Available in PDF, EPUB and Kindle. Book excerpt: All governments, in various ways, regulate and control nonprofit organizations. Nongovernmental organizations (NGOs), while hopeful of supportive regulatory environments, are simultaneously seeking greater autonomy both to provide services and to advocate for policy change. In part to counter increasing statutory regulation, there is a global nonprofit sector movement towards greater grassroots regulation - what the authors call self-regulation - through codes of conduct and self-accreditation processes. This book drills down to the country level to study both sides of this equation, examining how state regulation and nonprofit self-regulation affect each other and investigating the causal nature of this interaction. Exploring these issues from historical, cultural, political, and environmental perspectives, and in sixteen jurisdictions (Australia, China, Brazil, Ecuador, England and Wales, Ethiopia, Ireland, Israel, Kenya, Malawi, Mexico, Tanzania, Uganda, Scotland, United States, and Vietnam), the authors analyse the interplay between state control and nonprofit self-regulation to better understand broader emerging trends.

Abstract: Private non-enterprise institutions (PNIs, minban feiqiye danwei 民辦非企業單位 or minfei 民非), one of the three types of nonprofit organizations in China, mainly exist in a wide range of human service fields, e.g. education, health-care, and social welfare. Thus, PNIs are addressed as nonprofit human service organizations in this study. Despite their relatively short history, PNIs have grown dramatically in size and influence since the late 1990s. Today they constitute an integral and increasingly important part of the charitable sector in China. However, to date research into the legal and regulatory framework for PNIs has been limited. This study examines the legal and regulatory framework for PNIs in the broader context of China's ongoing charity law reform. In the wake of charity scandals in 2011, the past few years have seen a new wave of charity law reform in China, characterized by an accelerated process of drafting the long-awaited Charity Law. This vital piece of legislation is likely to bring the charitable sector of the country to a new stage of development where a more supportive legal environment can enable further development of this sector on the one hand, and more vigorous and effective oversight can restore public trust and confidence on the other. For charity law reform in China to succeed, a richer and deeper understanding is needed of the legal and regulatory framework for PNIs. This study presents a theoretical framework for the study of nonprofit human service organizations that is built on an integration of demand-side and supply-side theories, and uses it to examine the development of PNIs in post-1978 China. In particular, relying primarily on data analysis, this study reveals that the supply of nonprofit production of human services in China is still unable to meet the growing demand. Given this, PNIs are unlikely to have a comparative advantage over public agencies and private for-profit producers. This demand-supply mismatch, as this study makes clear, is due largely to the uncertainty surrounding the legal status of PNIs. In view of the extraordinary challenges facing the development of PNIs, this study explores some suggested directions toward improving the legal and regulatory framework for PNIs against the backdrop of charity law reform in China. First, based on a comparative analysis of civil law and common law approaches to recognizing nonprofit organizations, as well as case studies, this study highlights the need to clarify and recognize the nonprofit and charitable status as well as tax-exempt status of PNIs, and investigates the present state and future development of relevant issues. Second, this study looks closely at the means by which greater accountability and transparency of PNIs can be achieved, aiming to prevent abuse of this legal status. Bearing in mind the regulatory challenges posed by the emergence of multiple-entity groups (or "social enterprise groups") in the third sector in China, this study analyzes and proposes regulatory oversight mechanisms that should be put in place as charity law reform goes forward. Book Synopsis Policing the Good Guys by : Terri Lynn Helge

Book excerpt: Recently, public confidence in the charitable sector has eroded due to a barrage of media reports on scandals and abuses. The principal parties charged with regulation of the charitable sector, the Internal Revenue Service and state attorneys general, are saddled with bureaucratic constraints that make it difficult to enforce the laws governing the fiduciary responsibilities of charity managers. Substantial reform in the regulation of charitable organizations is necessary to curb the reported abuses that have undermined confidence in the charitable sector. Some advocate expanding private regulation of the charitable sector to improve enforcement of the fiduciary responsibilities of charitable managers. While some of these private regulatory alternatives have had success in isolated situations, none are satisfactory in providing comprehensive and effective oversight of the charitable sector. Overall, the policies underlying oversight of charitable organizations support maintaining primary responsibility for their regulation in a centralized authority. However, the financial, political, institutional, and agency constraints imposed on the Internal Revenue Service and state attorneys general make them unlikely to implement enough internal reform to be an ongoing, effective enforcement presence in the charitable sector. This Article advocates the creation of a new, federal, quasi-public agency that would be the principal regulator of the charitable sector. The new agency would be a self-funded, independent, and proactive regulator that would serve the dual purposes of curbing the abuses that have eroded public confidence in the sector and educating charity managers of their obligation to be responsible stewards of charitable resources. The proposed agency would be primarily responsible for enforcing federal tax laws aimed at influencing fiduciary behavior of charity managers and preserving charitable assets for public benefit. Its formation, therefore, would separate oversight of charity governance from the tax collection function, thus harmonizing the United States with other countries that have established independent charity oversight agencies.
Book Synopsis Regulating Charities by : Myles McGregor-Lowndes
Download or read book Regulating Charities written by Myles McGregor-Lowndes and published by Taylor & Francis. This book was released on 2017-04-07 with total page 317 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this volume charity commissioners and leading charity policy reformers from across the world reflect on the aims and objectives of charity regulation and what it has achieved. Regulating Charities represents an insider’s review of the last quarter century of charity law policy and an insight for its future development. Charity Commissioners and nonprofit regulatory agency heads chart the nature of charity law reforms that they have implemented, with a ‘warts and all’ analysis. They are joined by influential sector reformers who assess the outcomes of their policy agitation. All reflect on the current state of charities in a fiscally restrained environment, often with conservative governments, and offer their views on productive regulatory paths available for the future. This topical collection brings together major charity regulation actors, and will be of great interest to anyone concerned with contemporary third sector policy-making, public administration and civil society.

This book was released on 2013-12-04 with total page 52 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Charity Commission is not regulating charities effectively and there is a gap between what the public expects of the Commission and what it actually does. The NAO has concluded that the Commission does not do enough to identify and tackle abuse of charitable status. Between 2007-08 and 2013-14, the Commission's annual budget fell 40 per cent in real terms to £22.7 million but the number of main registered charities has remained fairly constant at around 160,000. In response to budget cuts, the Commission has reviewed how it works and successfully reduced demand for its services, but it has not identified what budget it would need to regulate effectively. The Commission makes little use of its enforcement powers, for example suspending only two trustees and removing none in 2012-13. And it can be slow to act when investigating regulatory concerns. The NAO found cases where periods of several months passed during which the Commission took no action. Furthermore, the Charity Commission does not take tough enough action in some of the most serious regulatory cases. It is also reactive rather than proactive, making insufficient use of the information it holds to identify risk. The Charity Commission needs to think radically about alternative ways of meeting its objectives with constrained resources. It also needs to make greater use of its statutory powers in line with its objective of maintaining confidence in the sector; and develop an approach to identify and deal with those few trustees who deliberately abuse charitable status. This report publishes alongside another NAO report, the Cup Trust.

Available in PDF, EPUB and Kindle. Book excerpt: The Politics of Charity examines the contemporary political role played by charity, as legally defined, in the developed democratic nations. It considers how this has come about, why it is now significant, what it is that is integral to the content and role of ‘charity’ that allows it to hold such a pivotal political position and why this would seem to be non-transferable to undemocratic nations. It also identifies and assesses the political relevance of different types of charitable activity.

Download or read book The Profits of Charity written by Kerry O'Halloran and published by Oxford University Press. This book was released on 2012-09-24 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The Profits of Charity examines the contemporary law governing the involvement of charity in commerce, explores the reasons why this involvement is dramatically changing and considers the resulting implications for charities and the nonprofit sector. From a perspective familiar to charity lawyers, NGO managers, and scholars, Kerry O'Halloran identifies the concepts and the law underpinning charities and their profits by tracing legal developments in the field and identifying the resulting opportunities and challenges for the future. At a time when many leading nations are confronting economic recession, the threat of terrorism, and the retreat of the 'welfare state,' this book explores how and why governments are now turning to charities in their quest to cultivate social capital, consolidate civil society, and promote civic engagement. In The Profits of Charity, Professor O'Halloran undertakes a comparative analysis of the balance struck between government, charity, and commerce in the EU and leading common law nations, including the United States, Canada, England and Wales, New Zealand, and Australia. He uses analysis of legislation, outcomes of charity law reviews, and recent case law to illustrate jurisdictional differences, and concludes with an assessment of the extent and significance of the recalibrated relationships and considers the overarching issues that arise for charity law and social policy.

Available in PDF, EPUB and Kindle. Book excerpt: Over the past three decades or so, the nonprofit, voluntary, or third sector has undergone a major transformation from a small cottage industry to a major economic force in virtually every part of the developed world as well as elsewhere around the globe. Nonprofit organizations are now major providers of public services working in close cooperation with governments at all levels and increasingly find themselves in competition with commercial firms across various social marketplaces. This transformation has come with ever-increasing demands for enhancing the organizational capacities and professionalizing the management of nonprofit institutions. The Routledge Companion to Nonprofit Management is the first internationally focused effort to capture the full breadth of current nonprofit management research and knowledge that has arisen in response to these developments. With newly commissioned contributions from an international set of scholars at the forefront of nonprofit management research, this volume provides a thorough overview of the most current management thinking in this field. It contextualizes nonprofit management globally, provides an extensive introduction to key management functions, core revenue sources and the emerging social enterprise space, and raises a number of emerging topics and issues that will shape nonprofit management in future decades. As graduate programs continue to evolve to serve the training needs in the field, The Routledge Companion to Nonprofit Management is an essential reference and resource for graduate students, researchers, and practitioners interested in a deeper understanding of the operation of the nonprofit sector.

Book excerpt: Among the issues confronting America is long-term care for frail, older persons and others with chronic conditions and functional limitations that limit their ability to care for themselves. Improving the Quality of Long-Term Care takes a comprehensive look at the quality of care and quality of life in long-term care, including nursing homes, home health agencies, residential care facilities, family members and a variety of others. This book describes the current state of long-term care, identifying problem areas and offering recommendations for federal and state policymakers. Who uses long-term care? How have the characteristics of this population changed over time? What paths do people follow in long term care? The committee provides the latest information on these and other key questions. This book explores strengths and limitations of available data and research literature especially for settings other than nursing homes, on methods to measure, oversee, and improve the quality of long-term care. The committee makes recommendations on setting and enforcing standards of care, strengthening the caregiving workforce, reimbursement issues, and expanding the knowledge base to guide organizational and individual caregivers in improving the quality of care.
