The conference was jointly organised by the German Federal Ministry of Finance, the Centre for European Economic Research (ZEW), Mannheim, and the Max Planck Institute (MPI) for Intellectual Property, Competition and Tax Law, Munich. More than 250 participants from all over Europe and other regions, scholars, politicians, business people and tax administrators, discussed the Eu- pean Commission’s proposal to establish a CCCTB. Three panels of tax experts evaluated the common tax base with respect to structural elements, consolidation, allocation, international aspects and administration. The conference made clear that the CCCTB has the potential to overcome some of the most intriguing problems of corporate income taxation within the Common Market. Common tax accounting rules substantially reduce compliance and administrative costs. Consolidation of a group’s profits and losses effects cro- border loss compensation which removes a major tax obstacle for European cro- border investment. At the same time, tax planning with respect to financing and transfer pricing is pushed back within the European Union. Moreover, as far as the CCCTB applies, member states are able to remove tax provisions that are targeted at cross border tax evasion and that might be challenged by the jurisdiction of the Eu- pean Court of Justice.

Als Ausschüttungsbemessungsgrundlage sowie für die steuerliche Gewinnermittlung haben jedoch alle Unternehmen weiterhin einen Einzelabschluss nach den Regelungen des HGB zu erstellen. Der Anteil kapitalmarktorientierter Unternehmen, die unter diesen Pflichtanwendungsbereich der IAS-Verordnung fallen, ist in Deutschland jedoch verschwindend gering, so dass die Vielzahl der übrigen, meist mittelständischen Unternehmen zumindest rechtlich von der Pflicht zur Anwendung der IFRS nicht betroffen ist. In der Literatur wird jedoch bezweifelt, ob diese zurzeit bestehende Spaltung von Einzel- und Konzernrechnungslegung langfristig bestehen bleiben kann. Eine einheitliche deutsche Rechnungslegung wäre aufgrund der IAS-Verordnung indes nur noch nach den IFRS möglich. Ist die traditionelle deutsche Bilanzierungsweise somit auch außerhalb der Kapitalmärkte an ihrem Ende und das HGB tatsächlich ein Auslaufmodell ? Sollten die IFRS überhaupt und, wenn ja, in welcher Art und Weise im Einzelabschluss mittelständischer Unternehmen Anwendung finden? Eröffnen sich dem Mittelstand durch die Bilanzierung nach den IFRS neue Möglichkeiten bspw. im Hinblick auf die Internationalisierung der Geschäftstätigkeit oder werden durch die hohen Kosten und die besonderen Anwendungsprobleme mittelständischer Unternehmen der IFRS-Anwendung ihre Grenzen aufgezeigt? In der Literatur wird über diese Fragen eine kontroverse Diskussion geführt. Besondere Bedeutung kommt in diesem Zusammenhang dem im Februar 2007 veröffentlichten Standardentwurf eines eigenständigen IFRS for SMEs zu, der die Entscheidung zugunsten oder gegen die IFRS maßgeblich beeinflussen könnte.
