Book excerpt: Provides a guide to the general principles of Scottish law relevant to construction contracts and the main provisions of the standard forms of construction contract used in Scotland including: the obligations of employers and contractors certification payment ending a construction contract remedies subcontracts collateral warranties insurance dispute resolution regulatory matters The new edition has been substantially updated and expanded to take account of the latest editions of the Scottish Standard Building Contracts and recent case law. Specific updates have been driven by the following changes to legislation and standard contracts Local Democracy Economic Development and Construction Act 2009 and the relative Scheme for Construction Contracts Arbitration (Scotland) Act 2010 Recognising the significant increase in use of NEC3 standard forms of contract, references to NEC3 provisions have been introduced throughout the relevant chapters so that each now covers the common law, the SBCC provisions and the NEC3 provisions. It also features new chapters on: litigation; competition; the Bribery Act 2010; and guarantees and bonds. From reviews of previous editions: ‘very approachable and readable... I would particularly recommend this book to non-legal construction professionals’ – Construction & Engineering Law ‘an informative textbook for the practitioner... [a] significant contribution to knowledge’ – Arbitration ‘a highly competent... textbook which would be of value for industry professionals with no legal background’ – Construction Law

Available in PDF, EPUB and Kindle. Book excerpt: This book covers the written record of Alberta's oil sands - the world's second-largest petroleum resource - from 1715 to the present day. The focus is on men and women who contributed to the enormous scientific and technological advances that enabled the oil sands sector to become a petroleum giant. Equally, it reviews recent developments that make much of the sector at best marginally economic. According to renowned petroleum historian Earle Gray, the book "is a powerful addition to the corpus of writing about Canada's petroleum industry. But it is more than history: it is an account of current challenges and visions of future possibilities. While he focuses on the vast oil deposits in the Alberta oil sands, he also sheds wide-ranging light on other aspects of the Canadian petroleum industry's history." The author "has weaved his story from an impressive array of diverse sources, as well as intensive and extensive research," Gray continues in his foreword. "The result is a must-read for anyone interested not only in the history of the Canada's oil business, but perhaps more importantly, Canada's economic history." The Petroleum History Society's Clint Tippett adds, in the Afterword, that "there are still major hurdles ahead if we are to truly fulfil the promise of the oil sands. Extracting the bitumen and upgrading it are intensive both in terms of energy use and of greenhouse gas generation. Transportation and market access continue to be challenges." "It remains to be seen whether the Canadian oil sands sector will be nimble enough to avoid becoming roadkill, or at least become significantly restricted," he says, "in either a fundamental economic sense or through the global controversy concerning greenhouse gases and global warming." Calgary-based economist Peter Findley, whom he cites, a different perspective. Although oil sands production growth "has been impressive and robust since 1999," he said, "it seems that the more production barrels that come online from the massive heavy oil basin, the more headwinds arise that operators must overcome to deliver a return to increasingly impatient investors." Operators had little to show from their investments, he said, "even before the oil price rout." In this bust a "lacklustre" job market elsewhere in Canada (except B.C.) contributed to Alberta's pain, added Todd Hirsch, another of several economists cited. In effect, individuals in the workforce voted with their feet...by going elsewhere. "The nasty recessions of the 1980s saw tens of thousands of people pack up and leave Alberta, resulting in a drop in the size of the work force," he said. "During the darkest days of 1987, the province saw more than 1.2 per cent of its workers leave or drop out of the labour market. This repeated itself during the recessions of 1992 and 2009-10." "One reason was that those earlier busts coincided with stronger economies elsewhere in Canada attracting the province's unemployed," the author says. "Alberta's pain this time around got no such assistance - indeed, new international immigration made matters worse. Unemployment reached 8.6 per cent, the highest since 1994. "Gradually, though, things got better. After touching US$26 per barrel in February 2016, West Texas oil prices doubled within a year. At this writing, the worst of the bust seems behind us."

Book excerpt: Breaking 170 years of secrecy, this intriguing exposÉ takes a behind-the-scenes look at Yale's mysterious society, the Order of the Skull and Bones, and its prominent members, numbering among them Tafts, Rockefellers, Pillsburys, and Bushes. Explored is how Skull and Bones initiates have become senators, judges, cabinet secretaries, spies, titans of finance and industry, and even U.S. presidents, including George W. Bush. This book reveals that far from being a campus fraternity, the society is more concerned with the success of its members in the postcollegiate world. Included are a verified membership list, rare reprints of original Order materials revealing the interlocking power centers dominated by Bonesmen, and a peek inside the Tomb, their 140-year-old private clubhouse.

Book excerpt: 'Madame...Sir...May we come in?' This was the prelude to some dreadful news in the Germonprez household. No parent should ever have to bury a child, especially not after a suicide. The chalk outline on the pavement is a constant reminder - even when it is no longer there. Linthout draws an almost tangible pain with his immediate, rudimentary art and strong script - combined with his own personal experience.

Book excerpt: College of the Ozarks, a small Work College nestled in the Ozark Mountains, has a patriotic goal and is taking a leadership role of filling in the gaps of American history by equipping future generations with the truth. Hopefully, this book will bridge the generation that fought the Vietnam War to the current generation, which has been taught little or nothing about the War and its meaning. As you will read, when students are taught the truth, they are willing to listen. In the case of the Vietnam War, there is no better way for today's generation of college students to understand this conflict than to travel to former battlefields with veterans who fought in these battles during their youth. Consequently, the country of Vietnam and the battle sites become a "classroom," and seeing them with veterans provides a "laboratory" for observations like no other. It is a generational bridge, connecting youth of today with Vietnam Veterans. This book depicts a course with a field trip. That is why it was written in an unusual style, common to what you might expect in a first-year "survey" class.
