Available in PDF, EPUB and Kindle. Book excerpt: In the late eighties and early nineties, driven by the post–Cold War environment and lessons learned during military operations, United States policy makers made intelligence support to the military the Intelligence Community's top priority. In response to this demand, the CIA and DoD instituted policy and organizational changes that altered their relationship with one another. While debates over the future of the Intelligence Community were occurring on Capitol Hill, the CIA and DoD were expanding their relationship in peacekeeping and nation-building operations in Somalia and the Balkans. By the late 1990s, some policy makers and national security professionals became concerned that intelligence support to military operations had gone too far. In Subordinating Intelligence: The DoD/CIA Post–Cold War Relationship, David P. Oakley reveals that, despite these concerns, no major changes to national intelligence or its priorities were implemented. These concerns were forgotten after 9/11, as the United States fought two wars and policy makers increasingly focused on tactical and operational actions. As policy makers became fixated with terrorism and the United States fought in Iraq and Afghanistan, the CIA directed a significant amount of its resources toward global counterterrorism efforts and in support of military operations.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines how U.S. domestic institutions stand up to global threats and whether intelligence sharing across military and civilian law enforcement barriers is legal. The U.S. Constitution is designed to distribute power in order to prevent its concentration, and in particular, it draws clear lines between the responsibilities of the military and those of civilian law enforcement. But the new global threat paradigm, requiring responses both abroad and at home, calls out for military and civilian intelligence gathering to work in tandem. The Civil-Military Divide: Obstacles to the Integration of Intelligence in the United States looks at historic and legal ramifications of such efforts. Louise Stanton's thought-provoking work sums up the current state of U.S. intelligence gathering at all levels of government. It then looks at the range of recommendations for overhauling our intelligence efforts in the context of the U.S. Constitution to assess what may or may not be constitutionally supportable. At issue are three long-established, often reaffirmed principles: the separation of powers, the federalist system that gives the U.S. government precedence over states, and the separation of the civilian and military sectors.

Available in PDF, EPUB and Kindle. Book excerpt: When crisis requires American troops to deploy on American soil, the country depends on a rich and evolving body of law to establish clear lines of authority, safeguard civil liberties, and protect its democratic institutions and traditions. Since the attacks of 9/11, the governing law has changed rapidly even as domestic threats—from terror attacks, extreme weather, and pandemics—mount. Soldiers on the Home Front is the first book to systematically analyze the domestic role of the military as it is shaped by law, surveying America’s history of judicial decisions, constitutional provisions, statutes, regulations, military orders, and martial law to ask what we must learn and do before the next crisis. America’s military is uniquely able to save lives and restore order in situations that overwhelm civilian institutions. Yet the U.S. military has also been called in for more coercive duties at home: breaking strikes, quelling riots, and enforcing federal laws in the face of state resistance. It has spied on and overseen the imprisonment of American citizens during wars, Red scares, and other emergencies. And while the fears of the Republic’s founders that a strong army could undermine democracy have not been realized, history is replete with reasons for concern. At a time when the military’s domestic footprint is expanding, Banks and Dycus offer a thorough analysis of the relevant law and history to challenge all the stakeholders—within and outside the military—to critically assess the past in order to establish best practices for the crises to come.

Book excerpt: After the September 11 attacks, the 9/11 Commission argued that the United States needed a powerful leader, a spymaster, to forge the scattered intelligence bureaucracies into a singular enterprise to vanquish AmericaÆs new enemiesùstateless international terrorists. In the midst of the 2004 presidential election, Congress and the president remade the postûWorld War II national security infrastructure in less than five months, creating the Office of the Director of National Intelligence (DNI) and a National Counterterrorism Center (NCTC). Blinking Red illuminates the complicated history of the bureaucratic efforts to reform AmericaÆs national security after the intelligence failures of 9/11 and IraqÆs missing weapons of mass destruction, explaining how the NSC and Congress shaped the U.S. response to the 9/11 attacks. Michael Allen asserts that the process of creating the DNI position and the NCTC is a case study in power politics and institutional reform. By bringing to light the legislative transactions and political wrangling during the reform of the intelligence community, Allen helps us understand why the effectiveness of these institutional changes is still in question.

Book excerpt: The National Security Council (NSC) is the locus of strategic policy planning for the United States, as it serves as the statutory strategic coordinating cell for the President. With the recent shift toward great power competition, consideration must be given to how the military and interagency integrate into policy at the strategic and operational levels of war. This study seeks to examine how the United States conducts strategic planning to understand the implications for the U.S. effort in preparing for great power conflict and large scale combat operations.Recommendations from this study include making structural improvements in the NSC system that establish the importance of strategic planning, policy evaluation, and talent management. To accomplish this, both legislative and executive measures should be implemented to support progressive change. The study concludes by offering that synchronizing strategy across the interagency is a complex problem with no perfect solution. Instead, incremental changes should be made to improve the system with continued study focused on refining the process given a changing environment. This compilation also includes a reproduction of the 2019 Worldwide Threat Assessment of the U.S. Intelligence Community.1. The 2018 U.S. National Defense Strategy (NDS) states that "a long-term strategic competition requires the seamless integration of multiple elements of national power-diplomacy, information, economics, finance, intelligence, law enforcement, and military."
