Jedoch gilt auch hier eines der Strukturprinzipien des Gesetzes, nämlich die Orientierung am Vorzug der elterlichen Erziehungsverantwortung.

Book excerpt: Im Rahmen der Arbeit wird untersucht, ob bzw. inwieweit die Leistungsorientierung der Kinder- und Jugendhilfe bei der Hilfe zur Erziehung nach §§ 27 ff. SGB VIII aus der Perspektive der Eltern und des Kindes verwirklicht worden ist. Anspruchsinhaber sind die Personensorgeberechtigten, nicht die Minderjährigen. Diese Zuweisung ist nicht verfassungsrechtlich zwingend. Sie steht zudem im Widerspruch zu der Stellung des Kindes als Rechtssubjekt auf internationaler Ebene sowie der an anderen Stellen des SGB VIII vorgenommenen Stärkung seiner Rechte. Als Personensorgeberechtigte sind in der Regel beide Eltern gemeinsam anspruchsberechtigt. Nur über Hilfen mit geringer Intensität kann als Angelegenheit des täglichen Lebens durch den Elternteil, bei dem sich das Kind gewöhnlich aufhält, allein entschieden werden. Dies gilt auch im Doppelresidenzmodell. Die Geltendmachung des Anspruchs durch die Minderjährigen oder etwa die Pflegeperson ist vorbehaltlich rechtsgeschäftlicher Vereinbarungen nicht möglich. Dies gilt grundsätzlich auch für die Annexansprüche der §§ 39, 40 SGB VIII. Anspruchsvoraussetzungen sind nach § 27 Abs. 1 SGB VIII ein erzieherischer Bedarf sowie Eignung und Notwendigkeit der Hilfe. Hierdurch konkretisiert sich bereits die als Rechtsfolge zu gewährende Hilfe. Neben den Hilfearten der §§ 28 bis 35 SGB VIII sind die Kombination von Hilfen, die Entwicklung neuer Hilfearten und die Gewährung von Leistungen aus anderen Abschnitten des SGB VIII möglich. Bei Auslegung der unbestimmten Rechtsbegriffe steht dem Jugendamt kein Beurteilungsspielraum zu. Zu den Fallgruppen, in denen der Exekutive letztverbindliche Entscheidungskompetenzen eingeräumt werden, liegen entscheidende Abweichungen vor. Es besteht auch grundsätzlich kein Auswahlermessen. Während sich die Leistungsorientierung den Eltern gegenüber als stark ausgeprägt erweist, bleibt die Rechtsstellung des Kindes aufgrund der ausschließlichen Anspruchsinhaberschaft der Personensorgeberechtigten schwach.
