Book excerpt: The prerogative powers of ministers include some of the most important functions of government, such as decisions on armed conflict and the conclusion of international treaties. This report describes how such powers have come to be delegated. It also concludes that they should be more closely regulated. It proposes that the government should prepare a list of all prerogative powers, which would be considered by a parliamentary committee. Appropriate legislation, with any required statutory safeguards, would then be put into place. A draft Bill is appended to the report.

Book excerpt: Fresh, modern, and practical, Public Law provides law undergraduates with a unique approach to constitutional and administrative law, aptly demonstrating why this is an exciting time to be studying the subject. Writing in a fluid, succinct style, the authors carve a logical pathway through the key areas studied on the LLB, guiding students to a solid understanding of the fundamental principles. This theoretical grounding is then rooted in reality, with each concept applied to a hypothetical scenario (included at the start of each chapter) to set it into a practical context. While this practical element helps students to understand how the law applies and develop problem-solving skills, a trio of supportive learning features also encourages active engagement with and a critical appreciation of public law. 'Key case' boxes highlight and analyse the significant case law in each area; 'Counterpoint' boxes flag alternative viewpoints and areas of debate; and 'Pause for reflection' boxes prompt readers to consider the impact of laws, and what potential developments and reforms may lie ahead. Public Law's modern approach and unique combination of practical application and theoretically critical discussion makes it the ideal choice for students seeking to understand concepts not only in the abstract but in practice, helping them to develop the skills they need to succeed at university and beyond. Book excerpt: This is the seventh report on Ministerial Accountability and Parliamentary Questions and the last that covers the workings of the Code of Practice on Access to Government Information, as in January 2005 this Code was superseded by the Freedom of Information Act. Amongst its conclusions are a concerned that departments have failed to honour fully their undertaking to provide specific Code exemption when they failed to give answers on public interest grounds. The Committee will monitor the effect of the Freedom of Information Act but believes that Cabinet Office guidance is inconsistent with earlier practice and should be reconsidered. The Committee also recommend that there should be an annual report of departmental performance on named-day questions and they strongly deplore and attempt to use the new arrangements of dealing with Questions before Prorogation as a means of avoiding answering a Question.

Book excerpt: Britain's participation in the Iraq war defines one of the most tumultuous periods in its political history. Driven by a desire to enhance the influence of the British government on the world stage, the decision to support the US-led invasion has severely disrupted the stability of international relations, produced rising disenchantment with the domestic political process, and has threatened to undermine the continued viability of the New Labour project. Yet these developments are also indicative of a far-deeper malaise. The events surrounding the war have clearly exposed the flaws and weaknesses that are inherent within the British democratic system. A deep-seated adherence to a top-down style of policy-making at the expense of more participatory and accountable forms of governance has been amplified by the internal structures of the New Labour government itself. The consequences have left an indelible mark on Britain's political landscape that will endure for many years.

Available in PDF, EPUB and Kindle. Book excerpt: This book considers the function of the royal prerogative in the changing landscape of the British constitution. It explains each of the prerogative powers in separate chapters. It clarifies the respective roles of government, Parliament and the courts in defining the extent of prerogative powers, and in regulating their use. It also looks at which powers should be codified in statute, which should be regulated by convention, and which could be left at large. The book is very timely in contributing to current debates. The fevered parliamentary debates over Brexit thrust the prerogative centre-stage. Recent controversies have ranged from the role of Parliament in assenting to treaties, to the prorogation and dissolution of Parliament, to the grant or withholding of royal assent to bills. In their 2019 election manifesto, the Conservative Party stated that 'After Brexit we also need to look at the broader aspects of our constitution, the relationship between the Government, Parliament and the courts; the functioning of the Royal Prerogative...'. The book covers the whole range of prerogative powers, from going to war and ratifying treaties, appointing and dismissing ministers, regulating the civil service and public appointments, to the grant of honours and pardons and the issue of passports. Its 19 chapters provide a comprehensive guide to the operation of the prerogative – past, present, and future – together with suggestions for reform.

Available in PDF, EPUB and Kindle. Book excerpt: Following on from a Green Paper (Cm. 7170, ISBN 9780101717021) published in July 2007, this consultation document discusses ways of making the executive branch of government more accountable, focusing on two areas: the power to enter into international obligations (treaties) and the power to engage the country in war. Although these are two of the most important powers a government can wield, there is no legal requirement for the House of Commons to have any particular role in these decisions, with the executive traditionally deriving its powers from the ancient prerogatives of the Crown. This consultation paper considers how the role of Parliament can be strengthened in the conduct of diplomacy and armed conflict, whilst balancing this against the need for government to take swift action to protect national security and other national interests, and avoiding undermining operational security and effectiveness. The consultation period ends on 17/01/2008.

Available in PDF, EPUB and Kindle. Book excerpt: Interpretive Political Science is the second of two volumes featuring a selection of key writings by R.A.W. Rhodes. Volume II looks forward and explores the 'interpretive turn' and its implications for the craft of political science, especially public administration, and draws together articles from 2005 onwards on the theme of 'the interpretive turn' in political science. Part I provides a summary statement of the interpretive approach, and Part II develops the theme of blurring genres and discusses a variety of research methods common in the humanities, including: ethnographic fieldwork, life history, and focus groups. Part III demonstrates how the genres of thought and presentation found in the humanities can be used in political science. It presents four examples of such blurring 'at work' with studies of: applied anthropology and civil service reform; women's studies and government departments; and storytelling and local knowledge. The book concludes with a summary of what is edifying about an interpretive approach, and why this approach matters, and revisits some of the more common criticisms before indulging in plausible conjectures about the future of interpretivism. The author seeks new and interesting ways to explore governance, high politics, public policies, and the study of public administration in general. Volume I collects in one place for the first time the main articles written by Rhodes on policy networks and governance between 1990 and 2005, and explores a new way of describing British government, focusing on policy making and the ways in which policy is put into practice.

Available in PDF, EPUB and Kindle. Book excerpt: Situated between two different constitutional traditions, those of the United Kingdom and the United States, Canada has maintained a distinctive third way: federal, parliamentary, and flexible. Yet in recent years it seems that Canadian constitutional culture has been moving increasingly in an American direction. Through the prorogation crises of 2008 and 2009, its senate reform proposals, and the appointment process for Supreme Court judges, Stephen Harper's Conservative government has repeatedly shown a tendency to push Canada further into the US constitutional orbit. Red, White, and Kind of Blue? is a comparative legal analysis of this creeping Americanization, as well as a probing examination of the costs and benefits that come with it. Comparing British, Canadian, and American constitutional traditions, David Schneiderman offers a critical perspective on the Americanization of Canadian constitutional practice and a timely warning about its unexamined consequences.
