Book excerpt: Liberty and Law examines a previously underappreciated theme in legal history - the idea of permissive natural law. The idea is mentioned only peripherally, if at all, in modern histories of natural law. Yet it engaged the attention of jurists, philosophers, and theologians over a long period and formed an integral part of their teachings. This ensured that natural law was not conceived of as merely a set of commands and prohibitions that restricted human conduct, but also as affirming a realm of human freedom, understood as both freedom from subjection and freedom of choice. Freedom can be used in many ways, and throughout the whole period from 1100 to 1800 the idea of permissive natural law was deployed for various purposes in response to different problems that arose. It was frequently invoked to explain the origin of private property and the beginnings of civil government.

Book excerpt: By the end of the thirteenth century, court procedure in continental Europe in secular and ecclesiastical courts shared many characteristics. As the academic jurists of the Ius commune began to excavate the norms of procedure from Justinian's great codification of law and then to expound them in the classroom and in their writings, they shaped the structure of ecclesiastical courts and secular courts as well. These essays also illuminate striking differences in the sources that we find in different parts of Europe. In northern Europe the archives are rich but do not always provide the details we need to understand a particular case. In Italy and Southern France the documentation is more detailed than in other parts of Europe but here too the historical records do not answer every question we might pose to them. In Spain, detailed documentation is strangely lacking, if not altogether absent. Iberian conciliar canons and tracts on procedure tell us much about practice in Spanish courts. As these essays demonstrate, scholars who want to peer into the medieval courtroom, must also read letters, papal decretals, chronicles, conciliar canons, and consilia to provide a nuanced and complete picture of what happened in medieval trials. This volume will give sophisticated guidance to all readers with an interest in European law and courts.

Available in PDF, EPUB and Kindle. Book excerpt: Contains a bibliographical survey of the chronological and systematic canonical collections in the Latin West from the beginnings of Christianity to Gratian's Decretum (ca. 1140). Dr. Kéry not only has compiled a catalogue of early medieval canonistic manuscripts, but has included valuable information about them. For each collection she has described its type and contents, the time and place of compilation, and, when, possible, its author. Full bibliographies have been provided for each collection, arranged in chronological order. Scholars will find her work particularly useful since she has also noted where scholars have differed and where their opinions may be found. Special attention has been paid to the numerous recensions of the collections. She has given a separate entry for important recensions and has lists of fragments and abbreviated forms of the collections.

Book excerpt: Between Sword and Prayer is a broad-ranging anthology focused on the involvement of medieval clergy in warfare and a variety of related military activities. The essays address, on the one hand, the issue of clerical participation in combat, in organizing military campaigns, and in armed defense, and on the other, questions surrounding the political, ideological, or religious legitimization of clerical military aggression. These perspectives are further enriched by chapters dealing with the problem of the textual representation of clergy who actively participated in military affairs. The essays in this volume span Latin Christendom, encompassing geographically the four corners of medieval Europe: Western, East-Central, Northern Europe, and the Mediterranean. Contributors are Carlos de Ayala Martínez, Geneviève Bührer-Thierry, Chris Dennis, Pablo Dorronzoro Ramírez, Lawrence G. Duggan, Daniel Gerrard, Robert Houghton, Carsten Selch Jensen, Radosław Kotecki, Jacek Maciejewski, Ivan Majnarić, Monika Michalska, Michael Edward Moore, Craig M. Nakashian, John S. This book was released on 2016 with total page 351 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the mid-ninth century, Francia was rocked by the first royal divorce scandal of the Middle Ages: the attempt by King Lothar II of Lotharingia to rid himself of his queen, Theutberga, and replace her with Waldrada, the mother of his children. Lothar, however, faced opposition to his actions; kings and bishops from neighbouring kingdoms, and eventually the pope himself, were gradually drawn into a crisis affecting the fate of an entire kingdom and which helped durably shape European politics and culture. This is the first professionally published translation of a key source for this extraordinary episode: Archbishop Hincmar of Rheims's De divortio Lotharii regis et Theutbergae reginae. Surviving in a single manuscript produced under Hincmar's own guidance, On the divorce of King Lothar and Queen Theutberga offers eye-opening insight not only on the political wrangling of the time (in which Hincmar was a major participant), but also on early medieval attitudes towards a host of issues including magic, penance, gender, the ordeal, marriage, sodomy, the role of bishops, and kingship. The translation is cross-referenced to Letha Böhringer's MGH edition and includes a substantial introduction and annotations which put the case into its early medieval context and explain Hincmar's sometimes-dubious methods of argument. The text provides fascinating insights into Carolingian society and will make an ideal source text for many undergraduate courses on medieval gender and sexuality, magic or kingship. It will also appeal to all academics and non-specialists interested in this most lurid of cases.

Book excerpt: Although seemingly bizarre and barbaric in modern times, trial by ordeal-the subjection of the accused to undergo harsh tests such as walking over hot irons or being bound and cast into water-played an integral, and often staggeringly effective, role in justice systems for centuries. In "Trial by Fire and Water," Robert Bartlett examines the workings of trial by ordeal from the time of its first appearance in the barbarian law codes, tracing its use by Christian societies down to its last days as a test for witchcraft in modern Europe and America. Bartlett presents a critique of recent theories about the operation and the decline of the practice, and he attempts to make sense of the ordeal as a working institution and to explain its disappearance. Finally, he considers some of the general historical problems of understanding a society in which religious beliefs were so fundamental. Robert Bartlett is Wardlaw Professor of Medieval History at the University of St. Andrews.
