Book Synopsis Tax, Order, and Good Government by : E.A. Heaman
Download or read book Tax, Order, and Good Government written by E.A. Heaman and published by McGill-Queen's Press - MQUP. This book was released on 2017-06-08 with total page 599 pages. Available in PDF, EPUB and Kindle. Book excerpt: Was Canada's Dominion experiment of 1867 an experiment in political domination? Looking to taxes provides the answer: they are a privileged measure of both political agency and political domination. To pay one's taxes was the sine qua non of entry into political life, but taxes are also the point of politics, which is always about the control of wealth. Modern states have everywhere been born of tax revolts, and Canada was no exception. Heaman shows that the competing claims of the propertied versus the people are hardwired constituents of Canadian political history. Tax debates in early Canada were philosophically charged, politically consequential dialogues about the relationship between wealth and poverty. Extensive archival research, from private papers, commissions, the press, and all levels of government, serves to identify a rising popular challenge to the patrician politics that were entrenched in the Constitutional Act of 1867 under the credo "Peace, Order, and good Government." Canadians wrote themselves a new constitution in 1867 because they needed a new tax deal, one that reflected the changing balance of regional, racial, and religious political accommodations. In the fifty years that followed, politics became social politics and a liberal state became a modern administrative one. But emerging conceptions of fiscal fairness met with intense resistance from conservative statesmen, culminating in 1917 in a progressive income tax and the bitterest election in Canadian history. Tax, Order, and Good Government tells the story of Confederation without exceptionalism or misplaced sentimentality and, in so doing, reads Canadian history as a lesson in how the state works. Tax, Order, and Good Government follows the money and returns taxation to where it belongs: at the heart of Canada's political, economic, and social history.

Download or read book Prairie Justice written by Wayne Sumner and published by University of Toronto Press. This book was released on 2024-10-01 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: In May 1928, the body of George Edey was discovered on his Saskatchewan farm, leading to the swift arrest of a deaf and mentally disabled farmhand named Mike Hack. Following a three-day murder trial, Hack was quickly convicted and sentenced to death. Denied clemency, in January 1929 he was hanged in the courtyard of the Regina Jail at twenty-seven years of age and buried in an unmarked grave. Prairie Justice dissects this case, revealing its implications for important themes in the history of the Canadian criminal justice system. Wayne Sumner meticulously traces the narrative of the case, analysing each step from the initial murder investigation to the subsequent arrest, trial, conviction, denial of clemency, and execution of the man accused. Drawing on a personal connection to the case rooted in his family history – his father’s hometown was the village where the crime occurred, and both his grandfather and great-grandfather were involved in the investigation – Sumner uncovers deeper and more universal reasons to share the story. The book punctuates the narrative with insightful analysis on key criminal justice themes illustrated by the case: unfitness to stand trial, the defence of insanity, ineffective assistance of counsel, wrongful conviction, and miscarriage of justice. Ultimately, Prairie Justice exposes how access to justice can be merely illusory for the poor and marginalized.

Book Synopsis Canadian State Trials, Volume V by : Barry Wright
Download or read book Canadian State Trials, Volume V written by Barry Wright and published by University of Toronto Press. This book was released on 2022-11-01 with total page 438 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fifth and final volume of the Canadian State Trials series examines political trials and national security measures during the period of 1939 to 1990. Essays by historians and legal scholars shed light on experiences during the Second World War and its immediate aftermath, including uses of the War Measures Act and the Official Secrets Act with the unfolding of the Cold War and legal responses to the FLQ (including the October Crisis), labour strikes, and Indigenous resistance and standoffs. The volume critically examines the historical and social context of the trials and measures resulting from these events, concluding the first comprehensive series on this important area of Canadian law and politics. The fifth volume’s exploration of state responses to real and perceived security threats is particularly timely as Canada faces new challenges to the established order ranging from Indigenous nations demanding a new constitutional framework to protestors challenging discriminatory policing and contesting public health measures. Book Synopsis Public Finance and Parliamentary Constitutionalism by : Will Bateman
Download or read book Public Finance and Parliamentary Constitutionalism written by Will Bateman and published by Cambridge University Press. This book was released on 2020-09-24 with total page 283 pages. Available in PDF, EPUB and Kindle. Book excerpt: Public Finance and Parliamentary Constitutionalism analyses constitutionalism and public finance (tax, expenditure, audit, sovereign borrowing and monetary finance) in Anglophone parliamentary systems of government. The book surveys the history of public finance law in the UK, its export throughout the British Empire, and its entrenchment in Commonwealth constitutions. It explains how modern constitutionalism was shaped by the financial impact of warfare, welfare-state programs and the growth of central banking. It then provides a case study analysis of the impact of economic conditions on governments' financial behaviour, focusing on the UK's and Australia's responses to the financial crisis, and the judiciary's position vis-à-vis the state's financial powers. Throughout, it questions orthodox accounts of financial constitutionalism (particularly the views of A. V. Dicey) and the democratic legitimacy of public finance. Currently ignored aspects of government behaviour are analysed in-depth, particularly the constitutional role of central banks and sovereign debt markets.
