scholars and officers of intellectual property protection organizations who have either participated in Taiwan's copyright reform or in the copyright negotiations with the United States. This study also explores underlying factors behind Taiwan's copyright revolution from the perspectives of press theories and intellectual property theories. The author finds that copyright infringement of foreign and domestic works were rampant in Taiwan throughout the second half of the twentieth century because of several historical factors: political, legal, and economic concerns. But lack of the concept of copyright or intellectual property in general in the society was the underpinning factor. In other words, there has been a huge cultural difference between the West and Taiwan in the aspect of intellectual property protection throughout the history of their respective civilizations. This helps explain why copyright piracy was not a concern among the Taiwanese citizens and the Taiwan government until the United States started to pressure Taiwan for improvement with the threat of trade sanctions. Forces behind Taiwan's copyright reform included external/foreign pressure as well as internal/domestic forces. In addition to providing a comprehensive history and analysis of the copyright dispute between the United States and Taiwan and creating a whole new understanding of Taiwan's copyright reform and the copyright disputes between the two nations, this study also reveals that underlying the comprehensive history of the copyright disputes between the United States and Taiwan, there are the missing elements within the literature about policy toward intellectual property rights in a free or controlled press/speech system. And those elements are important in helping scholars more comprehensively understand how each press/speech system is conceived and operates. Most previous literature that discusses free and controlled press systems does not comprehensively explain the importance of intellectual property rights within each tradition. This study suggests that literature should include more intellectual property rights traditions in understanding both press/speech systems.

While the Chinese government, since joining the WTO, has made greater efforts to halt piracy, successes have been minimal since China is first grappling with the creation of a modern legal structure that includes laws, enforcement mechanisms and a dispute resolution processes. The 140-page report analyzes the steps that large multi-national corporations are taking to protect their patents, copyrights and trademarks. It offers a number of case studies and detailed descriptions of actions taken by these corporations.

Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the main legal and economic challenges to the creation and enforcement of security rights in intellectual property and explores possible avenues of reform, such as more specific rules for security in IP rights and better coordination between intellectual property law and secured transactions law. In the context of business financing, intellectual property rights are still only reluctantly used as collateral, and on a small scale. If they are used at all, it is mostly done in the form of a floating charge or some other “all-asset” security right. The only sector in which security rights in intellectual property play a major role, at least in some jurisdictions, is the financing of movies. On the other hand, it is virtually undisputed that security rights in intellectual property could be economically valuable, or even crucial, for small and medium-sized enterprises – especially for start-ups, which are often very innovative and creative, but have limited access to corporate financing and must rely on capital markets (securitization, capital market). Therefore, they need to secure bank loans, yet lack their own traditional collateral, such as land.

Book excerpt: The rapid evolution of China from an emerging to a mature intellectual property jurisdiction has far-reaching implications for the law, policy and practice of IP, and their links with competition and technology law. Produced in the year China rose to fourth rank globally as user of the international patent system, this volume is an invaluable guide for the policymaker, the analyst and the practitioner alike, setting a thorough exposition of the substantive law and its application within a broader policy context, and offering a comprehensive, timely overview of an IP system just at the time it begins to assume central significance on the world stage. Antony Taubman, Director, IP Division, WTO This edited volume offers an excellent comprehensive overview of China s intellectual property and technology laws. The eminent contributors to this volume have played important roles in shaping China s IP system and in tackling the many challenges confronting it. By making their views of the system readily accessible to an English audience, this volume will undoubtedly add to our understanding of the legal protections and challenges facing innovation industries in China. Mark Wu, Harvard Law School, US The pioneering studies in this book examine the fundamental role of intellectual property and technology laws as China is moving from made in China to created in China . This book also helps us to understand about the interplay between China s intellectual property protection system and the potential for transition of China s economy, and provides numerous means to deal with the legislative difficulties in China s innovation-oriented strategy. Wu Handong, Zhongnan University of Economics and Law, China Written by some of China s leading academic experts and with a foreword by the former Chief Justice of the IP Tribunal of China s Supreme People s Court, this book combines for the very first time a review of both Chinese intellectual property and technology laws in a single volume in English. The book initially focuses on recent amendments to the laws of copyright, trademarks, patents, before moving on to discuss unfair competition and trade secrets, and the protection of intellectual property over electronic networks. Other chapters cover the regulation of digital networks and telecommunications; IT and E-commerce; the new antimonopoly law and competition; and China s position on the TRIPS agreement. Of special note is a chapter written by in-house Counsel and the Chairman of the Quality Brands Protection Committee (a coalition of well known multinational brands) reviewing both brand protection and practical enforcement of intellectual property in China. This book will appeal to scholars and postgraduate students in commercial law (especially in IP, trade, competition, and technology), Chinese studies and business, as well as regulators, international agencies and law firms. Management consultancy and accounting firms, banks and investment firms will also find this book invaluable.
