These proposed changes to the law and regulation relating to human reproductive technologies, following on from a public consultation exercise undertaken during 2005, sought to balance the competing claims of reproductive liberty and responsibility, patient safety, child welfare, professional autonomy and public accountability. The overarching aim is to achieve the common good through a system which is broadly acceptable to society, given the complex ethical issues involved, and which is effective given the pace of scientific developments. This present document contains the draft text of the proposed Human Tissue and Embryos Bill, published in order to enable pre-legislative scrutiny of the proposals by a Parliamentary Committee. It includes the text of the draft Bill, explanatory notes, a draft regulatory impact assessment and a version of how the Human Fertilisation and Embryology Act would look if amended by the draft Bill and the EU Tissue Directive. The proposals include the creation of the new single regulatory authority on the use of human tissue, cells and blood, to be called the Regulatory Authority for Tissue and Embryos (RATE), to replace the Human Fertilisation and Embryology Authority and the Human Tissue Authority.

Book excerpt: The demise on 3 June 2009 of Dairy Farmers of Britain (DFB) resulted in substantial losses for its 1,813 farmer members. It also resulted in more than a thousand job losses. A market crash was avoided, thanks to the positive response of - among others - the receivers, the Department for Environment, Food and Rural Affairs (Defra), the Welsh Assembly Government, and, in general the dairy industry itself. The Committee believes the way in which DFB pursued its vertical integration strategy was over-ambitious. No single factor caused the demise of the DFB although the purchase of Associated Cooperatives Creameries (ACC) for a total of £81 million in 2004 had lasting repercussions. They are satisfied that DFB did not fail because it was a co-operative. However, its failure draws attention to a number of ways in which UK dairy co-operatives could be strengthened. Defra should be offering advice and assistance and they are urged to set up a task force comprising the Financial Services Authority, members of the banking community and industry representatives to investigate ways to overcome constraints on capitalising agricultural co-operatives. Defra must also raise with the Treasury the need to ensure that farmers are not taxed on money that is only notionally paid out to them and actually retained by their co-operative. They also recommend that Defra produce a report examining governance and capital raising arrangements in successful co-operatives overseas. The collapse of DFB also draws attention to the urgent need to update insolvency legislation as it applies to co-operatives.

Book excerpt: In the past decades, the European Union has made little progress with respect to disqualifications as a sanction mechanism for the violation of laws. The creation of some form of harmonization is necessary, but the complex nature of this specific sanction mechanism has caused policy initiatives to be postponed, time after time. In answer to a call from the European Commission, the contributors in this book have conducted a comparative legal analysis in the EU 27 and looked into the practical experiences with disqualifications from a domestic and a cross border perspective. To that end, academics, policy makers, and practitioners in the Member States have been consulted. Analysis reveals a wide variety in the typology of the disqualifications as a sanction measure, the typology of the persons to whom the disqualifications can be imposed, and the typology of the authorities involved. Furthermore, there are considerable differences with respect to the inclusion of disqualifications in the national criminal records databases. Linked thereto information on foreign disqualifications is scarce and rarely used in practice. To ensure a comprehensive and consistent policy approach, this book has come up with a so called disqualification triad, comprising: (1) unified EU-wide disqualifications, (2) mutual recognition of disqualifications, and (3) EU-wide equivalent effect of disqualifications. The functioning of the disqualification triad has been further elaborated on in three case studies, which are public procurement disqualifications, disqualifications from working with children, and driving disqualifications.
