Les discussions sur la capacité de l'économie à s'adapter au changement souffrent d'un manque de données sur l'ampleur des changements survenus dans le passé. L'étude présentée ici tente de combler cette lacune en permettant l'examen de trois ensembles distinct de mesures du changement et des liens existant entre eux. Le premier ensemble de mesures vise à déterminer l'ampleur des mutations de l'emploi d'une branche d'activité à l'autre. Le deuxième ensemble comprend des mesures de l'évolution de l'emploi permettant d'évaluer la croissance ou la diminution de l'emploi attribuable à des variations des niveaux de l'emploi chez les producteurs. Le troisième ensemble de mesures porte sur le nombre de départs de travailleurs. L'ampleur du changement survenue dépend du niveau auquel il est mesuré et de la période utilisée pour le faire. La variation est plus importante à court terme parce qu'elle comprend une composante transitoire qui se renverse à long terme. Quoi qu'il en soit, la variation à long terme demeure relativement importante. Lorsque le changement est évalué en fonction des emplois perdue dans les branches de la fabrication dont la situation s'est détériorée de 1970 à 1979, le degré de réaffectation s'avère relativement faible : perte de moins de 1 point chaque année pour une période de dix ans. En revanche, la croissance et la baisse de l'emploi au niveau des producteurs se rélèvant élevées, même à long terme. Au cours de la période allant de 1970-1971 à 1980-1981, environ 3.6% des emplois dans le secteur de la fabrication ont été perdus chaque année en raison du fléchissement affliché par les producteurs, ce qui représente un total cumulatif de près de 31% en rega rd des nivea relatives aux départs de travailleurs qui font ressortirs les plus fortes variations. De 1978 à 1986, chaque année, le nombre de départs définitifs correspondait à plus de 20% du nombre de personnes occupant un emploi dans le secteur de la fabrication.

This book presents papers from the 31st International Conference on Legal Knowledge and Information Systems (JURIX 2018), held in Groningen, the Netherlands, in December 2018. The support of the Dutch Foundation for Legal Knowledge Based Systems for the JURIX conference has transformed a domestic workshop into an international event, with theoretical contributions, applied work, demo prototypes, a hackathon, and a doctoral consortium. Of the 72 submissions received, 17 full papers and 11 short papers were selected for publication, representing an acceptance rate of approximately 38%. Machine learning for the legal domain prevails in the JURIX 2018 program, with traditional research mainstreams concerning legal reasoning and argumentation, natural-language processing, legal-text retrieval, and legal semantic modelling. An emerging topic is blockchain, which has graduated from the workshop area to the main program. La plupart des études antérieures se sont surtout intéressées à l'ampleur des déplacements des travailleurs d'une industrie à l'autre. Nous examinons plutôt ici la mesure dans laquelle l'emploi est redistribué entre les unités de production du secteur manufacturier canadien en raison du fait que certaines entreprises prospèrent et que d'autres régressent. Pour ce faire, nous étudions à la fois la variation de l'emploi liée à l'entrée et à la sortie d'entreprises et celle qui résulte de la croissance et du déclin des entreprises en place. La redistribution de l'emploi découle de la variation de la taille relative des entreprises dans une industrie par rapport à une autre et à l'intérieur d'une même industrie. Pour examiner la variation de l'emploi, nous nous attardons sur deux points en particulier. Nous évaluons d'abord l'ampleur de l'adaptation qu'a vécue l'économie par le passé. Ce faisant, nous obtenons un point de repère qui permettra de mesurer dans l'avenir les variations prévues engendrées par exemple par la libéralisation des échanges. Nous tentons ensuite de déterminer si le processus d'adaptation correspond à un modèle. À cet égard, nous examinons plusieurs questions. Y a-t-il un taux normal ou habituel de renouvellement des emplois? L'adaptation provient-elle principalement de la contraction (pertes d'emplois) ou de l'expansion (gains d'emplois) des entreprises? Comment la distinction entre ces deux causes varie-t-elle en temps de récession? Quelle est la différence entre le degré d'adaptation qui résulte de l'entrée ou de la sortie d'entreprises et le degré d'adaptation qui découle de la croissance ou du déclin des entreprises existantes? En quoi le processus diffère-t-il selon qu'on le considère à court ou à long terme? Enfin, nous nous servons des réponses à ces questions pour caractériser la nature du processus d'adaptation que l'on observe généralement dans le secteur manufacturier au Canada.

The acceleration of these flows poses new legal and political problems to their regulation and control, as shown by recent conflicts between Google and the European Union (EU). This book investigates the transnational constitutional dimension of recent conflicts between Google and the EU in the areas of competition, taxation and human rights. More than a simple case study, it explores how the new conflicts originating from the worldwide expansion of the Internet economy are being dealt with by the institutional mechanisms available at the European level. The analysis of these conflicts exposes the tensions and contradictions between, on the one hand, legal and political systems that are limited by territory, and, on the other hand, the inherently global functioning of the Internet. The EU’s promising initiatives to extend the protection of privacy in cyberspace set the stage for a broader dialogue on constitutional problems related to the enforcement of fundamental rights and the legitimate exercise of power that are common to different legal orders of world society. Nevertheless, the different ways of dealing with the competition and fiscal aspects of the conflicts with Google also indicate the same limits that are generally attributed to the very project of European integration, showing that the constitutionalization of the economy tends to outpace the constitutionalization of politics.
