Book excerpt: In response to a congressional request, GAO reviewed cleanup activities at priority hazardous waste sites, specifically: (1) the number, estimated value, and purpose of settlement agreements between the Environmental Protection Agency (EPA) and responsible parties; and (2) how well EPA is overseeing responsible-party compliance with the settlement terms. GAO found that: (1) approximately half of the settlements were for long-term site cleanup activities, and cleanup work was valued at $417 million; (2) the purpose of the settlement agreements was to ensure that responsible parties either performed cleanup activities at hazardous waste sites or reimbursed the government for cleanup at the sites; and (3) no formal guidelines or procedures exist for project managers to oversee settlement activities and enforce decisions, causing delays in identifying and resolving problems.

We reviewed nine higher-cost case studies at the Defense Logistics Agency (DLA) and the military services (1) to assess the consistency of cost-sharing practices across DOD and (2) to compare the service cleanup estimates against DOD'S. Specifically, we identified the actions taken and the types of arrangements for sharing cleanup costs between the government and other responsible parties, and examined site-specific cleanup cost data.

Book excerpt: GAO discussed the Environmental Protection Agency's (EPA) progress in cleaning up hazardous waste sites, focusing on: (1) future site clean-up challenges; and (2) possible clean-up approaches. GAO noted that: (1) EPA and responsible parties have removed significant amounts of hazardous waste from 149 sites on the National Priorities List (NPL) or reported as construction-complete; (2) EPA could better inform the public and Congress on a site's true status if it differentiates between sites that protect human health and the environment and those that require further remediation to achieve their clean-up objectives; (3) the remaining Superfund sites will probably be more costly to cleanup because they are more complex and require more extensive clean-up efforts; (4) EPA, states, and responsible parties will incur significant oversight, operation, and maintenance costs at many former NPL and construction-complete sites where untreated wastes remain; (5) oversight and funding problems will increase as the number of Superfund sites increase; (6) there is no consensus on how much cleanup is appropriate; (7) clean-up methods will depend on how EPA protects human health and the environment and sets clean-up standards at the sites; (8) possible clean-up approaches include uniform national clean-up standards, site-specific risk assessments, and treatment of immediate risks and delay of full cleanup; and (9) each clean-up approach has limitations due to the lack of scientific data and public acceptance.

Book excerpt: "Why GAO Did This StudyUnder the Superfund program, EPA has the authority to enter into agreements with potentially responsible parties for them to conduct a cleanup at hazardous waste sites or compel potentially responsible parties to do so. EPA can also conduct cleanups itself and then seek reimbursement. EPA is authorized to retain and use funds received from settlements with these parties in interest-earning, site-specific special accounts within the Trust Fund. These accounts provide resources in addition to annual appropriations to clean up sites. The number of accounts grew slowly until 1995 when EPA encouraged their greater use. After 1995, their number and dollar value increased. EPA headquarters is responsible for overseeing its regions' management of special accounts. In two reports issued in 2006 and 2009, the EPA IG made recommendations to EPA to better manage these accounts.As requested, this report examines the (1) status-that is, balances, locations, and recent and planned uses-of Superfund special accounts, and (2) extent to which EPA's headquarters and regions have implemented processes and policies to improve the monitoring and management of these accounts. GAO analyzed EPA Superfund program data, guidance, and strategies, and interviewed EPA officials.GAO is not making recommendations in this report.
