Book excerpt: This report, from the Public Administration Select Committee looks at the Governance of Britain Green Paper, as published on 3rd July 2007 (Cm.7170, ISBN 9780101717021). The stated aim of the document, by the Prime Minister, Gordon Brown, was "a new constitutional settlement that entrusts more power to Parliament and the British people", with two objectives as the bedrock to this approach: (i) to hold power more accountable; (ii) to uphold and enhance the rights and responsibilities of the citizen. The Committee commends the statement and the wide-ranging programme as set out in the Green Paper, and the call for wide consultation and cross-party input. The Committee sees the goals of a new constitutional settlement as ambitious and laudable, but which will require considerable care in establishing a rebalance, in the Committee's view, of the relationship between Government, Parliament and the public.

This book was released on 2004 with total page 212 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Joint Committee on Human Rights examined the implementation of the UN International Covenant on Economic, Social and Cultural Rights in the UK. Domestic legislation protects many of the economic, social and cultural rights, with the Covenant itself having little impact in UK domestic law. The Committee believes that there is scope for incorporating further protection of rights in the UK, by enshrining some of the guarantees contained in the Covenant. Further, that for the Covenant rights to be effective, they should be part of a framework for government policy development, and that Government along with the Commission for Equality and Human Rights should develop ways of measuring the progress of these rights. The Committee also recommends, that explanatory notes to Bills, should include discussion of the Bills compatibility with Covenant rights, which is a way of enhancing the scrutiny of proposed Government legislation. Furthermore, the Committee recommends the introduction of an Equality Bill, to address the concerns of discrimination faced by ethnic minorities and persons with disabilities in employment, housing and education.

Book excerpt: This report responds to the white paper "Fairness for all: a new Commission for Equality and Human Rights" (Cm. 6185, ISBN 0101618522, issued 12 May 2004), which proposed a new single body with responsibility for promoting equality throughout society, building on the strengths of existing Commissions (the Commission for Racial Equality, the Disability Rights Commission and the Equal Opportunities Commission). There is broad agreement between the white paper's proposals and the Committee's own proposals (11th report, HLP 78 / HCP 536 session 2003-04, ISBN 010400452, issued 5 May 2004). The areas of divergence include the following: the precise nature of the general duty to be placed upon the CEHR in relation to the promotion and protection of human rights; the details of the power of the CEHR to conduct "general inquiries"; the case for giving the Commission power to seek judicial review of the policies, actions and omissions of public authorities; and the institutional and funding arrangements to secure the independence and accountability of the new body.

Available in PDF, EPUB and Kindle. Book excerpt: This book is a detailed examination of whether domestic security measures are striking an appropriate balance between homeland security and civil liberties in the post-9/11 era. Professor Paul Wilkinson and the other contributors assess the nature of UK responses to terrorism by key public and private-sector bodies, highlighting how these organizations can prevent, pre-empt, counter and manage terrorist attacks by using a matrix of factors such as types of terrorist networks, tactics and targets. The volume also compares and contrasts the UK's response with cognate states elsewhere in the EU and with the USA. While improved intelligence has helped prevent a major Al Qaeda attack, the authors conclude that there is still a ‘major question mark’ over whether the country is adequately resourced to deal with an emergency situation, particularly in major cities other than London. The book also confirms that while the UK faces a ‘real and serious’ threat of terrorist attack by Al Qaeda, it is better prepared for an attack than other EU member states. Homeland Security in the UK will be essential reading for all students of terrorism studies, security studies and politics, as well as by professional practitioners and well-informed general readers.

Available in PDF, EPUB and Kindle. Book excerpt: This book investigates and analyses how administrative law works in practice through a detailed case-study and evaluation of one of the UK's largest and most important administrative agencies, the immigration department. In doing so, the book broadens the conversation of administrative law beyond the courts to include how administrative agencies themselves make, apply, and enforce the law. Blending theoretical and empirical administrative-legal analysis, the book demonstrates why we need to pay closer attention to what government agencies actually do, how they do it, how they are organised, and held to account. Taking a contextual approach, the book provides a detailed analysis of how the immigration department performs its core functions of making policy and law, taking mass casework decisions, and enforcing immigration law. The book considers major recent episodes of immigration administration including the development of the hostile environment policy and the treatment of the Windrush generation. By examining a diverse range of material, the book presents a model of administrative law based upon the organisational competence and capacity of administration and its institutional design. Alongside diagnosing the immigration department's failings, the book advances positive proposals for its reform.

This book was released on 2003 with total page 100 pages. Available in PDF, EPUB and Kindle. Book excerpt: The report examines how science and technology is used in countermeasures to chemical, biological, radiological and nuclear (CBRN) devices employed by terrorists. Areas of good practice are pointed out, for example the Office of the Deputy Prime Minister's (ODPM's) New Dimension programme of procurement for the Fire Service, but there has been very little new investment in long-term research and development in this field, for instance, the lack of emphasis on scientific research in the Home Office. The Committee proposes a Centre for Home Defence, under the Home Office, to develop technologies for civilian use. The surveillance of dangerous chemicals and pathogens, both nationally and internationally, is a matter or concern. The Government has also imposed an unnecessary and counterproductive level of secrecy surrounding its counter-terrorism research.

Book excerpt: The Committee's report examines the Children Bill as introduced into the Commons in July 2004 (HCB 144, ISBN 0215704479), following Lords amendments. In particular, the report focuses on the parts of the Bill relating to: the creation of the post of Children's Commissioner for England; strengthening the legal framework of co-operation between agencies delivering children's services; as well as clause 49 of the Bill on the corporal punishment of children and the restriction of the defence of 'reasonable chastisement', in light of the UK's obligations under the UN Convention on the Rights of the Child and the European Convention on Human Rights. Conclusions reached include i) support for the creation of an independent rights-based office of Children's Commissioner; and ii) that the continuing availability of the defence of reasonable chastisement is incompatible with the UK's obligations under the UN Convention and other international agreements.

Available in PDF, EPUB and Kindle. Book excerpt: 8 February 2015 marked the 200th anniversary of the birth of Thomas Erskine May. May is the most famous of the fifty holders of the office of Clerk of the House of Commons. His continued renown arises from his Treatise upon the Law, Privileges, Proceedings and Usage of Parliament, first published in 1844 and with its 25th edition currently in preparation. It is known throughout those parts of the world that model their constitutional arrangements on Westminster as the 'Bible of Parliamentary Procedure'. This volume celebrates both the man and his book. Bringing together current and former Clerks in the House of Commons and outside experts, the contributors analyse May's profound contribution to the shaping of the modern House of Commons, as it made the transition from the pre-Reform Act House to the modern core of the UK's constitutional democracy in his lifetime. This is perhaps best symbolised by its enforced transition between 1834 and 1851 from a mediaeval slum to the World Heritage Palace of Westminster, which is the most iconic building in the UK. The book also considers the wider context of parliamentary law and procedure, both before and after May's time. It constitutes the first sustained analysis of the development of parliamentary procedure in over half a century, attempting to situate the reforms in the way the central institution of our democracy conducts itself in the political contexts which drove those changes.
