The act of copying, and the creation and transaction of rights relating to it, evokes fundamental notions of communication and censorship, of authorship and ownership - of privilege and property. This volume conceives a new history of copyright law that has its roots in a wide range of norms and practices. The essays reach back to the very material world of craftsmanship and mechanical inventions of Renaissance Italy where, in 1469, the German master printer Johannes of Speyer obtained a five-year exclusive privilege to print in Venice and its dominions. Along the intellectual journey that follows, we encounter John Milton who, in his 1644 Areopagitica speech 'For the Liberty of Unlicensed Printing', accuses the English parliament of having been deceived by the 'fraud of some old patentees and monopolizers in the trade of bookselling' (i.e. the London Stationers' Company). Later revisionary essays investigate the regulation of the printing press in the North American colonies as a provincial and somewhat crude version of European precedents, and how, in the revolutionary France of 1789, the subtle balance that the royal decrees had established between the interests of the author, the bookseller, and the public, was shattered by the abolition of the privilege system. Contributions also address the specific evolution of rights associated with the visual and performing arts. These essays provide essential reading for anybody interested in copyright, intellectual history and current public policy choices in intellectual property. In 1858 Savannah businessman Charles Lamar, in violation of U.S. law, organized the shipment of hundreds of Africans on the luxury yacht Wanderer to Jekyll Island, Georgia. The four hundred survivors of the Middle Passage were sold into bondage. This was the first successful documented slave landing in the United States in about four decades, and it shocked a nation already on the path to civil war. Nearly thirty years later, the North American Review published excerpts from thirty of Lamar’s letters, reportedly taken from his letter book, which describe his criminal activities. However, the authenticity of the letters was in doubt until very recently. In the twenty-first century, researcher Jim Jordan found a cache of private papers belonging to Charles Lamar’s father, stored for decades in an attic in New Jersey. Among the documents was Charles Lamar’s letter book—confirming him as the author. The first part of this book recounts the flamboyant and reckless life of Lamar himself, including involvement in southern secession, the slave trade, and a plot to overthrow the government of Cuba. A portrait emerges at odds with Lamar's previous image as a savvy entrepreneur and principled rebel. Instead, we see a man who was often broke and whose volatility sabotaged him at every turn. His involvement in the slave trade was driven more by financial desperation than southern defiance. The second part presents the “Slave-Trader's Letter-Book.” Together with annotations, these seventy long-lost letters shed light on the lead-up to the Civil War from the remarkable perspective of a troubled, and troubling, figure.

Censorship and Conflict in Seventeenth-Century England offers a detailed picture of early modern censorship and investigates the pressures that censorship exerted on seventeenth-century authors, printers, and publishers. In the 1600s, Britain witnessed a civil war, the judicial execution of a king, the restoration of his son, and an unremitting struggle among crown, parliament, and people for sovereignty and the right to define “liberty and property.” This battle, sometimes subtle, sometimes bloody, entailed a struggle for the control of language and representation. Robertson offers a richly detailed study of this “censorship contest” and of the craft that writers employed to outflank the licensers. He argues that for most parties, victory, not diplomacy or consensus, was the ultimate goal. This book differs from most recent works in analyzing both the mechanics of early modern censorship and the poetics that the licensing system produced—the forms and pressures of self-censorship. Among the issues that Robertson addresses in this book are the workings of the licensing machinery, the designs of art and obliquity under a regime of censorship, and the involutions of authorship attendant on anonymity.
