With unprecedented force, Europeans have begun to question the need for deeper integration. Some fear threats to established national identities, while others perceive the emergence of a distant but powerful Brussels, beyond the reach of democratic control. Legitimacy and the European Union breaks with established approaches to the problem of the legitimacy of the European Union by focusing on the recent trend towards reconceptualization of the EU not as a superstate or an organization of states, but as a multi-level, contested polity without precedent. The book examines the implications of this reconceptualization for the problem of legitimacy. Individual chapters focus on policy areas, institutions and identity politics. Taken together, they reach two main conclusions. While Europeans do not strongly identify with the EU, they increasingly recognize it as a framework for politics alongside existing national and subnational structures. And while the EU lacks central democratic institutions, the integration process has spawned significant informal and pluralist forms of representation. Rethinking recognition and representation ouside the context of the nation state points to important, if little understood, actual and potential sources of EU legitimacy.

Despite a voluminous theoretical literature dealing with this question, there is hardly any systematic empirical investigation of the effectiveness of the system of political representation in the EU and ofthe legitimacy beliefs of EU citizens that spring from it.This volume elaborates a conceptual framework for the empirical analysis of the alleged democratic deficit. Four dimensions of legitimacy beliefs are identified and analysed: the European political community, the scope of EU government, the institutions and processes of EU government, and EUpolicies.Based upon large-scale representative surveys among the mass publics, and different strata of the political elite of the EU and its member-states, the book examines the conditions of political representation in the EU. The results demonstrate, by and large, that legitimacy beliefs of EU citizensare the more positive, the less specific the object of identification and evaluations is; and that the process of political representation works pretty well as long as issues other than European Union issues are concerned. These findings are finally discussed in view of familiar strategies forinstitutional reform of the European Union.

Many commentators argue that this could be remedied by increasing the powers of the European Parliament relative to those of the Council and the Commission. The fact that the European Parliament is the only EU institution whose members are directly elected leads to the assumption that it is also the most legitimate. The author argues that this position is based on the flawed assumption that the nature of the European citizenry is similar to those of the member states. In other words, the position assumes that the union has a demos, or a people, who are prepared to accept majority outcomes even when finding themselves in the minority. In this book the author argues that this is not the case and that the most severe dimension of the democracy problem is not procedural, but socio-psychological. The fact that the EU does not have a people means that establishing an EU-wide democracy based on analogies to domestic political systems is likely to lead to a further loss of democratic legitimacy. The EU can rely on output legitimacy in policy areas which do not require pan-European solidarity and identity and in which policy-making at EU-level increases efficiency and thereby benefits all citizens. However, policy areas which require high levels of solidarity or a common identity should either remain fully within the nation states, or be subject to intergovernmental rather than supranational decision-making at EU-level.

Book excerpt: Scholars generally agree that 'independent institutions' have become a ubiquitous and pervasive feature of EU polity. The blossoming of regulatory agencies, the critical role of the European Court of Justice, the salient position of the European Central Bank and of the Commission (particularly its powerful and quasi-autonomous DG Comp) have exemplified an overall process of delegation of governmental functions to institutions put at distance from direct diplomatic and electoral 'pressures'. Yet, most accounts of this 'rise of the unelected' have stuck to sector-specific explanations providing idiosyncratic reasons for the 'functionality' of statutory independence in the different judicial, monetary, executive branches of EU government. As a result, we still fail to grasp the deep and cross-sectorial entanglement between 'independence' and the 'European project'. This paper brings together recent streams of scholarship in historical sociology, critical legal scholarship and political science and uses them to suggest a renewed narrative of EU polity-formation, whereby 'independence' and 'expertise' form the very terrain on which Europe's political capacity and specialised form of authority have been shaped, staged and consolidated.
