Book excerpt: Compendium of documents on National Human Rights Institutions in eastern and southern Africa Edited by Charles M Fombad 2019 ISBN: 978-1-920538-95-8 Pages: 898 Print version: Available Electronic version: Free PDF available About the publication Africa’s increasing recognition and protection of human rights have been accompanied by a surge in the number of NHRIs established with broad mandates to promote and protect human rights. The mandates and powers of the NHRIs vary from country to country, as does their ability to deliver on these mandates. Indeed, the rapid increase in the number of NHRIs in Africa has come with a variety of substantive and operational challenges. In the face of such challenges, those who work in NHRIs need to understand the broader regional and global context in which the institutions operate and the changing nature of human rights issues. This compendium provides an overview of NHRIs in eastern and southern Africa. It is guided to a large extent by the internationally agreed-upon Principles Relating to the Status of National Institutions, referred to as the Paris Principles. These Principles are broadly accepted as the benchmark against which the legitimacy and credibility of NHRIs can be assessed. Endorsed by the United Nations General Assembly in 1993, the Paris Principles provide NHRIs with guidelines as to their competence and responsibilities, their composition and guarantees of independence and pluralism, and their methods of operation; additional principles relate to the status of commissions with quasi-jurisdictional competence. The generous financial support of the Konrad Adenauer Stiftung, Rule of Law for Sub-Saharan Africa, Nairobi, Kenya office, is gratefully acknowledged. Book excerpt: The right to equal treatment is undoubtedly one of the most fundamental human rights. As such, it can be found in international human rights treaties, in constitutions and in national legislation. In this book the principle of equality is analysed from different angles, bearing in mind the South African and Belgian experiences in this area. Firstly, a general overview is given of the different sources of human rights law in the Belgian and South African legal system, the relation between international and national law, the direct applicability and third party-applicability of rights and freedoms in the legal order(s), and the implementation mechanisms available both in Belgium and South Africa. Secondly, the principle of equality, as found in the Belgian Constitution, in the European Convention on Human Rights and in the South African Constitution, and the South African Antidiscrimination Bill are analyzed. Finally, the principle of equality is being studied from a thematic perspective, i.e. with regard to the use of languages and from a gender perspective. The book is concluded with a contribution on the access to medical and health care in South Africa.

After a substantial, successful period in Scotland, both as a practising advocate and professor of EC law, he was appointed to the Court of First Instance upon its creation in 1989. He was subsequently appointed to the Court of Justice where he has served for many years. This book has been prepared in honour of his retirement from that position in December 2003. The contributions reflect all aspects of Judge Edward's career as a lawyer, both in Scotland and in Luxembourg. In keeping with the respect with which he is held, contributions have been received from eminent members of the Scottish and Luxembourg judiciary, academics and practitioners. Not surprisingly, the main focus is on Community law, with important contributions on competition, institutional, substantive and remedial issues. This book will be an essential addition to the library of anyone with a genuine interest in Community law.

Available in PDF, EPUB and Kindle. Book excerpt: Intense political, social and scientific efforts to improve the position of children are converging rapidly, centered on the UN Convention on the Rights of the Child. It is therefore reasonable to assume that there is broad consensus in the international community on how to take the position of children in society seriously. Despite the unique success of the Convention, the situation is such that it forces us, as a matter of urgency, to explore, develop and implement guarantees for effective monitoring of the implementation of the Convention's provisions. In the end, rights are only effective when implemented. This book, containing the contributions made and discussed at the European Conference on Monitoring Children's Rights (organized by Ghent University's Children's Rights Centre in December 1994), presents the results of interdisciplinary research into monitoring to a wider scientific forum. Several monitoring issues are tackled, with particular emphasis on the reporting system: what should be reported (the content of the reports) and who should report (the more formal and procedural aspects of reporting)? Apart from a suitable monitoring mechanism, there is also the self-executing force of the Convention, making it directly enforceable in national courts. Ongoing and dynamic monitoring can be a powerful impetus to making systematic progress in this area. The debate on monitoring the Children's Rights Convention may in this way expand into an attractive and exemplary debate on human rights conventions in general. This book will therefore not only meet the requirements of all those working in the field of children's rights, but can also provide appealing material for all those involved in the field of monitoring human rights.
