India, Pakistan, Bangladesh, Nepal, Sri Lanka and Afghanistan have all been affected by the geopolitics of colonialism. Nineteenth century Europe is often simplistically seen as the ideological source of the rights discourse in South Asia. But, like any ideological theme, the discourse on rights is also a negotiated space. Resistance created a need to justify imperialism by importing a purpose to it. Regulation of policing was the coloniser's superior norm, and also, his tool of control. The erstwhile colonies inherited the practice of affirming norms while systems enabled their breach. Which is not to say that the purpose of norms is merely hypocritical; political struggles and intellectual discourse have, over the years, ensured the recognition of human rights in international instruments, national charters and even in the very pretexts for their breach. Though human rights are inalienable, the modern state has been uniformly guarded in its response to their imperatives. This book traces the historical and contemporary nature of the conflict between the norm and its practice. Constitutions, statutes and mechanisms of justice are reviewed with case studies and interviews that illustrate the many layers of impunity.

Six country volumes (one each on Bangladesh, Nepal, Pakistan, Sri Lanka, and two on India, as well as two standalone volumes) comprising over fifty research papers and two book-length studies, detail the histories of sexual violence and look at the systemic, institutional, societal, individual and community structures that work together to perpetuate impunity for perpetrators. The essays in this volume examine history and contemporary politics to understand the root causes of sexual violence in Sri Lanka. They look at the polarization created around ethnic and linguistic identities during the three-decades of ethnic conflict, but also scrutinize the routine violence of communities towards their own women in daily life. The authors argue that in this transitional post-war phase, Sri Lankan women must not only be treated as victims, but as agents of change. The writers highlight a hitherto unaddressed aspect of sexual violence: that of the structures that enable impunity on the part of perpetrators, be they security personnel and paramilitary forces, members of armed rebel groups, gangs, local politicians and police or ordinary citizens including close family members. They demonstrate how impunity for perpetrators is both a failure of the formal justice process and a product of individual, community and social conditions and indeed the choices that victims and families make that promote silence over truth. At the end of more than a quarter century of conflict that has left some 100,000 dead, 50,000 women-headed households struggling to survive, as well as countless victims and survivors of sexual violence, the calls for justice can no longer be ignored.

As many of the authors argue, the very nature and conditions of sexual violence in the South Asian region lend themselves to a silencing process, or, at a minimum, a reluctance to address it head on, something that may at least partially explain why accountability for sexual violence remains such a distant horizon. This volume focuses on Bangladesh, a nation born in 1971, in a birth that was as marked by bloodshed as it was by sexual violence. The history of widespread sexual violence, and incidents of sexual slavery, as well as the absence of accountability for the perpetrators, is by now well known. The essays here address the structural dynamics of impunity at the individual and societal levels, looking not only at the conditions that go into its creation, but also the elements that fuel it. They ask what helps it to become so embedded and point to its human, global and national costs. Together they explore the ways in which the women's movement and feminist practice have worked to demand accountability and recognition for the victims and survivors of sexual violence, challenging the impunities embedded in the patriarchal structures of Bangladeshi society. In doing so, they bear witness to the continuing efforts of women's groups in Bangladesh to give this crucial issue the attention that it deserves, for without that, justice for victims and survivors will remain elusive.
