Book Synopsis Law Books in Action by : Angela Fernandez
Download or read book Law Books in Action written by Angela Fernandez and published by Bloomsbury Publishing. This book was released on 2012-04-02 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: 'Law Books in Action: Essays on the Anglo-American Legal Treatise' explores the history of the legal treatise in the common law world. Rather than looking at treatises as shortcuts from 'law in books' to 'law in action', the essays in this collection ask what treatises can tell us about what troubled legal professionals at a given time, what motivated them to write what they did, and what they hoped to achieve. This book, then, is the first study of the legal treatise as a 'law book in action', an active text produced by individuals with ideas about what they wanted the law to be, not a mere stepping-stone to codes and other forms of legal writing, but a multifaceted genre of legal literature in its own right, practical and fanciful, dogmatic and ornamental in turn. This book will be of interest to legal scholars, lawyers and judges, as well as to anyone else with a scholarly interest in law in general, and legal history in particular.

Book Synopsis Writings on India by : John Stuart Mill
Download or read book Writings on India written by John Stuart Mill and published by University of Toronto Press. This book was released on 1990-01-01 with total page 395 pages. Available in PDF, EPUB and Kindle. Book excerpt: John Stuart Mill worked for thirty-five years in the Examiner's Office of the East India Company, first as a junior clerk and finally as head of the Office. His activities there are among the least examined aspects of his career. Mill was somewhat reluctant, because of his official position, to comment publicly on the Company's affairs, but occasionally he put forwards views in essays and before parliamentary committees that alert us to important elements in his thought and career. Further, when in the aftermath of the Indian Mutiny a succession of bills was brought forward in parliament to abolish the Companty, Mill was its chief spokesman in a succession of carefully argued pamphlets that reveal even more of his views. This volume offers the first opportunity for a fill assessment of Mill's contribution, including as it does the first reprinting of the essays, parliamentary evidence, and pamphlets, and adding an appendix of an annotated record and location of his despatches.

Available in PDF, EPUB and Kindle. Book excerpt: John Stuart Mill worked for the East India Company in London for thirty-five years (1823-58), drafting many hundreds of dispatches for the guidance of British administrators in India. Historians have long been aware of Mill's involvement in British Indian government. This comprehensive effort brings together different strands of scholarship on Mill to determine the character of his role based on analyses of his draft despatches and comparisons of their practical and theoretical concerns with the broad themes of Mill's major writings on political philosophy and economics. The essays in this collection explore specific aspects of Mill's approach to Indian issues, including religion, law, education, and security, and also place him within the broader currents of utilitarianism. The contributors present different perspectives on the ideology in Mill's pragmatic work for the Company and his personal philosophy.

Download or read book Hurt Sentiments written by Neeti Nair and published by Harvard University Press. This book was released on 2023-03-07 with total page 353 pages. Available in PDF, EPUB and Kindle. Book excerpt: An insightful history of censorship, hate speech, and majoritarianism in post-partition South Asia. At the time of the India-Pakistan partition in 1947, it was widely expected that India would be secular, home to members of different religious traditions and communities, whereas Pakistan would be a homeland for Muslims and an Islamic state. Seventy-five years later, India is on the precipice of declaring itself a Hindu state, and Pakistan has drawn ever narrower interpretations of what it means to be an Islamic republic. Bangladesh, the former eastern wing of Pakistan, has swung between professing secularism and Islam. Neeti Nair assesses landmark debates since partition—debates over the constitutional status of religious minorities and the meanings of secularism and Islam that have evolved to meet the demands of populist electoral majorities. She crosses political and territorial boundaries to bring together cases of censorship in India, Pakistan, and Bangladesh, each involving claims of “hurt sentiments” on the part of individuals and religious communities. Such cases, while debated in the subcontinent’s courts and parliaments, are increasingly decided on its streets in acts of vigilantism. Hurt Sentiments offers historical context to illuminate how claims of hurt religious sentiments have been weaponized by majorities. Disputes over hate speech and censorship, Nair argues, have materially influenced questions of minority representation and belonging that partition was supposed to have resolved. Meanwhile, growing legal recognition and political solicitation of religious sentiments have fueled a secular resistance.
