Book excerpt: Companies House has two main functions: the incorporation, dissolution and restoration of limited companies; and the maintenance of a register of company details, annual reports and accounts which it makes available for public inspection. It funds its work by charging fees and pays a small dividend to the Treasury each year. Companies House handles a vast amount of data. It is now doing much more of this electronically. This move has not been entirely smooth. In the Committee's view, the greatest difficulties facing Companies House, and those who use its services, arise from matters which are not directly controlled by Companies House itself - namely the way in which the internet has enabled faster and easier access to information. The Committee makes a number of recommendations about assessing particular risks and trying to reduce them. An underlying theme of this report is the need for Companies House to do more to explain the limitation of the information it holds. It is felt that much more could and should be done to make clear that the role of Companies House is to receive and publish data and that its power to verify information is extremely limited

The plenary session on The Interaction Between Technology and Law brought a legal perspective to the technological challenges of digital forensic investigation.

Book excerpt: There has been a significant improvement in economic relations between the UK and India since the 2006 report from the Trade and Industry Committee (HC 881-I, 3rd report session 2005-06, ISBN 9780215029355), which urged greater engagement with India. Both Government and private sector bodies have worked to achieve this. The sizeable investments and deals made both by Indian companies in the UK and British companies in India are encouraging signs of a deepening relationship which should benefit both countries. The establishment of the UK-India Business Council is perhaps the most tangible manifestation of this. This new report welcomes the improved climate, but identifies areas for further work. India's economy has recently enjoyed growth rates of around 9 per cent a year; it is possible this will slow slightly in 2008 and 2009. India faces significant challenges, such as real poverty, poor infrastructure and public sector bureaucracy. But the Indian market is liberalising and has much to offer. Not all the barriers to a deepened relationship are on the Indian side. The recommendations in this report on education links, on visas, on the future of JETCO, on the work of UKTI and on trade negotiations need to be seen against this wider backdrop.

Amongst the 56 conclusions and recommendations made, the report seeks to highlight the importance of an independent audit facility, including placing the chairmanship of the Audit Committee in the hands of an external Committee member and instituting a rolling programme of NAO value-for-money audits. It also recommends a revamped role for the Office for the Chief Executive, with responsibility for strategic planning; strengthening the position of the Finance and Services Committee to improve scrutiny of spending proposals and to support the governing role of the Commission; a centralised and professional human resources team to develop the House staff as a collective resource and to overcome the inefficiencies of the present personnel structure; and the creation of further joint Departments between the two Houses in the interests of reducing overhead costs and general efficiency.

Based on ethnographic research over a two-year period, the work follows and analyses numerous asylum appeals through the British courts. It draws on myriad interviews with individuals and a thorough examination of many state and non-state organizations to understand how the system works. While the organization of the book reflects the formal asylum process, a focus on specific legal appeals reveals the ‘political’ factors at play as different institutions and actors seek to influence judicial decision-making and overturn/uphold official asylum policy. For some they represent a 'dangerous enthusiasm' and for others a key enabler of 'disruptive innovation'. Many governments have made major policy and financial investments in digitalizing health records but their implementation has frequently run into opposition from doctors, had lukewarm responses from patients, and raised considerable concerns for privacy advocates and others worried by the security of sensitive health data and the risks of national data-bases. This book draws upon the concept of 'orders of worth' to reveal the moral dimensions of the medical division of labour and to delve deeper into understanding why electronic records have been so difficult to implement and the sources of opposition to them. The authors argue that digitalization disrupts the moral orders which define rights and responsibilities for the sharing and exchanging of patient medical data. This is illustrated through longitudinal studies of two of the most controversial attempts to introduce national systems - a patient controlled electronic record in Australia and a national summary care record that was part of the ill-fated NHS national program for IT in England. The authors conclude by using the lessons from these national experiences and insights from two regional projects in each country to suggest how the idea of electronic records might be re-thought. It is a must read for anyone concerned about health information and the implications of how it is shared and exchanged in a digital world.

The Government and Research Council UK should reconsider their preference for Gold open access during the five year transition period, and give due regard to the evidence of the vital role that Green open access and repositories have to play as the UK moves towards full open access. (Authors opting for Green open access publish in any subscription journal, and then make their peer-reviewed final draft freely accessible online by self-archiving or depositing the article in a repository (either institutional or disciplinary) upon acceptance for publication.) Other recommendations include: promotion of standardisation and compliance across subject and institutional repositories; mitigation against the impact on universities of paying Article Processing Charges out of their own reserves; introduce a reduced VAT rate for e-journals; non-disclosure clauses should not be used in publishing contracts that include the use of public funds; BIS must review its consultation processes to ensure that lessons are learned from the lack of involvement of businesses, particularly SMEs, in the formation of open access policy
