Many of these systems are described and assessed for the first time in an academic publication. The publication draws upon a groundbreaking Conference organised by the Clemens Nathan Research Centre (CNRC) and REDRESS at the Peace Palace in The Hague, with the support of the Dutch Carnegie Foundation. Both CNRC and REDRESS had become very concerned about the extreme difficulty encountered by most victims of serious international crimes in attempting to access effective and enforceable remedies and reparation for harm suffered. In discussions between the Conference organisers and Judges and officials of the International Criminal Court, it became ever more apparent that there was a great need for frank and open exchanges on the question of effective reparation, between the representatives of victims, of NGOs and IGOs, and other experts. It was clear to all that the many current initiatives of governments and regional and international institutions to afford reparations to victims of genocide, crimes against humanity and war crimes could benefit greatly by taking into full account the wide and varied practice that had been built up over several decades. In particular, the Hague Conference sought to consider in detail the long experience of the Conference on Jewish Material Claims against Germany (the Claims Conference) in respect of Holocaust restitution programmes, as well as the practice of truth commissions, arbitral proceedings and a variety of national processes to identify common trends, best practices and lessons. This book thus explores the actions of governments, as well as of national and international courts and commissions in applying, processing, implementing and enforcing a variety of reparations schemes and awards. Crucially, it considers the entire complex of issues from the perspective of the beneficiaries - survivors and their communities - and from the perspective of the policy-makers and implementers tasked with resolving technical and procedural challenges in bringing to fruition adequate, effective and meaningful reparations in the context of mass victimisation.

These items bore testimony to the cultural genocide that accompanied the Nazis’ systematic acts of mass murder. The depot built a short-lived lieu de memoire—a “mortuary of books,” as the later renowned historian Lucy Dawidowicz called it—with over three million books of Jewish origin coming from nineteen different European countries awaiting restitution. A Mortuary of Books tells the miraculous story of the many Jewish organizations and individuals who, after the war, sought to recover this looted cultural property and return the millions of treasured objects to their rightful owners. Some of the most outstanding Jewish intellectuals of the twentieth century, including Dawidowicz, Hannah Arendt, Salo W. Baron, and Gershom Scholem, were involved in this herculean effort. This led to the creation of Jewish Cultural Reconstruction Inc., an international body that acted as the Jewish trustee for heirless property in the American Zone and transferred hundreds of thousands of objects from the Depot to the new centers of Jewish life after the Holocaust. The commitment of these individuals to the restitution of cultural property revealed the importance of cultural objects as symbols of the enduring legacy of those who could not be saved. It also fostered Jewish culture and scholarly life in the postwar world.

In the aftermath of the Holocaust, returning survivors had to navigate a frequently unclear path to recover their property from governments and neighbors who had failed to protect them and who often had been complicit in their persecution. While the return of Nazi-looted art has garnered the most media attention, and there have been well-publicized settlements involving stolen Swiss bank deposits and unpaid insurance policies, there is a larger piece of Holocaust injustice that has not been adequately dealt with: stolen land and buildings, much of which today still remain unrestituted. This book is about the less publicized area of post-Holocaust restitution involving immovable (real) property confiscated from European Jews and others during World War II. In 2009, 47 countries convened in Prague to deal with the lingering problem of restitution of pre-war private, communal and heirless property stolen in the Holocaust. The outcome was the issuance by 47 states of the Terezin Declaration on Holocaust Era Assets and Related Issues, which aimed, among other things, to "rectify the consequences" of the wrongful property seizures. This book sets forth the legal history of Holocaust immovable property restitution in each of the Terezin Declaration signatory states. It also analyses how each of the 47 countries has fulfilled the standards of the Guidelines and Best Practices of the Terezin Declaration, issued in 2010 in conjunction with the establishment of the European Shoah Legacy Institute (ESLI) to monitor compliance. The book is based on the Holocaust (Shoah) Immovable Property Restitution Study commissioned by ESLI, written by the authors and issued in Brussels in 2017 before the European Parliament.

Political conflicts, regime change, revolutions and wars make not only people but also their property vulnerable. Plunder and confiscation were common ways of dealing with the enemy - either internal or external - in many conflicts, conquests and occupations during the Old Regime, and resurfaced as crucial political weapons in both the First and the Second World Wars, with disruptive effects. In the two World Wars and the interwar period, sequestration and confiscation grew in scale and scope, reaching an unprecedented magnitude because of three driving forces that were frequently intertwined: nationalism, socialism and antisemitism. Confiscation was a political weapon that furthered different aims. It helped to make the expulsion of enemy subjects irreversible. It was an instrument to exclude from the civic body those who did not belong - the 'internal enemies' - and to prevent undesirable people from acquiring citizenship. It also deprived “enemy aliens” of economic means during the conflict. Bringing together new historical research on Serbia, Italy, Belgium, Turkey, Holland, Poland, Czechoslovakia, Germany and Austria, the chapters address state violence, law and human rights, as well as the entanglement between citizenship, nationality and property. It will be of great interest to those who study minorities, borders, migration, social and economic history as well as European History. Book excerpt: The Strashun Library was among the most important Jewish public institutions in Vilna, and indeed in Eastern Europe, prior to its destruction during World War II. Mattityahu Strashun, descended from a long and distinguished line of rabbis, bequeathed his extensive personal library of 5,753 volumes to the Vilna Jewish community on his death in 1885, with instructions that it remain open to all. In the summer of 1941, the Nazis came to Vilna, plundered the library, and shipped many of its books to Germany for deposition at a future Institute for Research into the Jewish Question. When the war ended, the recovery effort began. Against all odds, a number of the greatest treasures of the library could be traced. However, owing to its diverse holdings and its many prewar patrons, a custody battle erupted over the remaining holdings. Who should be heir to the Strashun Library? This book tells the story of the Strashun Library from its creation through the contentious battle for ownership following the war until present day.
