Book excerpt: El proyecto fundamental de una teoría crítica del derecho trata, en suma, de pensar el derecho en función de la dialecticidad de lo social, pero comprendiendo un compromiso ético y político mucho más profundo que el simple acatamiento de las leyes e instituciones que se consolidaron a través de aquél, lo que trasciende con mucho el marco de una teoría del derecho positivo. En esta investigación la reconstrucción del saber jurídico, a partir de la identificación de los presupuestos ideológicos de la dogmática jurídica, es precedida por un estudio metodológico preliminar y por la valoración de las manifestaciones más significativas del pensamiento filosófico y iusfilosófico, que constituyen una aproximación a la teoría crítica. A fin de hacer la obra más accesible al lector situado fuera del pequeño círculo de los versados en la iusfilosofía, se procuró evitar los excesos del lenguaje permeado por el tecnicismo, cuidando de que todas las citas de textos en idioma extranjero fuesen traducidas. La metodología adoptada procuró apartar el excesivo apego a los esquemas lineales de la derivación analítica, de conclusiones inferidas a partir de las premisas construidas a lo largo del texto, y optó por un modelo circular, de reflexión sobre las ideas surgidas en el contexto del pensamiento crítico.
