The playhouses of London in the 1590s provided a distinctive forum for discourse and dissemination of nascent political ideas. Shakespeare exploited the unique capacity of theatre to humanise contemporary debate concerning the powers of the crown and the extent to which these were limited by law. The autonomous subject of law is represented in the plays considered here as a sentient political being whose natural rights and liberties found an analogue in the narratives of common law, as recorded in juristic texts and law reports of the early modern era. Each chapter reflects a particular aspect of constitutional development in the late-Elizabethan state. These include abuse of the royal prerogative by the crown and its agents; the emergence of a politicised middle class citizenry, empowered by the ascendancy of contract law; the limitations imposed by the courts on the lawful extent of divinely ordained kingship; the natural and rational authority of unwritten lex terrae; the poetic imagination of the judiciary and its role in shaping the constitution; and the fusion of temporal and spiritual jurisdiction in the person of the monarch. The book advances original insights into the complex and agonistic relationship between theatre, politics, and law. The plays discussed offer persuasive images both of the crown's absolutist tendencies and of alternative polities predicated upon classical and humanist principles of justice, equity, and community. The book first looks at contemporary performances that foreground the doubleness of the actor’s body, particularly through cross-dressing. It then examines narratives of Shakespearean rehearsal—both fictional representations of rehearsal in film and video, and eye-witness narratives of actual rehearsals—and how they show us the process by which the actor does or does not “become” the character. And, finally, it looks at modern performances that “frame” Shakespeare’s play as a play-within-a-play, showing the audience both the character in the Shakespeare play-within and the actor in the frame-play acting that character.

Book excerpt: Modern biographies of William Shakespeare abound; however, close scrutiny of the surviving records clearly show that there is insufficient material for a cradle to grave account of his life, that most of what is written about him cannot be verified from primary sources, and that Shakespearean biography did not attain scholarly or academic respectability until long after Samuel Schoenbaum published William Shakespeare A Documentary Life in 1975. This study begins with a short survey of the history and practice of biography and then surveys the very limited biographical material for Shakespeare. Although Shakespeare gradually attained the status as a national hero during the seventeenth and eighteenth centuries, there were no serious attempts to reconstruct his life. Any attempt at an account of his life or personality amounts, however, merely to "biografiction". Modern biographers differ sharply on Shakespeare’s apparent relationships with Southampton and with Jonson, which merely underlines the fact that the documentary record has to be greatly expanded through contextual description and speculation in order to appear like a Life of Shakespeare.

Most scholars agree that reading a printed play is a means of dramatic realization absolutely unlike live performance, but everything else beyond this premise is contestable: how much authority to assign to playwrights, the extent to which texts and readings determine performance, and the capability of printed plays to communicate the possibilities of performance. Without denying that printed plays distort and fragment performance practice, this book negotiates an intractable debate by shifting attention to the ways in which these inevitable distortions can nevertheless enrich a reader's awareness of a play's performance potentialities. As author J. Gavin Paul demonstrates, printed plays can be more meaningfully engaged with actual performance than is typically assumed, via specific editorial principles and strategies.
