Book excerpt: This book reveals the social logic of the medieval rituals of reconciliation as showcased by the most potent rite, the kiss of peace. Ritual is presented as a contested ground on which individuals, groups, and political and moral authorities competed for and appropriated political sovereignty. The thesis of the study is that by employing ritual and bodily mnemonics as strategic tools, the forces of order and official morality strove to organize personality structures around a hegemonic value system. Researching three analytical fields—the legal bonds of peace, the emotional economy of ritual, and the building of identity—the book highlights the contents and evolution of ritual reconciliation in diverse cultural contexts in the period between the eleventh and the sixteenth centuries.

Book excerpt: Guta Lag, the law of the independent island of Gotland, is one of the earliest laws of Scandinavia. The historical appendix to the law, Guta Saga, was written in the thirteenth or fourteenth century. Together, Guta Lag and its accompanying Saga provide an invaluable insight into the lives of the people living on Gotland, the largest of Sweden’s Baltic islands, in 1000-1400. Guta Lag and Guta Saga: The Law and History of the Gotlanders is the first time that these two important texts have been translated into English and combined in one edition, accompanied by an extensive commentary and historical contextualisation by Christine Peel. In the Viking Age, the island of Gotland maintained its own law and administrative system. It was distinctive among Swedish provinces, retaining its own laws until 1645 while mainland provincial laws were all superseded by national law in the mid-fourteenth century. Preserved in eight manuscripts, it illustrates the everyday life and administrative system of the people of Gotland. Guta Saga tells the story of the island from its discovery by the legendary Þieluar, who removed the enchantment upon it which led to its inhabitation. Read together, the texts provide a complete picture of an island unique among Scandinavian provinces, offering a rare view of everyday people in medieval Scandinavia. This innovative and timely translation will be fascinating and essential reading for scholars of Scandinavian studies and legal history.

Book excerpt: This volume brings together fifteen articles exploring the linguistic and literary foundations of lexicography and lexicology. Topics explored here include a discussion of the relationships between lexicography and ideology in China; Frisian legal language and the Deutsches Rechtswörterbuch; the history and lexicography of Faroese; Wortgeschichte digital and its relation to Grimmian tradition; the linguistic history of phonetically imitative words; and studies of Croatian, Czech, English, Greek, and Turkish historical dictionaries. The book also presents a digital and textual study on the status of eponyms across the history of the Royal Society, as well as a study of German paronym dictionaries, a modern history of bilingual Russian-Tajik terminological dictionaries, and a historical overview of the lexicography of Frisian. The research findings and close readings by expert practitioners and historians of dictionaries and word studies found in the pages of this volume continue to broaden critical perspectives upon the study of manuscripts and print artifacts; dictionaries and standard varieties; biographies; bibliography and text analyses; dictionary production; and corpus and digital analyses.

Available in PDF, EPUB and Kindle. Book excerpt: The use of ordeals and sworn oaths to prove one's innocence invites trickery. The guilty trickster cannot influence the judgment of the divine powers, but he can--by disguise or by equivocation in wording the oath--create a presumption of innocence. Ralph Hexter surveys the varieties of such stories in a number of folk literatures and looks at the use of this motif in three important medieval story cycles, with special attention to the way Christian writers handled story material based on a pre-Christian act of truth.

Book excerpt: Much of what we know about the colourful Russian middle ages comes from legal sources: the treaties of Russian-Scandinavian warlords with the Byzantine emperors, the gradual penetration of Christianity and Byzantine institutions, the endless game of war and peace among the numerous regional princes, the activities of Hanseatic merchants in the wealthy city-republic of Novgorod, the curious relationships between the Mongol conquerors and Russian rulers and church dignitaries, etc. And, at the even further fringes of medieval Europe, there were the Christian kingdoms of Armenia and Georgia, squeezed between the Islamic empires of Iran and Turkey, but each possessing their elaborate and original legal systems. A discussion of more general questions of legal history and legal anthropology precedes the treatment of these various topics.

Available in PDF, EPUB and Kindle. Book excerpt: This study explores the prevalence in German culture of myths about ancient matriarchal societies, discussing their presence in left and right wing politics, feminist and antifeminist writing, sociology, psychoanalysis and literary production. By tracing the influence of the works of the Swiss jurist and theorist of matriarchy, Johann Jakob Bachofen (1815–1887), and the controversies about the reception and interpretation of his work, this study shows how debate about the matriarchal origins of culture was inextricably linked with anxieties about modernity and gender identities at the turn of the twentieth century. By moving beyond the discussion of canonical authors and taking seriously the scope of the discussion, it becomes clear that it is not possible to reduce matriarchal theories to any particular political ideology; instead, they function as a mythic counterdiscourse to a modernity conceived as oppressive, rational and masculine. Writers considered include Ludwig Klages, Hofmannsthal, Kafka, Hauptmann, Lou Andreas-Salomé, Sir Galahad, Clara Viebig, Mathilde Vaerting, Thomas Mann, Elisabeth Langgässer, Ilse Langner, Otto Gross, Franz Werfel, and many others.
