Available in PDF, EPUB and Kindle. Book excerpt: Several ofthe themes of this study have been treated in earlier publica tions, some by means of a general analysis and some through a detailed handling of problems raised by a particular theme or historian. Both the more general theoretical treatment of the theme and the concrete historiographical treatment are, I think, indispensable aids to the proper understanding of the development of historical scholarship in nineteenth-and twentieth-century England. There are a number of problems in a concrete historiographical approach: there is first the mass of historians to be faced, and then the immense amount of historical themes dealt with in various periods. As a guideline through the tangle of themes we chose the historiography on the development of the English parliament. We can only hope that we have made a responsible choice of the historians concerned. Un fortunately it was not always possible for us to give extensive biogra phies of some of the more recent historians, as several 'papers' are still firmly in the possession of families, and a number of them mus- despite of years - still be labelled 'confidential.' The Pollard Papers in the London Institute of Historical Research thus remained inaccessible. Fortunately the lack was partly compen sated by some important material being found apart from these Papers.

Available in PDF, EPUB and Kindle. Book excerpt: First published in 1954, this book explores the political ideas of the Middle Ages. It covers the period from the investiture struggle to the end of the fifteenth century and provides comprehensive readings of otherwise inaccessible source material. Each chapter begins with an introductory essay on the subject at hand that leads to a number of translated passages, numerous enough to display a variety of opinion and long enough to indicate the process of thought as well as its conclusions. This book is the first of a two volume set and will be useful to teachers and advanced students of political theory and medieval history. Topics discussed in this volume include law, property and lordship, political authority and community.

Book excerpt: Throughout Europe, the exercise of justice rests on judicial independence by impartiality. In Reason and Fairness Ulrike Müßig reveals the combination of ordinary judicial competences with procedural rationality, together with the complementarity of procedural and substantive justice, as the foundation for the ‘rule of law’ in court constitution, far earlier than the advent of liberal constitutionalism. The ECHR fair trial guarantee reads as the historically-grown consensus of the functional judicial independence. Both before historical and contemporary courts, justice is done and seen to be done by means of judgements, whose legal requirements combine the equation of ‘fair’ and ‘legal’ with that of ‘legal’ and ‘rational.’ This legal determinability of the judge’s fair attitude amounts to the specific (rational) European idea of justice.

Book excerpt: Corruption is far from disappearing, yet now it inspires resignation rather than indignation - and as such, it has lost its power to scandalize. Jankowski claims that such transformations tell a tale. The state that once aspired to pre-eminence as the sole magnet of loyalty, touchstone of probity, and guarantor of right, has yielded significant ground to the individual who is now more likely to elevate his own dignity and cry scandal on his own behalf."--Jacket.
