Available in PDF, EPUB and Kindle.

Book excerpt: This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.

Book excerpt: Community and participation have become central concepts in the nomination processes surrounding heritage, intersecting time and again with questions of territory. In this volume, anthropologists and legal scholars from France, Germany, Italy and the USA take up questions arising from these intertwined concerns from diverse perspectives: How and by whom were these concepts interpreted and re-interpreted, and what effects did they bring forth in their implementation? What impact was wielded by these terms, and what kinds of discursive formations did they bring forth? How do actors from local to national levels interpret these new components of the heritage regime, and how do actors within heritage-granting national and international bodies work it into their cultural and political agency? What is the role of experts and expertise, and when is scholarly knowledge expertise and when is it partisan? How do bureaucratic institutions translate the imperative of participation into concrete practices? Case studies from within and without the UNESCO matrix combine with essays probing larger concerns generated by the valuation and valorization of culture.

Available in PDF, EPUB and Kindle. Book excerpt: Jean-Loup Amselle explores the issue of multiculturalism by delving into the history of France's confrontation with ethnic difference. Amselle analyzes France's relationship to Egypt, Algeria, and Senegal to show how ideas about difference and assimilation played out in French colonial policies and how these same tensions continue to be problematic as France grapples with cultural pluralism.Amselle's book has timely and wide-ranging implications. Arguing against the "liberal communitarian state" as it exists in the United States, Amselle contends that an overemphasis on difference can lead to what he calls "affirmative exclusion"--the flip side of affirmative action. The recognition of a multiplicity of ethnic groups in France, he asserts, creates an environment that fosters racism. "Despite an outward appearance of generosity, supporters of French-style multiculturalism, by promoting 'affirmative action, ' run the risk of creating as many difficulties as there are 'target groups, ' which they have helped identify and hence produce."Calling on theories of racial difference devised by early anthropologists--most notably, Louis Faidherbe--and on the work of political philosophers such as Thomas Hobbes, John Locke, and Jean-Jacques Rousseau, Amselle makes historical and sociological sense of the debates over multiculturalism and the violence they engender. Toward a French Multiculturalism proposes directions for the future.

This book was released on 2014-01-01 with total page 58 pages. Available in PDF, EPUB and Kindle. Book excerpt: The linguistic integration of migrants affects every aspect of settling in a new country (employment, health, etc.). The aim of this collection of texts is to propose a number of specific measures member states can take to help adult migrants become acquainted with the language of the host country. The main focus is on organising language courses that meet migrants’ real communication needs. It is not enough for authorities simply to consider the technical aspects of such courses, they should also design and conduct them in accordance with the fundamental values of the Council of Europe. A number of issues concerning the linguistic integration of adult migrants are presented here, beginning with the notion of linguistic integration itself. Family reunion, the nature of citizenship and the function of language tests, among others, are dealt with from the point of view of language and language use. Readers are invited to reflect on the type of language competences that need to be acquired as well as an appropriate use of the Common European Framework of Reference for Languages. The collection also sets out approaches and instruments designed to assist in implementing effective policies.

Available in PDF, EPUB and Kindle. Book excerpt: Deconstructing the Nation examines the connection between racism and the development of the nation-state in modern France. The author raises important questions about the nature of citizenship rights in modern French society and contributes to wider European debates on citizenship. By challenging the myths of the modern French nation Maxim Silverman opens up the debate on questions of immigration, racism, the nation and citizenship in France to non-French speaking readers. Until quite recently these matters have largely been ignored by researchers in Britain and the USA. However, European integration has made it essential to look beyond national frontiers. The major part of his analysis concerns the period from the end of the 1960s to the beginning of the 1990s. Yet contemporary developments are placed in a historical context: first through a consideration of the construction of the modern question of immigration since the second half of the nineteenth century, and second through a survey of political, economic and social developments since 1945. There are analyses of the major debates on nationality in 1987 and the headscarf' affair of 1989. Finally questions of immigration, racism and citizenship are considered within the framework of European integration.

Available in PDF, EPUB and Kindle. Book excerpt: Some 20 years after writing The Technological Society, Jacques Ellul realized how the totalistic dimensions of our modern technological milieu required an additional treatment of the topic. Writing amidst the rise of books in the 1970s on pollution, over-population, and environmental degradation, Ellul found it necessary, once again, to write about the global presence of technology and its far-reaching effects. The Technological System represents a new stage in Ellul’s research. Previously he studied technological society as such; in this book he approaches the topic from a systems perspective wherein he identifies the characteristics of technological phenomena and technological progress in light of system theory. This leads to an entirely new approach to what constitutes the most important event of our society which has decisive bearing on the future of our world. Ellul’s analysis touches on all aspects of modern life, not just those of a scientific or technological order. In the end, readers are compelled to formulate their own opinions and make their own decisions regarding the way a technique-based value system affects every level of human life.
