Book excerpt: The Canadian Senate has long been considered an institutional pariah, viewed as an undemocratic, outmoded warehouse for patronage appointments and mired in spending and workload scandals. In 2014, the federal government was compelled to refer constitutional questions to the Supreme Court relating to its attempts to enact senatorial elections and term limits. Constitutional Pariah explores the aftermath of Reference re Senate Reform, which barred major unilateral alteration of the Senate by Parliament. Ironically, the decision resulted in one of the most sweeping parliamentary reforms in Canadian history, creating a pathway to informal changes in the appointments process that have curbed patronage and partisanship. Despite reinvigorating the Senate, Reference re Senate Reform has far-reaching implications for constitutional reform in other contexts. Macfarlane’s sharp critique suggests that the Court’s nebulous approach to the amending formula raises the spectre of a frozen constitution, unable to evolve with the country.

In this timely book, Patrick Boyer examines the important role that direct democracy -- through the occasional use of referendums, plebscites, and inniatives -- can play in concert with our existing institutions of representative democracy. This concept is not alien to our country, says Boyer, pointing to the two national plebiscites (on prohibition of alcohol in 1898 and consciption for overseas military service in 1942), some sixty provincial plebscites (on everything from sovereignty-association to abortion, medicare to women's suffrage, prohibition to ownership of power companies), and several thousand at the municipal level. Direct voting is an important instrument in a truly democratic society, Boyer argues, and it has a more important rold in the current reformation of Canada than some in the comfortable growing governing classes want to admit. Book excerpt: In this study of the intellectual origins of Quebec's Quiet Revolution of the 1960s, Michael Behiels has provided the most comprehensive account to date of the two competing ideological movements which emerged after World War II to challenge the tenets of traditional French-Canadian nationalism. The neo-nationalists were a group of young intellectuals and journalists, centered upon Le Devoir and L'Action nationale in Montreal, who set out to reformulate Quebec nationalism in terms of a modern, secular, urban-industrial society which would be fully "master in its own house." An equally dedicated group of French Canadians of liberal or social democratic persuasion was based upon the periodical Cité libre -one of whose editors was Pierre Trudeau - and had links with organized labour. Citélibristes sought to remove what they considered to be the major obstacles to the creation of a modern francophone society: the all-pervasive influence of clericalism inherent in the Catholic church's control of education and the social services, and the persistence among Quebec's intelligentsia of an outmoded nationalism which advocated the preservation of a rural and elitist society and neglected the development of the individual and the pursuit of social equality. Behiels delineates the divergent "societal models" proposed by the two movements by focusing upon such themes as the critique of traditional nationalism; the roles of church, state, and labour; the response to the "new federalism"; the reform of education; and the search for a third party. He shows how the rivals combined to help bring down an anachronistic Union Nationale government in June 1960. In one form or another, he concludes, Cité libre liberalism and neo-nationalism have remained at the heart of the political and ideological debate that has continued in Quebec since the Duplessis era.
