On the Proposition to Amend the Constitution of the United States: Respecting the Election of President and Vice President; Delivered in the House of Representatives; March 29, 1826 Mr. Hoffman, of New York, rose, and addressed the Committee as follows: Mr. Chairman: On this important subject, I should prefer to remain silent. It is most easy; and that indisposition, which has prevented me from hearing a considerable part of the debate, and the labor of body necessary to speak in this place, make that ease the more desirable. But, the State which I have the honor, ii part, to represent, has, from her extent and population, a great interest in this question. In every part of the debate she has been referred to with the utmost freedom. The judgment she has expressed upon the subject, and which is mine also, weighs heavily with me. Her institutions, her parties, her judgment, her interests, have been misunderstood, and misrepresented. All these circumstances concur, however reluctant I may feel, in obliging me to endeavor to correct the errors into which gentlemen have fallen, in relation to her parties, her institutions, her judgment, and above all, her substantial Interests, in this subject. I must therefore claim- the indulgence of the Committee, while I express my views on the amendments contemplated. In common with all the gentlemen who have preceded me in the debate, I heartily concur in the eulogies pronounced on the framers of the Constitution. They were patriot citizens, and worthy men, and they have done good. I will not praise the dead to censure the living; and I know that their great excellence is best exhibited in their just regard for the rights of person and of property. In framing our political institutions, they earnestly sought to secure to the citizen such political privileges as should forever enable him, beyond the control of any other, to protect his civil liberty. Their good character expresses our duty. We must not shrink from the responsibility of our situation. Like them, we must examine into the state, the condition, and the wants of the society in which we live; and if the advancement of the interest or happiness of the citizens of the States require it, we must propose proper amendments to the Constitution, according to its provisions. We must endeavor to perfect the work they so happily began; and not disappoint the just expectation of our predecessors. But, sir, two objections are interposed to this course. And at this day the hidden vice and misery, falsehood and deception, created solely by the er rors proceeding from men's laws, are most appalling; and if the sufferings thereby produced, especially to the finest formed in body and mind of the female sex, were not thus hidden, and were made public, they could not be longer permitted, if it were known that they are the necessary results of false and most injurious legislation, emanating from the grossly mistaken first principles on which the present system of society over the world is alone based and supported. In a pure democracy, there will be no motive to sexual crime, and soon sexual disease will be eradicated from society. Marriages will be formed, as the laws of God unequivo cally direct, at a proper period of life, under such arrangements as will be the most likely to prevent ill-assorted unions, and to insure the greatest permanency of the first natural affections between the parties. As a Constitution of pure democracy will insure to all equal education, occupation, and condition, through life, according to age and capacity, the field of choice for the parties will be greatly enlarged, and the real character of every one in the unions will be accu' rately known from birth through every stage of life; and as the language of the unions will be 'alone the language of truth, there will he no deception before marriages, to destroy mutual confidence after marriages, when the deception becomes known, as so generally occurs under the present system The law of God is, that humanity is compelled to like or love that which is agreeab'e or lovely to the peculiar combination of qualities given by God to each individual at birth, and from that period as cultivated by society, and to dislike or loathe those qualities which are made to be disagreeable or hateful to the instincts or natural feelings of the same individuals.
