Book excerpt: A free open access ebook is available upon publication. Learn more at www.luminosoa.org. The leadership and legacy of al-Haq, from its origins in Palestine to its international impact Established in Ramallah in 1979, al-Haq was the first Palestinian human rights organization and one of the first such organizations in the Arab world. This inside history explores how al-Haq initiated methodologies in law and practice that were ahead of its time and that proved foundational for many strands of today’s human rights work in Palestine and elsewhere. Lynn Welchman looks at both al-Haq’s history and legacy to explore such questions as: Why would one set up a human rights organization under military occupation? How would one go about promoting the rule of law in a Palestinian society deleteriously served by the law and with every reason to distrust those charged with implementing its protections? How would one work to educate overseas allies and activate international law in defense of Palestinian rights? This revelatory story speaks to the practice of local human rights organizations and their impact on international groups.

Book excerpt: From the historic launch of the organization by such luminaries as Elihu Root and Charles Evans Hughes, to the recent era when international law is more and more in the public realm, Kirgis's book traces the evolution of the organization and its relationship to events in the United States and around the world. As he says in the preface: "'...In the end, the reader will have to make his/her own judgment about how well the Society has run the course it set out for itself in 1906. I hope this book will provide a basis for that judgment. And of course no judgment at this stage can be final. The American Society of International Law will carry on into its second century with new and continuing programs that take into account what it has done in its first one hundred years. It will continue to do its best to demonstrate not only what international law is or should be, but also that, in the words of former ASIL President Louis Henkin, international law matters.'"

Available in PDF, EPUB and Kindle. Book excerpt: Since the end of the Cold War, increasing numbers of people have been forced to leave their homes as a result of armed conflict, internal strife, and systematic violations of human rights. Whereas refugees crossing national borders benefit from an established system of international protection and assistance, those who are displaced internally suffer from an absence of legal or institutional bases for their protection and assistance from the international community. This book analyzes the causes and consequences of displacement, including its devastating impact both within and beyond the borders of affected countries. It sets forth strategies for preventing displacement, a special legal framework tailored to the needs of the displaced, more effective institutional arrangements at the national, regional, and international levels, and increased capacities to address the protection, human rights, and reintegration and development needs of the displaced.

Book excerpt: This is the seventeenth volume of the Hague Yearbook of International Law, which succeeds the Yearbook of the Association of Attenders and Alumni of the Hague Academy of International Law. The title Hague Yearbook of International Law reflects the close ties which have always existed between the AAA and the City of The Hague with its international law institutions, and indicates the Editor's intention to devote attention to developments taking place in those international law institutions, viz. the International Court of Justice the Permanent Court of Arbitration, the Iran-United States Claims Tribunal, and the Hague Conference on Private International Law. This volume contains in-depth articles on these developments and summaries of (aspects of) decisions rendered by the International Court of Justice, the International Criminal Court, the International Criminal Tribunal for the former Yugoslavia since 1991, the Iran-United States Claims Tribunal, the Permanent Court of Arbitration and the Hague Peace Conference on Private International Law.

Available in PDF, EPUB and Kindle. Book excerpt: Landmark study of the African Charter on Human and Peoples' Rights. Documents on one side the international community's inability to foist a human rights system upon Africa and on the other the process within the OAU (now African Union) that eventually brought it into being and determined its content. The African Charter on Human and Peoples' Rights (ACHPR), which was proposed in 1979, adopted in 1981 and came into effect in 1986, was the first non-Western declaration of human rights and the first official statement of an African human rights perspective. With Africa largely absent in 1948 when the Universal Declaration of Human Rights (UDHR) was adopted, it stands in stark historical reproach to the Western conception of universal human rights as a pivotal document in the decolonisation of the continent. This book, for the first time, presents a comprehensive account of the development of the ACHPR, which is key to a proper understanding of its fundamental nature. Through documenting its process of construction, it becomes possible to understand how Africans themselves understood the process and the issues involved and how the ACHPR became a political text asserted by African leaders and not a continuum of a so-called universal human rights tradition. The result is a radical repositioning of the underlying context of the ACHPR, one of the most important documents in modern African history, of how it came to be and how it should therefore be understood. Volume 2 describes the process through which the ACHPR came into being. Analysing the role of Western governments, the UN and NGOs, it shows that, contrary to the prevailing view of African human rights commentators, their influence was limited and at times counter-productive. That, in fact, the formulation of the ACHPR was a profoundly political process that was primarily a product of an African desire to instigate its own human rights perspective as a counter to the human rights universalism advanced by the Western post-war human rights tradition.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents a systematic, in-depth, and comparative analysis of the role of the EU in the process of international state-building and is one of the first comprehensive books to do so at an international level. Taking the case of Kosovo, it examines the EU's role in the birth of a state in comparison to other international actors from 1999 to 2008 and moves on to analyse the EU's role in norm diffusion in the post-independence period (2008–2020). Throughout the book, the author draws parallel analyses with broader debates and scholarly literature regarding the EU’s role as a state-builder or norm-diffuser. Combining a liberal peace thesis framework with the normative power Europe (NPE) approach, it analyses how successful the EU and other international actors were in the diffusion of tangible and normative impacts in the process of state-building in Kosovo (1999–2008), along with the EU’s diffusion of normative impact from 2008 to 2020. Finally, it scrutinises the role of the EU and other international actors in the processes of state-building through transference tools (funding) and overt tools (political role). This book will be of key interest to scholars and students of EU foreign policy, European politics, peace and conflict studies, the Western Balkans, state-building, international organisations, and more broadly to international relations.
