But in fact, the United States is the only major democratic nation in which the less well-off, the young, and minorities are substantially underrepresented in the electorate. Frances Fox Piven and Richard A. Cloward were key players in the long battle to reform voter registration laws that finally resulted in the National Voter Registration Act of 1993 (also known as the Motor Voter law). When Why Americans Don't Vote was first published in 1988, this battle was still raging, and their book was a fiery salvo. It demonstrated that the twentieth century had witnessed a concerted effort to restrict voting by immigrants and blacks through a combination of poll taxes, literacy tests, and unwieldy voter registration requirements. Why Americans Still Don't Vote brings the story up to the present. Analyzing the results of voter registration reform, and drawing compelling historical parallels, Piven and Cloward reveal why neither of the major parties has tried to appeal to the interests of the newly registered-and thus why Americans still don't vote.

In a country marked by arbitrary and exclusionary electoral practices, minority political participation is central to remedying the inequity of the electoral process. The 1993 National Voter Registration act (NVRA) was enacted to compensate for past exclusionary electoral practices and was designed to equalize the political playing field so that disenfranchised groups could achieve parity. The author contends that, as a result, Latino communities are in a unique position to seize political clout. First, the growing numbers of Latino families in strategic electoral states are a significant proportion of the states' population. Second, the young Latino segment is in search of community reassurance. Third, the ever-increasing non-citizen population is demanding the political resources become a voice for Latino community interests. Morgan Kousser criticizes the Court's "postmodern equal protection" and demonstrates that legislative and judicial history still matter for public policy. Offering an original interpretation of the failure of the First Reconstruction (after the Civil War) by comparing it with the relative success of the Second (after World War II), Kousser argues that institutions and institutional rules--not customs, ideas, attitudes, culture, or individual behavior--have been the primary forces shaping American race relations throughout the country's history. Using detailed case studies of redistricting decisions and the tailoring of electoral laws from Los Angeles to the Deep South, he documents how such rules were designed to discriminate against African Americans and Latinos. Kousser contends that far from being colorblind, Shaw v. Reno (1993) and subsequent "racial gerrymandering" decisions of the Supreme Court are intensely color-conscious. Far from being conservative, he argues, the five majority justices and their academic supporters are unreconstructed radicals who twist history and ignore current realities. A more balanced view of that history, he insists, dictates a reversal of Shaw and a return to the promise of both Reconstructions.

Book excerpt: The Politics of Voter Suppression arrives in time to assess actual practices at the polls this fall and to reengage with debates about voter suppression tactics such as requiring specific forms of identification. Tova Andrea Wang examines the history of how U.S. election reforms have been manipulated for partisan advantage and establishes a new framework for analyzing current laws and policies. The tactics that have been employed to suppress voting in recent elections are not novel, she finds, but rather build upon the strategies used by a variety of actors going back nearly a century and a half. This continuity, along with the shift to a Republican domination of voter suppression efforts for the past fifty years, should inform what we think about reform policy today. Wang argues that activities that suppress voting are almost always illegitimate, while reforms that increase participation are nearly always legitimate. In short, use and abuse of election laws and policies to suppress votes has obvious detrimental impacts on democracy itself. Such activities are also harmful because of their direct impacts on actual election outcomes. Wang regards as beneficial any legal effort to increase the number of Americans involved in the electoral system. This includes efforts that are focused on improving voter turnout among certain populations typically regarded as supporting one party, as long as the methods and means for boosting participation are open to all. Wang identifies and describes a number of specific legitimate and positive reforms that will increase voter turnout.

Drawing on a wealth of data from the U.S. Census Bureau's Current Population Survey and the American National Election Studies, Jan Leighley and Jonathan Nagler demonstrate that the rich have consistently voted more than the poor for the past four decades, and that voters are substantially more conservative in their economic views than nonvoters. They find that women are now more likely to vote than men, that the gap in voting rates between blacks and whites has largely disappeared, and that older Americans continue to vote more than younger Americans.
