Book excerpt: This chapter discusses principles and consequences of the common agricultural policy (CAP) of the European Community (EC). It shows that agricultural pricing policies aimed at supporting farm incomes were already in place in EC member countries before the inception of the CAP; indeed, in the presence of these policies, the CAP was a logical consequence of the extension of the common market to the agricultural sector. Thus, the flaws of the CAP can be traced back to national policies and attitudes toward agriculture. Recognition of the burden of agricultural support on the rest of the economy, as well as the growing budgetary costs, has elicited a greater public interest in the CAP. Equally, the trade frictions caused by export subsidies have underlined the CAP's international implications. For these reasons, the member states appear more determined than hitherto to bring agricultural expenditure under control. Given the wider effects of the CAP both on EC economies and the international community, it is to be hoped that current efforts at reform will be successful.

Durch die Öffnung der nationalen Märkte sahen und sehen sich die Staaten und ihre heimischen Unternehmen einem steigenden Wettbewerbsdruck gegenüber, den sie mitunter mit unrechtmäßigen Mitteln zu unterlaufen versuchen: Wettbewerbsbeschränkende Absprachen zwischen Unternehmen auf der einen Seite und staatliche Maßnahmen auf der anderen Seite vermögen den Wettbewerb gleichermaßen zu beeinflussen. Um die kompetitiven Marktstrukturen aufrechtzuerhalten, bedient sich die EU daher zweier Instrumente: Während die im Jahre 1990 erlassene europäische Fusionskontrollverordnung Wettbewerbsverfälschungen auf Unternehmensebene effektiv entgegenzuwirken versucht, regelt und überwacht die Beihilfenkontrolle die Beihilfenvergabe durch die Mitgliedstaaten. Einführend wird in Kapitel 2 zunächst der zentrale Gegenstand der Beihilfenkontrolle - sprich die Beihilfe - genauer betrachtet, bevor in gebotener Kürze ein Überblick über mögliche Vor-und Nachteile der Vergabe gegeben wird. Gegenstand des dritten Kapitels ist die Beihilfenkontrolle durch die Europäische Kommission. Zunächst werden die Zielsetzungen sowie die Kriterien für die Rechtmäßigkeit einer Beihilfe dargestellt. Daraufhin sollen kurz das Verfahren der Beihilfenkontrolle sowie die rechtlichen Schranken skizziert werden, wobei weniger einzelne Details besprochen als vielmehr die Grundzüge aufgezeigt werden. In Kapitel 4 erfolgt eine kritische Betrachtung der Beihilfenkontrolle und ihrer wichtigsten Problemfelder. Dabei werden zunächst die Überlastung der Kommission sowie die unzureichende Transparenz sowohl auf Seiten der Mitgliedstaaten als auch auf Seiten der Kommission betrachtet. Anschließend wird die Dimension politischer Zielkonflikte dargestellt, wobei auch ein kurzer Blick auf politökonomische Aspekte erfolgt. It’s a prevalent topic which not every citizen is fully aware of and whose effects should be examined more in detail. Agriculture has many important needs to satisfy in the population and to ensure a wide range of social tasks: food production, production of biomass for power generation and material use, design and maintenance of cultural landscapes and biotopes, determination of animal welfare or the impact on social and economic structures. In order to promote these societal tasks of agriculture, the politics should set the framework in such a way that the economic activity of the farmers fulfills common welfare purposes at the same time. This is done by specifying duties as well as by creating incentives. In this regard the CAP of the European Union (=EU) has a great influence. In this context the time has come again for the EU commission to set the Multiannual Financial Framework (=MFF) for the period from 2021 to 2027. One of the biggest expenditures with about 54 billion euros a year is the CAP which is nowadays hardly criticised for promoting poverty and food security in developing countries through European subsidies. Interventions related to the agricultural policy cause a dilemma due to the fundamental conflict of interest between producers and consumers. On the one hand, the abolishment of the CAP apparently does not have a lot of negative consequences – according to the Joint Research Centre of the European commission the consequential decline of the agricultural production would be insignificant. On the other hand, the CAP does not have a lot of effects that harm its development, but a danger is prevalent that it might fall back into old patterns by e.g. using payments coupled to the production.

The objective is to analyse the current system and the proposals made by the Commission in January 2003 regarding a decoupling of these payments. The Common Agricultural Policy was one of the first policies developed in the European Union, and one of those regulated in the greatest detail. Among the European Union's policies, the CAP is regarded as one of the most important policy areas. This is justified not only because of its share of the EU budget, the vast number of people and the extent of the territory directly affected, but also because of its symbolic significance and the extent of sovereignty transferred from the national to the European level. The significance of the CAP, nowadays, is also portrayed by the fact that it is directly related to the Single Market and the EMU, two key areas in achieving the European integration. The objective of the CAP was to support the agricultural sector in the Member States. The second chapter of this thesis will provide general legal background information on the institutions of the EU and the functioning of the decision-making processes with regards to the agricultural sector. The history of the CAP, it s functioning, the reasons for its creation and some general information will be outlined in chapter 3. Special emphasis will be on the common market organisations, the second pillar of the CAP, the rural development policy and the system of Direct Payments. The history will also cover the Agenda 2000, the Mid-term review and especially the latest reform proposals of the EU in January 2003. The proposals with regard to the Direct Payments, such as the decoupling and the modulation, will be subject to a closer analysis in chapter 7. The chapter 4 covers the EU enlargement and gives an overview of the new challenges arising by that for the EU. Even though the consequences of the enlargement are significant in some areas of the CAP, this thesis will not provide a closer analysis of all the dimensions. The topic of the EU enlargement itself is too extensive to be covered by a single chapter. Predominantly rural regions, where agriculture remains particularly important, contain almost one quarter of the population of OECD countries. Although total support remains high, a shift has taken place from price-linked measures to direct income support, most notably in the European Union. Policies have been adapted to meet pressing social concerns, such as ens- ing food security and improving environmental quality. The EU's common agricultural policy (CAP) has often been the source of conflict between the EU and its trade partners within first the GATT, and then the WTO. In the Doha Round agriculture was again a sticking point, resulting in setbacks and delays. The position of the EU is pivotal. Due to the comparatively limited competitiveness of the EU's agricultural sector, and the EU's institutionally constrained ability to undertake CAP reform, the CAP sets limits for agricultural trade liberalization blocking progress across the full compass of the WTO agenda. Therefore, the farm trade negotiation, with the CAP at its core, is the key to understanding the dynamics of trade rounds in the WTO. The book, written by a political scientist and an agricultural economist, applies theory on ideas to explain how the agricultural sector came to be included in the Single Undertaking that resulted in the Uruguay Round agreements, and how this led to a dynamic interplay between CAP reform and the possibility of further agricultural trade liberalization within the WTO, thereby providing useful insights into international trade relations.
