The appearance of Langdell's Select Cases as a substitute for Parsons on Contracts, at Harvard Law School, in the year 1871, and the subsequent abolition on text-books from their curriculum by the law faculty or that great university, marked a conspicuous departure from pre-existing methods of legal instruction, and gave impetus to an exchange of views among those interested in education which has continued with increased earnestness. By the old method, the student is expected to acquire a knowledge of the elements of the law by memorizing the pages of a general treatise, which, in the estimate and according to the views of its author, contains a compendium of the whole body of law upon the given subject. By the other method, the student is made acquainted with original sources of legal authority; namely, leading decisions and opinions by the courts upon the given subject, together with the precise statement of facts upon which the opinion in each case is based, substantially as recorded in the official reports. These selected cases, edited, arranged, and printed in a book for this purpose, are put into the hands of the class, and are made the subject not only of study and recitation, but also of a free discussion in the class-room under guidance of an instructor, with a view to evolving, illustrating, and emphasizing the important principles established by them, and also other analogous and closely allied principles which may at the same time be conveniently considered. Book excerpt: Excerpt from Cases on the Law of Insurance: Selected From Decisions of English and American Courts For years past the science of law has been taught by lectures, the use of text-books and more recently by the detailed study, in the class-room, of selected cases. Each method has its advocates, but it is generally agreed that the lecture system should be discarded because in it the lecturer does the work and the student is either a willing receptacle or offers a passive resistance. It is not too much to say that the lecture system is doomed. Instruction by the means of text-books as a supplement or substitute for the formal lecture has made its formal entry into the educational world and obtains widely; but the system is faulty and must pass away as the exclusive means of studying and teaching law. It is an improvement on the formal lecture in that the student works, but if it cannot be said that he works to no purpose, it is a fact that he works from the wrong end. The rule is learned without the reason, or both rule and reason are stated in the abstract as the resultant rather than as the process. If we forget the rule we cannot solve the problem; if we have learned to solve the problem it is a simple matter to formulate a rule of our own. The text-book method may strengthen the memory; it may not train the mind, nor does it necessarily strengthen it. A text, if it be short, is at best a summary, and a summary presupposes previous knowledge. If, however, law be considered as a science rather than a collection of arbitrary rules and regulations, it follows that it should be studied as a science. Thus to state the problem is to solve it; the laboratory method has displaced the lecture, and the text yields to the actual experiment. The law reports are in more senses than one books of experiments, and, by studying the actual case, the student co-operates with the judge and works out the conclusion however complicated the facts or the principles involved. A study of cases arranged historically develops the knowledge of the law, and each case is seen to be not an isolated fact but a necessary link in the chain of development. The study of the case is clearly the most practical method, for the student already does in his undergraduate days what he must do all his life; it is curiously the most theoretical and the most practical. As an aid to an interesting discussion and profitable development of certain doctrines, a case on either side of the border line is reproduced. In Part I general principles are considered; and, in Part II, the more significant clauses of the policies, in the sequence in which they occur in the several instruments. Definitions, explanations, subsidiary points, numerous condensed cases and citations of selected authorities to date are given in finer print. Some such supplementary treatment by way of amplification or explanation is almost a necessity. Many of the decisions in insurance law are highly exceptional or arbitrary in their character. A few cases, culled here and there from thirty thousand, if unqualified, are too apt to be occasions of stumbling as well as of support. We are satisfied to train our students to reason, provided only they reason in terms of sound law. Otherwise they must fall short of attaining success in their professional career. If the class is to study the case of Home Mutual Ins. Co. v. Tompkies, or similar ruling, they must also compare with it the case of Brighton Beach Racing Assn. 1. Home Ins.
