Book excerpt: In July 2008 the Parliamentary and Health Service Ombudsman presented a report concerning the prudential regulation of the Equitable Life Assurance Society (HC 815, session 2007-08, ISBN 9780102957303). The report made ten findings of maladministration, determined that this maladministration had led to injustice, and made two recommendations: that the Government should apologise to policyholders for the serial regulatory failure and; that the Government should establish and fund a compensation scheme. The Public Administration Select Committee also reported on this matter: "Justice delayed" (HC 41-1, session 2008-09, ISBN 9780215525536). On 15 January 2009 the Government published their response: "The prudential regulation of the Equitable Life Assurance Society" (Cm. 7538, ISBN 9780101748124). The Government accepted some, but not all, of the Ombudsman's findings and apologised to policyholders. The Government decided to reject the central recommendation - that the Government should establish and fund a compensation scheme. Instead Sir John Chadwick was appointed to advise the Government on the extent of relative losses suffered and what proportion might be attributed to the maladministration before some ex gratia payments were made. This report presents the Ombudsman's assessment of the Government's response. She is disappointed that the Government rejected many of the findings and is unpersuaded by the basis for those rejections. The Ombudsman has three concerns about the "alternative approach" or Chadwick process, which she brings to Parliament's attention: it breaks the link between injustice and remedy; the lack of clarity about the process; selective use of the Penrose report in the Government response.

Book excerpt: Administrative Law provides a sophisticated but highly accessible account of a complex area of law of great contemporary relevance and increasing importance. Written in a clear and flowing style, the text has been radically reorganized and extensively rewritten to present administrative law as a framework for public administration. After an exploration of the nature, province, and sources of administrative law as well as the concept of administrative justice, the book briefly discusses the institutional framework of public administration. The second part of the book deals with the normative framework of public administration, starting with a general discussion of administrative tasks and functions and then examining in some detail norms relating to administrative procedure and openness, decision-makers' reasoning processes and the substance of administrative decisions. The next topic is the private law framework provided by the law of tort, contract, and restitution. The third part of the book provides an account of institutions and mechanisms of accountability by which the framework of public administration is policed and enforced: judicial review and appeals by courts and tribunals, bureaucratic and parliamentary oversight, and investigations by ombudsmen. This part ends by considering how these various mechanisms fit into the administrative justice system. The final part of the book explores the functions of administrative law and its impact on administration.

Available in PDF, EPUB and Kindle. Book excerpt: Criminal proceedings, it is often now said, ought to be conducted with integrity. But what, exactly, does it mean for criminal process to have, or to lack, 'integrity'? Is integrity in this sense merely an aspirational normative ideal, with possibly diffuse influence on conceptions of professional responsibility? Or is it also a juridical concept with robust institutional purchase and enforceable practical consequences in criminal litigation? The 16 new essays contained in this collection, written by prominent legal scholars and criminologists from Australia, Hong Kong, the UK and the USA, engage systematically with - and seek to generate further debate about - the theoretical and practical significance of 'integrity' at all stages of the criminal process. Reflecting the flexibility and scope of a putative 'integrity principle', the essays range widely over many of the most hotly contested issues in contemporary criminal justice theory, policy and practice, including: the ethics of police investigations, charging practice and discretionary enforcement; prosecutorial independence, policy and operational decision-making; plea bargaining; the perils of witness coaching and accomplice testimony; expert evidence; doctrines of admissibility and abuse of process; lay participation in criminal adjudication; the role of remorse in criminal trials; the ethics of appellate judgment writing; innocence projects; and state compensation for miscarriages of justice.

Available in PDF, EPUB and Kindle. Book excerpt: The statutory duty of public service ombudsmen (PSO) is to investigate claims of injustice caused by maladministration in the provision of public services. This book examines the modern role of the ombudsman within the overall emerging system of administrative justice and makes recommendations as to how PSO should optimize their potential within the wider administrative justice context. Recent developments are discussed and long standing questions that have yet to be adequately resolved in the ombudsman community are re-evaluated given broader changes in the administrative justice sector. The work balances theory and empirical research conducted in a number of common law countries. Although there has been much debate within the ombudsman community in recent years aimed at developing and improving the practice of ombudsmanry, this work represents a significant advance on current academic understanding of the discipline.

Available in PDF, EPUB and Kindle. Book excerpt: Public Law is a high quality introductory textbook that comprehensively covers the key topics found on undergraduate public law courses. Three key themes that permeate all of the content allow students to approach the content in a structured and easy to understand way and questions posed throughout the chapters give students the opportunity to provide answers that show how their knowledge has increased as the chapter progresses. The key themes are: -The significance of executive power in the contemporary constitution and the challenge of ensuring that those who wield it are held to account -The shift in recent times from a more political to a more legal constitution and the implications of this change -The increasingly 'multi-layered' character of the British constitution Online Resource Centre Public Law is accompanied by a free, open-access Online Resource Centre (www.oxfordtextbooks.co.uk/orc/elliott_thomas) which offers the following resources to support students: - Figures from the book reproduced online - A list of useful websites for students - Regularly posted legal and political updates for the book - A testbank of questions for tutors to assess students' progress This book has been highly endorsed by lecturers for level of coverage, accuracy, and the manner in which the three themes provide an excellent backdrop to the book's content. 'I think it will be a very welcome addition to the range of text books available and I suspect that it will become my personal favourite.' - Barbara Mauthe; Lancaster University 'I found the book impressive and likely to be of interest and use to a great many. It is written in a style that is pitched about the right level. It was easy to understand and provides - for me - a good blend of black letter law and socio-political context' - David Mead; University of East Anglia Written by two experienced teachers of the subject, Public Law is an essential new text that focuses on what students need to engage with and understand this challenging subject.

Book excerpt: As a result of two investigations on the funding of care for elderly and disabled people, in 2003 and 2004, the Health Service Ombudsman recommended: a review of the continuing care eligibility criteria; and efforts to remedy any consequential financial injustice where the criteria had not been applied in a fair or appropriate fashion. However there have been complaints that the recompense has not been sufficient and this report looks at the specific case of someone who was not given redress for the premature sale of her uncle's property. It finds that there was maladministration and makes the recommendation that the Department should distribute national guidance on continuing care redress that aims to return individuals to the position they would have been in if they had not wrongly been denied continuing care funding.
